  1  2                 DEPARTMENT OF CULTURAL AFFAIRS
  1  3    Section 1.  There is appropriated from the rebuild Iowa
  1  4 infrastructure fund to the department of cultural affairs for
  1  5 the fiscal year beginning July 1, 1997, and ending June 30,
  1  6 1998, the following amounts, or so much thereof as is
  1  7 necessary, to be used for the purposes designated:
  1  8    1.  For the completion of undeveloped exhibit space at the
  1  9 new historical building:  
  1 10 .................................................. $    500,000
  1 11    2.  For allocation to an Iowa project that has received a
  1 12 national endowment for the humanities award for the museum and
  1 13 discovery center:  
  1 14 .................................................. $    500,000
  1 15    Allocation of moneys pursuant to this subsection shall be
  1 16 contingent upon a matching contribution of private moneys at a
  1 17 rate of two dollars of private moneys for each dollar of state
  1 18 appropriated moneys.
  1 19    Notwithstanding section 8.33, the unencumbered or
  1 20 unobligated moneys remaining on June 30 of the fiscal year
  1 21 from moneys appropriated in this section may be expended
  1 22 during the following fiscal year for the same purpose.  
  1 23                 DEPARTMENT OF GENERAL SERVICES
  1 24    Sec. 2.  There is appropriated from the rebuild Iowa
  1 25 infrastructure fund to the department of general services for
  1 26 the fiscal year beginning July 1, 1997, and ending June 30,
  1 27 1998, the following amounts, or so much thereof as is
  1 28 necessary, to be used for the purposes designated:
  1 29    1.  For major maintenance needs including health, life, and
  1 30 fire safety, for compliance with the federal Americans with
  1 31 Disabilities Act for state-owned buildings and facilities:  
  1 32 .................................................. $  9,000,000
  1 33    2.  For critical and deferred maintenance at Terrace Hill:  
  1 34 .................................................. $    100,000
  1 35    As a condition of receiving this appropriation made in this
  2  1 subsection, private matching funds must be contributed on a
  2  2 dollar-for-dollar basis.
  2  3    3.  For relocating the state library:  
  2  4 .................................................. $  1,000,000
  2  5    4.  For relocation of offices and other transition costs
  2  6 associated with renovation of the Lucas state office building
  2  7 and the old historical building:  
  2  8 .................................................. $  1,300,000
  2  9    5.  To fund the state share of the capitol gateway east
  2 10 development project in conjunction with the city of Des
  2 11 Moines:  
  2 12 .................................................. $     50,000
  2 13    6.  For the installation of storm drainage, grading, new
  2 14 asphalt, new lighting, striping, filling cracks, and
  2 15 resurfacing of capitol complex parking lots, provided that
  2 16 existing capitol complex construction plans do not conflict
  2 17 with the parking lot improvements:  
  2 18 .................................................. $  2,330,750
  2 19    7.  For the design and construction of new or replacement
  2 20 buildings at the state training school by allocating not more
  2 21 than $1,600,000 for design and construction of a living unit,
  2 22 allocating not more than $800,000 for design and construction
  2 23 of a multipurpose building, and allocating not more than
  2 24 $200,000 for the design of a new school building:  
  2 25 .................................................. $  2,600,000
  2 26    8.  For renovation of an existing cottage to provide
  2 27 additional beds for females at the Toledo juvenile home:  
  2 28 .................................................. $    350,000
  2 29    9.  For conducting a survey of the condition of state-owned
  2 30 property:  
  2 31 .................................................. $    500,000
  2 32    The department shall report on the progress of the vertical
  2 33 infrastructure survey to the joint transportation,
  2 34 infrastructure and capitals appropriations subcommittee not
  2 35 later than February 1, 1998.
  3  1    Notwithstanding section 8.33, unencumbered or unobligated
  3  2 funds remaining on June 30, 2002, from the funds appropriated
  3  3 in this section, shall revert to the rebuild Iowa
  3  4 infrastructure fund on August 31, 2002.
  3  5    Sec. 3.  1996 Iowa Acts, chapter 1218, section 13, is
  3  6 amended to read as follows:
  3  7    SEC. 13.
  3  8    1.  There is appropriated from the rebuild Iowa
  3  9 infrastructure fund of the state to the department of general
  3 10 services for the fiscal period beginning July 1, 1996, and
  3 11 ending June 30, 1999 1998, the following amounts, or so much
  3 12 thereof as is necessary, to be used for the projects in the
  3 13 amounts and for the fiscal years as designated in subsection
  3 14 2:
  3 15    a.  For the fiscal year beginning July 1, 1996, and ending

