1 2 #1. Page 30, by inserting after line 4 the
1 3 following:
1 4 "y. A commitment to at least once annually,
1 5 provide a written statement to the competitive
1 6 electric service provider's customers of such
1 7 provider's policy regarding the sale or other
1 8 disposition of customer information to other persons.
1 9 The written statement shall be provided to the
1 10 competitive electric service provider's customers no
1 11 less than sixty days prior to any change in the
1 12 policy. The written statement shall explain the
1 13 change, and state the effective date of the change,
1 14 and whether or not the competitive electric service
1 15 provider has provided a written statement pursuant to
1 16 this section within the previous year. The written
1 17 statement shall provide the address and telephone
1 18 number of a person whom the customer can contact to
1 19 request that information regarding the customer not be
1 20 sold to any other person by the competitive electric
1 21 service provider. Upon the receipt of such a request,
1 22 the competitive electric service provider shall not
1 23 sell or otherwise provide information to any other
1 24 person regarding the customer making the request.
1 25 The written statement shall include the address and
1 26 phone number of the board and state that a complaint
1 27 regarding the sale of customer information may be made
1 28 to the board. The written statement shall also state
1 29 that a competitive electric service provider that
1 30 sells or otherwise provides customer information to
1 31 another person in violation of this section may be
1 32 subject to a civil penalty of one thousand dollars.
1 33 In addition to any other applicable penalty, a
1 34 competitive electric service provider violating this
1 35 paragraph is subject to a civil penalty of one
1 36 thousand dollars for each violation."
