  1  1                 COLLEGE STUDENT AID COMMISSION
  1  2    Section 1.  There is appropriated from the general fund of
  1  3 the state to the college student aid commission for the fiscal
  1  4 year beginning July 1, 1997, and ending June 30, 1998, the
  1  5 following amounts, or so much thereof as may be necessary, to
  1  6 be used for the purposes designated:
  1  7    1.  GENERAL ADMINISTRATION
  1  8    For salaries, support, maintenance, miscellaneous purposes,
  1  9 and for not more than the following full-time equivalent
  1 10 positions:  
  1 11 .................................................. $    310,847
  1 12 ............................................... FTEs       6.65
  1 13    Prior to distributing tuition grant moneys to an eligible
  1 14 accredited private institution, the college student aid
  1 15 commission shall receive from the institution the actual
  1 16 enrollment count of students awarded tuition grants enrolled
  1 17 in the institution following the start of the semester or
  1 18 quarter.
  1 19    It is the intent of the general assembly that the college
  1 20 student aid commission extend the vocational-technical tuition
  1 21 grant application deadline date, as nearly as practicable, to
  1 22 the beginning of the fall, spring, and summer semesters,
  1 23 quarters, or equivalent community college terms.
  1 24    If the amount of federal moneys received by the college
  1 25 student aid commission during the fiscal year beginning July
  1 26 1, 1997, and ending June 30, 1998, for state student incentive
  1 27 grants exceeds the amount of federal moneys received for those
  1 28 programs during the fiscal year beginning July 1, 1996, and
  1 29 ending June 30, 1997, the additional moneys received during
  1 30 the fiscal year beginning July 1, 1997, shall be used for
  1 31 vocational-technical tuition grants as provided in section
  1 32 261.17.  Additional moneys used as provided in this unnumbered
  1 33 paragraph shall supplement, not supplant, moneys appropriated
  1 34 or allocated by the general assembly for purposes of awarding
  1 35 vocational-technical tuition grants as provided in section
  2  1 261.17.
  2  2    2.  UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH SCIENCES
  2  3    a.  For forgivable loans to Iowa students attending the
  2  4 university of osteopathic medicine and health sciences, under
  2  5 the forgivable loan program pursuant to section 261.19A:  
  2  6 .................................................. $    379,260
  2  7    b.  For the university of osteopathic medicine and health
  2  8 sciences for an initiative in primary health care to direct
  2  9 primary care physicians to shortage areas in the state:

  2 11    3.  STUDENT AID PROGRAMS
  2 12    For payments to students for the Iowa grant program:

  2 15    For purposes of providing national guard tuition aid under
  2 16 the program established in section 261.21:

  2 18    Sec. 2.  Notwithstanding section 261.21, for the fiscal
  2 19 year beginning July 1, 1997, and ending June 30, 1998, a
  2 20 national guard member who has earned college credit hours in
  2 21 an amount necessary to be considered a junior or senior is
  2 22 ineligible for the national guard tuition aid program.
  2 23    Sec. 3.  There is appropriated from the loan reserve
  2 24 account to the college student aid commission for the fiscal
  2 25 year beginning July 1, 1997, and ending June 30, 1998, the
  2 26 following amount, or so much thereof as may be necessary, to
  2 27 be used for the purpose designated:
  2 28    For operating costs of the Stafford loan program including
  2 29 salaries, support, maintenance, miscellaneous purposes, and
  2 30 for not more than the following full-time equivalent
  2 31 positions:

  2 34    Sec. 4.  Notwithstanding the maximum allowed balance
  2 35 requirement of the scholarship and tuition grant reserve fund
  3  1 as provided in section 261.20, there is appropriated from the
  3  2 scholarship and tuition grant reserve fund to the college
  3  3 student aid commission for the fiscal year beginning July 1,
  3  4 1997, and ending June 30, 1998, the moneys remaining in the
  3  5 fund following transfer, pursuant to section 261.20 for the
  3  6 fiscal years ending June 30, 1996, and June 30, 1997, which
  3  7 are to be used for purposes of Iowa vocational-technical
  3  8 tuition grants in accordance with section 261.17.  Funds
  3  9 appropriated in this section are in addition to funds
  3 10 appropriated in section 261.25, subsection 3.  
  3 11                 DEPARTMENT OF CULTURAL AFFAIRS
  3 12    Sec. 5.  There is appropriated from the general fund of the
  3 13 state to the department of cultural affairs for the fiscal
  3 14 year beginning July 1, 1997, and ending June 30, 1998, the
  3 15 following amounts, or so much thereof as is necessary, to be
  3 16 used for the purposes designated:
  3 17    1.  ARTS DIVISION
  3 18    For salaries, support, maintenance, miscellaneous purposes,
  3 19 including funds to match federal grants, for areawide arts and
  3 20 cultural service organizations that meet the requirements of
  3 21 chapter 303C, and for not more than the following full-time

