1 1 Amend Senate File 2429, as passed by the Senate, as
1 2 follows:
1 3 #1. Page 7, line 25, by striking the word
1 4 "program." and inserting the following: "program, and
1 5 as a part of the department's lead abatement efforts,
1 6 and as a condition of this allocation, the department
1 7 shall establish by rule model lead hazard remediation
1 8 requirements for residential properties to address the
1 9 health and environmental needs of children who are
1 10 confirmed as lead poisoned. The purpose of the
1 11 requirements shall be to prevent ongoing and future
1 12 exposure to lead-based paint hazards. Local boards of
1 13 health may adopt and enforce the requirements or may
1 14 adopt the requirements and request that the
1 15 requirements be enforced by the state. However, local
1 16 boards of health shall not be required to adopt and
1 17 enforce the requirements. The state may not enforce
1 18 the requirements unless the requirements have been
1 19 adopted by the local board of health and the local
1 20 board of health has requested that the state enforce
1 21 the requirements."
