  1  4 RELATING TO THE DISTRIBUTION OF MONEYS HELD IN TRUST FOR A
  1  5    PARTICIPANT IN THE CERTIFIED SCHOOL TO CAREER PROGRAM.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 15.364, subsection 9, paragraph b, Code
  1 10 1999, is amended to read as follows:
  1 11    b.  That if a participant does not complete the certified
  1 12 program contemplated by the agreement prior to entering a
  1 13 postsecondary education program, one-half of the moneys being
  1 14 held in trust for the participant's postsecondary education
  1 15 shall be paid either to a postsecondary education institution
  1 16 as defined in section 261C.3 of the participant's choice or,
  1 17 notwithstanding any provision of this part to the contrary, to
  1 18 an apprenticeship program of the participant's choice which
  1 19 has been approved under 29 C.F.R., subtit. A, pt. 29, to pay
  1 20 tuition or expenses of the participant.  The other one-half of
  1 21 the trust moneys shall be paid back to the employer.  Any
  1 22 moneys to be transferred for the benefit of the participant
  1 23 which are not transferred within five years for purposes of
  1 24 education at the designated postsecondary institution, shall
  1 25 be paid back to the employer.