  4 14    Sec. 6.   Notwithstanding section 8.33 and 1996 Iowa Acts,
  4 15 chapter 1215, section 5, subsection 3, of the funds
  4 16 appropriated and allocated for historic sites pursuant to 1996
  4 17 Iowa Acts, chapter 1215, section 5, subsection 3, that remain
  4 18 unencumbered or unobligated on June 30, 1997, the amount of
  4 19 $50,000 shall not revert to the general fund of the state but
  4 20 shall be allocated to the department of cultural affairs which
  4 21 shall distribute the moneys to the Iowa state arts council for
  4 22 the fiscal year beginning July 1, 1997, and ending June 30,
  4 23 1998, for purposes of awarding operational support grants.  
  4 24                     DEPARTMENT OF EDUCATION
  4 25    Sec. 7.  There is appropriated from the general fund of the
  4 26 state to the department of education for the fiscal year
  4 27 beginning July 1, 1997, and ending June 30, 1998, the
  4 28 following amounts, or so much thereof as may be necessary, to
  4 29 be used for the purposes designated:
  4 30    1.  GENERAL ADMINISTRATION
  4 31    For salaries, support, maintenance, miscellaneous purposes,
  4 32 and for not more than the following full-time equivalent

  5  1    The department of education shall conduct a study of phase
  5  2 I of the educational excellence program as provided in chapter
  5  3 294A.  The purpose of the study shall be to determine options
  5  4 for decreasing the need for state funding of phase I of the
  5  5 education excellence program and for shifting funding to phase
  5  6 II of the educational excellence program.  The department
  5  7 shall submit a report of its findings and recommendations to
  5  8 the general assembly by December 31, 1997.
  5  9    2.  VOCATIONAL EDUCATION ADMINISTRATION

  5 27    The division of vocational rehabilitation services shall
  5 28 seek funds other than federal funds, which may include but are
  5 29 not limited to local funds from local provider entities,
  5 30 community colleges, area education agencies, and local
  5 31 education agencies, for purposes of matching federal
  5 32 vocational rehabilitation funds.  The funds collected by the
  5 33 division may exceed the amount needed to match available
  5 34 federal vocational rehabilitation funds in an effort to
  5 35 qualify for additional federal funds when such funds become
  6  1 available.
  6  2    Notwithstanding the full-time equivalent position limit
  6  3 established in this subsection, for the fiscal year ending
  6  4 June 30, 1998, if federal funding is received to pay the costs
  6  5 of additional employees for the vocational rehabilitation
  6  6 services division who would have duties relating to vocational
  6  7 rehabilitation services paid for through federal funding,
  6  8 authorization to hire not more than four additional full-time
  6  9 equivalent employees shall be provided, the full-time
  6 10 equivalent position limit shall be exceeded, and the
  6 11 additional employees shall be hired by the division.
  6 12    b.  For matching funds for programs to enable persons with
  6 13 severe physical or mental disabilities to function more
  6 14 independently, including salaries and support, and for not
  6 15 more than the following full-time equivalent positions:

  7 11 expenditures made by school districts to meet the standards
  7 12 set in sections 256.11, 258.4, and 260C.14 as a result of the
  7 13 enactment of 1989 Iowa Acts, chapter 278.  Funds shall be used
  7 14 as reimbursement for vocational education expenditures made by
  7 15 secondary schools in the manner provided by the department of
  7 16 education for implementation of the standards set in 1989 Iowa
  7 17 Acts, chapter 278.
  7 18    10.  SCHOOL FOOD SERVICE
  7 19    For use as state matching funds for federal programs that
  7 20 shall be disbursed according to federal regulations, including
  7 21 salaries, support, maintenance, miscellaneous purposes, and
  7 22 for not more than the following full-time equivalent
  7 23 positions:

  7 26    11.  TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS
  7 27    To provide funds for costs of providing textbooks to each

  7 30 shall not exceed the comparable services offered to resident

  9  8    Sec. 8.  Notwithstanding section 8.33 and section 256.39,
  9  9 subsection 7, unobligated or unencumbered moneys remaining on
  9 10 June 30, 1997, from the appropriation made in 1995 Iowa Acts,
  9 11 chapter 218, section 1, subsection 11, for purposes of the
  9 12 career pathways program, shall not revert but shall be
  9 13 available for expenditure for the program during the fiscal
  9 14 year beginning July 1, 1997, and ending June 30, 1998.
  9 15    Sec. 9.  Notwithstanding section 8.33, of the unencumbered
  9 16 or unobligated funds remaining on June 30, 1997, from moneys
  9 17 appropriated in 1996 Iowa Acts, chapter 1215, section 6,
  9 18 subsection 5, $120,000 shall not revert to the general fund of
  9 19 the state but shall be available the following fiscal year for
  9 20 expenditure for maintenance of the state of Iowa libraries
  9 21 online (SILO) program.
  9 22    Sec. 10.  A school district shall not receive funds from
  9 23 the new Iowa schools development corporation for more than
  9 24 three consecutive years.  The corporation shall place a high
  9 25 priority on increasing the number of school districts the
  9 26 corporation serves.  The corporation shall study the methods
  9 27 by which it can increase the number of school districts
  9 28 served, analyze the services provided to school districts, and
  9 29 determine the average amount of time necessary to adequately
  9 30 serve a school district.  The corporation shall submit its
  9 31 findings and recommendations to the general assembly by
  9 32 December 31, 1997.  
  9 33                     STATE BOARD OF REGENTS
  9 34    Sec. 11.  There is appropriated from the general fund of
  9 35 the state to the state board of regents for the fiscal year
 10  1 beginning July 1, 1997, and ending June 30, 1998, the
 10  2 following amounts, or so much thereof as may be necessary, to
 10  3 be used for the purposes designated:
 10  4    1.  OFFICE OF STATE BOARD OF REGENTS
 10  5    a.  For salaries, support, maintenance, miscellaneous
 10  6 purposes, and for not more than the following full-time
 10  7 equivalent positions:

