  1  1    Amend Senate File 2241, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting before line 1 the
  1  4 following:
  1  5    "Section 1.  Section 124.401, subsection 5,
  1  6 unnumbered paragraph 1, Code Supplement 1999, is
  1  7 amended to read as follows:
  1  8    It is unlawful for any person knowingly or
  1  9 intentionally to possess a controlled substance unless
  1 10 such substance was obtained directly from, or pursuant
  1 11 to, a valid prescription or order of a practitioner
  1 12 while acting in the course of the practitioner's
  1 13 professional practice, or except as otherwise
  1 14 authorized by this chapter.  Any person who violates
  1 15 this subsection is guilty of a serious misdemeanor for
  1 16 a first offense.  A person who commits a violation of
  1 17 this subsection and who has previously been convicted
  1 18 of violating this subsection chapter or chapter 124A,
  1 19 124B, or 453B is guilty of an aggravated misdemeanor.
  1 20 A person who commits a violation of this subsection
  1 21 and has previously been convicted two or more times of
  1 22 violating this subsection chapter or chapter 124A,
  1 23 124B, or 453B is guilty of a class "D" felony."
  1 24    #2.  Title page, lines 1 and 2, by striking the
  1 25 words "consolidation of certain criminal offenses
  1 26 concerning" and inserting the following:  "criminal
  1 27 offenses concerning possession of a controlled
  1 28 substance,".
  1 29    #3.  By renumbering as necessary.