 10 10    If the moneys appropriated in this lettered paragraph are
 10 11 augmented by reimbursements from the institutions under the
 10 12 control of the state board of regents for the funding of the
 10 13 office of the state board of regents, the office shall report
 10 14 quarterly such reimbursements to the chairpersons and ranking
 10 15 members of the joint appropriations subcommittee on education.
 10 16    The board shall prepare and submit a quarterly report,
 10 17 regarding the board office budget and the reimbursements
 10 18 provided to the board by the institutions of higher learning
 10 19 under the control of the board, to the general assembly and
 10 20 the legislative fiscal bureau.
 10 21    b.  For allocation by the state board of regents to the
 10 22 state university of Iowa, the Iowa state university of science
 10 23 and technology, and the university of northern Iowa to
 10 24 reimburse the institutions for deficiencies in their operating
 10 25 funds resulting from the pledging of tuitions, student fees
 10 26 and charges, and institutional income to finance the cost of
 10 27 providing academic and administrative buildings and facilities
 10 28 and utility services at the institutions:

 10 30    (1)  The state board of regents, the department of
 10 31 management, and the legislative fiscal bureau shall cooperate
 10 32 to determine and agree upon, by November 15, 1997, the amount
 10 33 that needs to be appropriated for tuition replacement for the
 10 34 fiscal year beginning July 1, 1998.
 10 35    (2)  Notwithstanding section 8.33, funds appropriated in
 11  1 this lettered paragraph remaining unencumbered or unobligated
 11  2 on June 30, 1998, shall not revert to the general fund of the
 11  3 state but shall be available for expenditure for the purposes
 11  4 listed in this lettered paragraph during the subsequent fiscal
 11  5 year.
 11  6    c.  For funds to be allocated to the southwest Iowa
 11  7 graduate studies center:

 11 33    For salaries, support, maintenance, equipment, and
 11 34 miscellaneous purposes and for medical and surgical treatment
 11 35 of indigent patients as provided in chapter 255, for medical
 12  1 education, and for not more than the following full-time
 12  2 equivalent positions:

 12  5    The university of Iowa hospitals and clinics, the Iowa
 12  6 department of corrections, and the association of Iowa
 12  7 hospitals and health systems shall jointly develop and issue
 12  8 recommendations relating to localizing indigent health care
 12  9 services, including but not limited to health care services to
 12 10 inmates, in a report to be submitted to the general assembly
 12 11 by January 1, 1998.
 12 12    The university of Iowa hospitals and clinics shall submit
 12 13 quarterly a report regarding the portion of the appropriation
 12 14 in this lettered paragraph expended on medical education.  The
 12 15 report shall be submitted in a format jointly developed by the
 12 16 university of Iowa hospitals and clinics, the legislative
 12 17 fiscal bureau, and the department of management, and shall
 12 18 delineate the expenditures and purposes of the funds.
 12 19    Funds appropriated in this lettered paragraph shall not be
 12 20 used to perform abortions except medically necessary
 12 21 abortions, and shall not be used to operate the early
 12 22 termination of pregnancy clinic except for the performance of
 12 23 medically necessary abortions.  For the purpose of this
 12 24 lettered paragraph, an abortion is the purposeful interruption
 12 25 of pregnancy with the intention other than to produce a live-
 12 26 born infant or to remove a dead fetus, and a medically
 12 27 necessary abortion is one performed under one of the following
 12 28 conditions:
 12 29    (1)  The attending physician certifies that continuing the
 12 30 pregnancy would endanger the life of the pregnant woman.
 12 31    (2)  The attending physician certifies that the fetus is
 12 32 physically deformed, mentally deficient, or afflicted with a
 12 33 congenital illness.
 12 34    (3)  The pregnancy is the result of a rape which is
 12 35 reported within 45 days of the incident to a law enforcement
 13  1 agency or public or private health agency which may include a
 13  2 family physician.
 13  3    (4)  The pregnancy is the result of incest which is
 13  4 reported within 150 days of the incident to a law enforcement
 13  5 agency or public or private health agency which may include a
 13  6 family physician.
 13  7    (5)  The abortion is a spontaneous abortion, commonly known
 13  8 as a miscarriage, wherein not all of the products of
 13  9 conception are expelled.
 13 10    The total quota allocated to the counties for indigent
 13 11 patients for the fiscal year beginning July 1, 1997, shall not
 13 12 be lower than the total quota allocated to the counties for
 13 13 the fiscal year commencing July 1, 1996.  The total quota
 13 14 shall be allocated among the counties on the basis of the 1990
 13 15 census pursuant to section 255.16.

 13 19 maintenance of committed and voluntary public patients, and

 17 12    Sec. 12.  Reallocations of sums received under section 11,

 17 18    Sec. 13.  Notwithstanding section 8.33, funds appropriated
 17 19 in 1996 Iowa Acts, chapter 1215, section 12, subsection 1,
 17 20 paragraph "b", remaining unencumbered or unobligated on June
 17 21 30, 1997, shall not revert to the general fund of the state
 17 22 but shall be available for expenditure for the purposes listed
 17 23 in section 11, subsection 1, paragraph "b", of this Act during
 17 24 the fiscal year beginning July 1, 1997, and ending June 30,
 17 25 1998.
 17 26    Sec. 14.  MEDICAL ASSISTANCE – SUPPLEMENTAL AMOUNTS.  For
 17 27 the fiscal year beginning July 1, 1997, and ending June 30,
 17 28 1998, the department of human services shall continue the
 17 29 supplemental disproportionate share and a supplemental
 17 30 indirect medical education adjustment applicable to state-
 17 31 owned acute care hospitals with more than 500 beds and shall
 17 32 reimburse qualifying hospitals pursuant to that adjustment
 17 33 with a supplemental amount for services provided medical
 17 34 assistance recipients.  The adjustment shall generate
 17 35 supplemental payments intended to equal the state
 18  1 appropriation made to a qualifying hospital for treatment of
 18  2 indigent patients as provided in chapter 255.  To the extent
 18  3 of the supplemental payments, a qualifying hospital shall,
 18  4 after receipt of the funds, transfer to the department of
 18  5 human services an amount equal to the actual supplemental
 18  6 payments that were made in that month.  The aggregate amounts
 18  7 for the fiscal year shall not exceed the state appropriation
 18  8 made to the qualifying hospital for treatment of indigent
 18  9 patients as provided in chapter 255.  The department of human
 18 10 services shall deposit the portion of these funds equal to the
 18 11 state share in the department's medical assistance account and
 18 12 the balance shall be credited to the general fund of the
 18 13 state.  To the extent that state funds appropriated to a
 18 14 qualifying hospital for the treatment of indigent patients as
 18 15 provided in chapter 255 have been transferred to the
 18 16 department of human services as a result of these supplemental
 18 17 payments made to the qualifying hospital, the department shall
 18 18 not, directly or indirectly, recoup the supplemental payments
 18 19 made to a qualifying hospital for any reason, unless an
 18 20 equivalent amount of the funds transferred to the department
 18 21 of human services by a qualifying hospital pursuant to this
 18 22 provision is transferred to the qualifying hospital by the
 18 23 department.
 18 24    If the state supplemental amount allotted to the state of
 18 25 Iowa for the federal fiscal year beginning October 1, 1997,
 18 26 and ending September 30, 1998, pursuant to section 1923 (f)(3)
 18 27 of the federal Social Security Act, as amended, or pursuant to
 18 28 federal payments for indirect medical education is greater
 18 29 than the amount necessary to fund the federal share of the
 18 30 supplemental payments specified in the preceding paragraph,
 18 31 the department of human services shall increase the
 18 32 supplemental disproportionate share or supplemental indirect
 18 33 medical education adjustment by the lesser of the amount
 18 34 necessary to utilize fully the state supplemental amount or
 18 35 the amount of state funds appropriated to the state university
 19  1 of Iowa general education fund and allocated to the university
 19  2 for the college of medicine.  The state university of Iowa
 19  3 shall transfer from the allocation for the college of medicine
 19  4 to the department of human services, on a monthly basis, an
 19  5 amount equal to the additional supplemental payments made
 19  6 during the previous month pursuant to this paragraph.  A
 19  7 qualifying hospital receiving supplemental payments pursuant
 19  8 to this paragraph that are greater than the state
 19  9 appropriation made to the qualifying hospital for treatment of
 19 10 indigent patients as provided in chapter 255 shall be
 19 11 obligated as a condition of its participation in the medical
 19 12 assistance program to transfer to the state university of Iowa
 19 13 general education fund on a monthly basis an amount equal to
 19 14 the funds transferred by the state university of Iowa to the
 19 15 department of human services.  To the extent that state funds
 19 16 appropriated to the state university of Iowa and allocated to
 19 17 the college of medicine have been transferred to the
 19 18 department of human services as a result of these supplemental
 19 19 payments made to the qualifying hospital, the department shall
 19 20 not, directly or indirectly, recoup these supplemental
 19 21 payments made to a qualifying hospital for any reason, unless
 19 22 an equivalent amount of the funds transferred to the
 19 23 department of human services by the state university of Iowa
 19 24 pursuant to this paragraph is transferred to the qualifying
 19 25 hospital by the department.
 19 26    Continuation of the supplemental disproportionate share and
 19 27 supplemental indirect medical education adjustment shall
 19 28 preserve the funds available to the university hospital for
 19 29 medical and surgical treatment of indigent patients as
 19 30 provided in chapter 255 and to the state university of Iowa
 19 31 for educational purposes at the same level as provided by the
 19 32 state funds initially appropriated for that purpose.
 19 33    The department of human services shall, in any compilation
 19 34 of data or other report distributed to the public concerning
 19 35 payments to providers under the medical assistance program,
 20  1 set forth reimbursements to a qualifying hospital through the
 20  2 supplemental disproportionate share and supplemental indirect
 20  3 medical education adjustment as a separate item and shall not
 20  4 include such payments in the amounts otherwise reported as the
 20  5 reimbursement to a qualifying hospital for services to medical
 20  6 assistance recipients.
 20  7    For purposes of this section, "supplemental payment" means
 20  8 a supplemental payment amount paid for medical assistance to a
 20  9 hospital qualifying for that payment under this section.
 20 10    Sec. 15.  For the fiscal year beginning July 1, 1997, and
 20 11 ending June 30, 1998, the state board of regents may use
 20 12 notes, bonds, or other evidences of indebtedness issued under
 20 13 section 262.48 to finance projects that will result in energy
 20 14 cost savings in an amount that will cause the state board to
 20 15 recover the cost of the projects within an average of six
 20 16 years.
 20 17    Sec. 16.  REMAINING INTEREST FOR IOWA SCHOOLS FUND BALANCE.
 20 18 Notwithstanding section 257B.1A, subsection 5, Code 1995, or
 20 19 any other provision to the contrary, the interest remaining
 20 20 unencumbered or unobligated on June 30, 1996, in the interest
 20 21 for Iowa schools fund, after the total of the transfer of
 20 22 moneys to the first in the nation in education foundation
 20 23 pursuant to section 257B.1A, subsection 2, and after the
 20 24 transfer of moneys to the international center endowment fund
 20 25 in section 257B.1A, subsection 3, paragraph "a", shall be
 20 26 transferred to the state board of regents, which shall
 20 27 distribute the moneys by July 1, 1997, to an institution of
 20 28 higher learning under its control for the fiscal year
 20 29 beginning July 1, 1997, and ending June 30, 1998, for purposes
 20 30 of the reading recovery program.
 20 31    Sec. 17.  Notwithstanding section 270.7, the department of
 20 32 revenue and finance shall pay the state school for the deaf
 20 33 and the Iowa braille and sight saving school the moneys
 20 34 collected from the counties during the fiscal year beginning
 20 35 July 1, 1997, for expenses relating to prescription drug costs
 21  1 for students attending the state school for the deaf and the
 21  2 Iowa braille and sight saving school.
 21  3    Sec. 18.  Section 257A.8, Code 1997, is amended to read as
 21  4 follows:
 21  5    257A.8  ADMINISTRATIVE ACTIVITIES.
 21  6    The administrative functions of the foundation shall be
 21  7 performed by the department of education university of
 21  8 northern Iowa.  The foundation office shall be located in on
 21  9 the department of education offices campus of the university
 21 10 of northern Iowa.
 21 11    Sec. 19.  Section 257B.1A, Code 1997, is amended by
 21 12 striking the section and inserting in lieu thereof the
 21 13 following:
 21 14    257B.1A  INTEREST FOR IOWA SCHOOLS FUND – TRANSFER OF
 21 15 INTEREST.
 21 16    1.  The interest for Iowa schools fund is established in
 21 17 the office of the treasurer of state.  The department of
 21 18 revenue and finance shall deposit interest earned on the
 21 19 permanent school fund in the interest for Iowa schools fund.
 21 20 Of the interest deposited in the interest for Iowa schools
 21 21 fund each year, fifty percent shall be transferred to the
 21 22 first in the nation in education foundation as established in
 21 23 section 257A.1 and fifty percent shall be transferred to the
 21 24 international center for gifted and talented education
 21 25 endowment fund established in section 263.8A.  The department
 21 26 of revenue and finance shall transfer interest as provided in
 21 27 this section on a quarterly basis.  As a condition of
 21 28 receiving funds under this section, the foundation and the
 21 29 center shall maintain and continue to increase the balances of
 21 30 their private foundations.  In addition, the foundation and
 21 31 the center shall each certify to the department of revenue and
 21 32 finance and the general assembly, by January 1 of each year,
 21 33 the cumulative total value of contributions received during
 21 34 the preceding calendar year.
 21 35    2.  If the general assembly appropriates funds to the
 22  1 international center endowment fund in the amount of not less
 22  2 than eight hundred seventy-five thousand dollars prior to July
 22  3 1, 1998, the center's interest allocation shall decrease to
 22  4 twenty-five percent.  If the general assembly appropriates
 22  5 funds to the international center endowment fund in an amount
 22  6 of not less than one million five hundred fifty thousand
 22  7 dollars, the center shall no longer receive an interest
 22  8 allocation.
 22  9    3.  The foundation and the center shall use for
 22 10 administrative costs not more than twenty-five percent of any
 22 11 moneys received annually pursuant to this section.
 22 12    Sec. 20.  Section 260C.22, subsection 4, unnumbered
 22 13 paragraph 2, Code 1997, is amended to read as follows:
 22 14    The revenues derived from the levies shall be placed in a
 22 15 separate cash reserve fund.  Notwithstanding subsection 3,
 22 16 moneys from the cash reserve fund established by a merged area
 22 17 under subsection 3 or this subsection shall be used only to
 22 18 alleviate temporary cash shortages and for the acquisition,
 22 19 lease, lease-purchase, installation, and maintenance of
 22 20 instructional technology equipment, including hardware and
 22 21 software, materials and supplies, and staff development and
 22 22 training related to instructional technology.  If moneys from
 22 23 the cash reserve fund are used to alleviate a temporary cash
 22 24 shortage, the cash reserve fund shall be reimbursed
 22 25 immediately from the general fund of the community college as
 22 26 funds in the general fund become available, but in no case
 22 27 later than June 30 of the current fiscal year, to repay the
 22 28 funds taken from the cash reserve fund.
 22 29    Sec. 21.  Section 260C.29, subsections 1 and 2, Code 1997,
 22 30 are amended to read as follows:
 22 31    1.  The mission of the career opportunity academic
 22 32 incentives for minorities program established in this section
 22 33 is to encourage collaborative efforts by a community college
 22 34 colleges, the institutions of higher learning under the
 22 35 control of the state board of regents, and business and
 23  1 industry to enhance the educational opportunities and provide
 23  2 for job creation and career advancement for Iowa's minority
 23  3 persons minorities by providing assistance to minority persons
 23  4 minorities who major in fields or subject areas where
 23  5 minorities are currently underrepresented or underutilized.
 23  6    2.  A career opportunity An academic incentives for
 23  7 minorities program is established to be administered by the a
 23  8 community college located in a county with a population in
 23  9 excess of three hundred thousand.  The community college shall
 23 10 provide office space for the efficient operation of the
 23 11 program.  The community college shall employ a director for
 23 12 the program.  The director of the program shall employ
 23 13 necessary support staff.  The director and staff shall be
 23 14 employees of the community college.
 23 15    Sec. 22.  Section 261.12, subsection 1, paragraph b, Code
 23 16 1997, is amended to read as follows:
 23 17    b.  For the fiscal year beginning July 1, 1996, and for
 23 18 each following fiscal year, three thousand one four hundred
 23 19 fifty dollars.
 23 20    Sec. 23.  Section 261.17, subsections 1, 2, and 4, Code
 23 21 1997, are amended to read as follows:
 23 22    1.  A vocational-technical tuition grant may be awarded to
 23 23 any resident of Iowa who is admitted and in attendance as a
 23 24 full-time or part-time student in a vocational-technical or
 23 25 career option program at a community college in the state, and
 23 26 who establishes financial need.
 23 27    2.  A qualified full-time student may receive vocational-
 23 28 technical tuition grants for not more than four semesters,
 23 29 eight quarters or the equivalent of two full years of study.
 23 30 The amount of a vocational-technical tuition grant to a
 23 31 qualified part-time student enrolled in a course of study
 23 32 including at least three semester hours but fewer than twelve
 23 33 semester hours or the trimester or quarter equivalent shall be
 23 34 equal to the amount of a tuition grant that would be paid to a
 23 35 full-time student times a number which represents the number
 24  1 of hours in which the part-time student is actually enrolled
 24  2 divided by twelve semester hours, or the trimester or quarter
 24  3 equivalent.
 24  4    PARAGRAPH DIVIDED.  However, if a student resumes study
 24  5 after at least a two-year absence, the student may again be
 24  6 eligible for the specified amount of time, except that the
 24  7 student shall not receive assistance for courses for which
 24  8 credit was previously received.
 24  9    4.  A vocational-technical tuition grant shall be awarded
 24 10 on an annual basis, requiring reapplication by the student for
 24 11 each year.  Payments under the grant shall be allocated
 24 12 equally among the semesters or quarters of the year upon
 24 13 certification by the institution that the student is in full-
 24 14 time or part-time attendance in a vocational-technical or
 24 15 career option program, as defined under rules of the
 24 16 department of education.  If the student discontinues
 24 17 attendance before the end of any term after receiving payment
 24 18 of the grant, the entire amount of any refund due that
 24 19 student, up to the amount of any payments made under the
 24 20 annual grant, shall be paid by the institution to the state.
 24 21    Sec. 24.  Section 261.25, subsection 1, Code 1997, is
 24 22 amended to read as follows:
 24 23    1.  There is appropriated from the general fund of the
 24 24 state to the commission for each fiscal year the sum of
 24 25 thirty-eight forty-one million six hundred sixty-four thousand
 24 26 seven hundred fifty dollars for tuition grants.
 24 27    Sec. 25.  Section 261.25, Code 1997, is amended by adding
 24 28 the following new subsection:
 24 29    NEW SUBSECTION.  3A.  There is appropriated from the
 24 30 general fund of the state to the commission for each fiscal
 24 31 year the sum of fifty thousand dollars for the industrial arts
 24 32 forgivable loan program established in section 261.111.
 24 33    Sec. 26.  NEW SECTION.  261.111  INDUSTRIAL ARTS FORGIVABLE
 24 34 LOAN PROGRAM.
 24 35    1.  There is established an industrial arts forgivable loan
 25  1 program to be administered by the college student aid
 25  2 commission.  An individual is eligible for the forgivable loan
 25  3 program if the individual meets all of the following
 25  4 conditions:
 25  5    a.  Is a resident of this state who is enrolled in the area
 25  6 of industrial arts education at an institution of higher
 25  7 learning under the control of the state board of regents or an
 25  8 accredited private institution as defined in section 261.9.
 25  9    b.  Completes and files an application for an industrial
 25 10 arts forgivable loan.  The individual shall be responsible for
 25 11 the submission of the parents' confidential statement for
 25 12 processing to both the commission and the institution in which
 25 13 the applicant is enrolling.
 25 14    c.  Reports promptly to the commission any information
 25 15 requested.
 25 16    d.  Files a new application and parents' confidential
 25 17 statement annually on the basis of which the applicant's
 25 18 eligibility for a renewed industrial arts forgivable loan will
 25 19 be evaluated and determined.
 25 20    2.  Forgivable loans to eligible students shall not become
 25 21 due until after the student graduates or leaves school.  If
 25 22 the person remains an Iowa resident and is employed by a
 25 23 school district or an accredited nonpublic school as an
 25 24 industrial arts teacher in an area in which a shortage of
 25 25 industrial arts teachers exists, as determined by the
 25 26 department of education, for five years immediately following
 25 27 graduation, the person is not responsible for payment of the
 25 28 principal amount of the loan and shall not pay interest on the
 25 29 loan.  If the commission determines that the person does not
 25 30 meet the criteria for forgiveness of the principal and
 25 31 interest payments, the commission shall establish a plan for
 25 32 repayment of the principal and interest over a ten-year
 25 33 period.  If a person required to make the repayment does not
 25 34 make the required payments, the commission shall provide for
 25 35 payment collection.
 26  1    3.  There is created an industrial arts forgivable loan
 26  2 repayment fund for deposit of payments made by forgivable loan
 26  3 recipients who do not fulfill the conditions of the forgivable
 26  4 loan program.  Notwithstanding section 8.33, moneys deposited
 26  5 in the industrial arts forgivable loan repayment fund shall
 26  6 not revert to the general fund of the state at the end of any
 26  7 fiscal year but shall remain in the industrial arts forgivable
 26  8 loan repayment fund and be continuously available to make
 26  9 additional loans under the program.
 26 10    Sec. 27.  NEW SECTION.  261.112  INDUSTRIAL ARTS FORGIVABLE
 26 11 LOAN ADMINISTRATION.
 26 12    1.  The college student aid commission shall administer the
 26 13 industrial arts forgivable loan program.  The loan amount is
 26 14 limited to an amount equal to the resident tuition rate of the
 26 15 institution to which the eligible student is admitted and
 26 16 attending.  The amount of an industrial arts forgivable loan
 26 17 shall not exceed the amount of the student's established
 26 18 financial need.
 26 19    2.  The interest rate for the forgivable loan shall be
 26 20 equal to the interest rate collected by an eligible lender
 26 21 under the Iowa guaranteed student loan program for the year in
 26 22 which the forgivable loan is made.
 26 23    Sec. 28.  Section 262.9, subsection 24, Code 1997, is
 26 24 amended to read as follows:
 26 25    24.  Develop a policy requiring oral communication
 26 26 competence of persons who provide instruction to students
 26 27 attending institutions under the control of the board.  The
 26 28 policy shall include a student evaluation mechanism which
 26 29 requires student evaluation of persons providing instruction
 26 30 on at least an annual basis.  However, the board shall
 26 31 establish criteria by which an institution may discontinue
 26 32 annual evaluations of a specific person providing instruction.
 26 33 The criteria shall include receipt by the institution of two
 26 34 consecutive positive annual evaluations from the majority of
 26 35 students evaluating the person.
 27  1    Sec. 29.  Section 294A.25, subsections 7 and 8, Code 1997,
 27  2 are amended to read as follows:
 27  3    7.  Commencing with the fiscal year beginning July 1, 1996
 27  4 1997, the amount of fifty thousand dollars for the geography
 27  5 alliance and one two hundred eighty thirty thousand dollars
 27  6 for a kindergarten to grade twelve management information
 27  7 system from additional funds transferred from phase I to phase
 27  8 III.
 27  9    8.  For the fiscal year beginning July 1, 1996 1997, and
 27 10 ending June 30, 1997 1998, to the department of education from
 27 11 phase III moneys the amount of one million two hundred fifty
 27 12 thousand dollars for support for the operations of the new
 27 13 Iowa schools development corporation and for school
 27 14 transformation design and implementation projects administered
 27 15 by the corporation.  Of the amount provided in this
 27 16 subsection, one hundred fifty thousand dollars shall be used
 27 17 for the school and community planning initiative.
 27 18    Sec. 30.  Section 321.34, subsection 21, paragraph c,
 27 19 subparagraph (2), Code 1997, is amended to read as follows:
 27 20    (2)  Twenty-five percent shall be allocated to the
 27 21 department of education cultural affairs.  The department
 27 22 shall use the moneys to support teacher training in Iowa
 27 23 history, to purchase Iowa history classroom materials, to
 27 24 support student participation in Iowa history and citizenship-
 27 25 building activities, and to create a grant program for school
 27 26 districts to apply for funding to support field trips to
 27 27 museums, historic sites, and heritage attractions.
 27 28    Sec. 31.   FUNDS TRANSFERRED.  For the fiscal year
 27 29 beginning July 1, 1997, and ending June 30, 1998, the
 27 30 following amounts for the purposes designated shall be paid to
 27 31 the department of education from additional funds transferred
 27 32 from phase I to phase III:
 27 33    1.  For Iowa public television overnight transmitter feeds:  
 27 34 .................................................. $    150,000
 27 35    2.  For contracting with the Iowa alliance for arts
 28  1 education to execute the local arts comprehensive educational
 28  2 strategies program (LACES):  
 28  3 .................................................. $     50,000
 28  4    3.  For allocation to area education agencies to assist
 28  5 school districts in developing reading recovery programs:  
 28  6 .................................................. $     50,000
 28  7    If funds available are insufficient to fully fund the
 28  8 amount designated for the reading recovery program under this
 28  9 section, the amount distributed for the reading recovery
 28 10 programs shall be reduced to an amount equal to the available
 28 11 funds.
 28 12    Sec. 32.  EFFECTIVE DATES.
 28 13    1.  Section 6 of this Act, relating to moneys designated
 28 14 for the Iowa state arts council for purposes of awarding
 28 15 operational support grants, being deemed of immediate
 28 16 importance, takes effect upon enactment.
 28 17    2.  Section 8 of this Act, relating to carryover for the
 28 18 career pathways program, being deemed of immediate importance,
 28 19 takes effect upon enactment.
 28 20    3.  Section 9 of this Act, relating to the state of Iowa
 28 21 libraries online (SILO) program, being deemed of immediate
 28 22 importance, takes effect upon enactment.
 28 23    4.  Section 13 of this Act, relating to tuition
 28 24 replacement, being deemed of immediate importance, takes
 28 25 effect upon enactment.
 28 26    5.  Section 16 of this Act, relating to the remaining
 28 27 interest for Iowa schools fund balance, being deemed of
 28 28 immediate importance, takes effect upon enactment.
 28 29    6.  Section 19 of this Act, relating to the amendment to
 28 30 section 257B.1A as the amendment relates to the interest for
 28 31 the Iowa schools fund, applies to interest earned on or after
 28 32 July 1, 1997.  
 28 33                           EXPLANATION
 28 34    The bill appropriates moneys from the state general fund to
 28 35 the department of education, the college student aid
 29  1 commission, the state board of regents and its institutions,
 29  2 and the department of cultural affairs.
 29  3    COLLEGE STUDENT AID COMMISSION – The bill appropriates
 29  4 moneys to the commission for general administration purposes,
 29  5 for forgivable loans to Iowa students attending the university
 29  6 of osteopathic medicine and health sciences, for an initiative
 29  7 to direct primary care physicians to shortage areas in the
 29  8 state, for student aid programs, for an industrial arts
 29  9 forgivable loan program, and for the Stafford loan program.
 29 10    DEPARTMENT OF CULTURAL AFFAIRS – The bill provides funds
 29 11 for the department's administration, the Iowa arts council,
 29 12 the historical division, historic sites, and community
 29 13 cultural grants.
 29 14    DEPARTMENT OF EDUCATION – Under the bill, moneys are
 29 15 appropriated for purposes of the department of education's
 29 16 general administration, vocational education administration,
 29 17 vocation rehabilitation division, independent living, the
 29 18 board of educational examiners, school food service, textbooks
 29 19 of nonpublic school pupils, the vocational agricultural youth
 29 20 organization and for other youth activities, family resource
 29 21 centers, the state library, regional library, the Iowa
 29 22 mathematics and science coalition, the public broadcasting
 29 23 division, and community colleges.
 29 24    STATE BOARD OF REGENTS – The bill appropriates moneys to
 29 25 the state board of regents for board operations, tuition
 29 26 replacement, the southwest Iowa graduate center, the tristate
 29 27 graduate center, the quad-cities graduate center, and for the
 29 28 state university of Iowa, Iowa state university of science and
 29 29 technology, the university of northern Iowa, the state school
 29 30 for the deaf, the Iowa Braille and sight saving school, and
 29 31 for tuition and transportation cost for students residing in
 29 32 the Iowa Braille and sight saving school and the school for
 29 33 the deaf.
 29 34    The bill continues funding for the new Iowa schools
 29 35 development corporation, the geography alliance, and the local
 30  1 arts comprehensive educational strategies (LACES) program.
 30  2    The bill funds, for the first time, the reading recovery
 30  3 program and an Iowa public television overnight transmitter
 30  4 feed.