  5  1 1999, the following amounts, or so much thereof as is
  5  2 necessary, to be used for the purposes designated:
  5  3    1.  For exterior state capitol building restoration:

  5  5    2.  For interior state capitol building restoration:  
  5  6 .................................................. $  4,200,000
  5  7    3.  For conducting a survey of the condition of state-owned
  5  8 property:

  5 10    4.  For the design and construction of new or replacement
  5 11 buildings at the state training school by allocating not more
  5 12 than $2,300,000 to complete construction of the new school
  5 13 building and allocating not more than $400,000 for the design

  5 22    Sec. 5.  There is appropriated from the rebuild Iowa
  5 23 infrastructure fund to the department of general services for
  5 24 the fiscal year beginning July 1, 1999, and ending June 30,
  5 25 2000, the following amount, or so much thereof as is
  5 26 necessary, to be used for the purpose designated:
  5 27    For construction of a new gymnasium building at the state
  5 28 training school:  
  5 29 .................................................. $  4,000,000
  5 30               DEPARTMENT OF ECONOMIC DEVELOPMENT
  5 31    Sec. 6.  There is appropriated from the rebuild Iowa
  5 32 infrastructure fund to the department of economic development
  5 33 for the fiscal period beginning July 1, 1997, and ending June
  5 34 30, 1999, the following amounts, or so much thereof as is
  5 35 necessary, to be used for the purposes designated:
  6  1    1.  For the fiscal year beginning July 1, 1997, and ending
  6  2 June 30, 1998:
  6  3    a.  For a welcome center at living history farms:  
  6  4 ................................................... $    500,000
  6  5    b.  For the main street linked investments loan program,
  6  6 notwithstanding section 8.57, subsection 5, paragraph "c":

  6  8    c.  For this historical site preservation grant program:

  6 10    d.  For construction of a China-Des Moines trade and

  6 23    Sec. 7.  1996 Iowa Acts, chapter 1218, section 55,
  6 24 unnumbered paragraph 1, is amended to read as follows:
  6 25    There is appropriated from the rebuild Iowa infrastructure
  6 26 fund of the state, notwithstanding section 8.57, subsection 5,
  6 27 paragraph "c", to the Iowa department of economic development
  6 28 for the fiscal years beginning July 1, 1996, and ending June
  6 29 30, 1998, the following amounts, or so much thereof as is
  6 30 necessary, to be deposited in the physical infrastructure
  6 31 assistance fund created in section 15E.175 and used only in
  6 32 accordance with subsection 3:
  6 33    Sec. 8.  1996 Iowa Acts, chapter 1218, section 55,
  6 34 subsection 2, is amended to read as follows:
  6 35    2.  For the fiscal year beginning July 1, 1997, and ending
  7  1 June 30, 1998, the following amount:

  7  4                  DEPARTMENT OF PUBLIC DEFENSE
  7  5    Sec. 9.  There is appropriated from the rebuild Iowa
  7  6 infrastructure fund to the department of public defense for
  7  7 the fiscal year beginning July 1, 1997, and ending June 30,
  7  8 1998, the following amount, or so much thereof as is
  7  9 necessary, to be used for the purpose designated:
  7 10    For maintenance and repair of national guard armories and
  7 11 facilities:  
  7 12 .................................................. $    400,000
  7 13    Notwithstanding section 8.33, the unencumbered or
  7 14 unobligated moneys remaining on June 30 of the fiscal year
  7 15 from the moneys appropriated in this section may be expended
  7 16 during the following fiscal year for the same purpose.  
  7 17                 DEPARTMENT OF NATURAL RESOURCES
  7 18    Sec. 10.  There is appropriated from the marine fuel tax
  7 19 receipts deposited in the general fund of the state to the
  7 20 department of natural resources for the fiscal year beginning
  7 21 July 1, 1997, and ending June 30, 1998, the following amount,
  7 22 or so much thereof as is necessary, to be used for the purpose
  7 23 designated:
  7 24    For the purpose of funding capital projects funded from
  7 25 marine fuel tax receipts for the purposes specified in section
  7 26 452A.79:  
  7 27 .................................................. $  1,800,000
  7 28    Notwithstanding section 8.33, unencumbered or unobligated
  7 29 funds remaining on June 30, 1998, from the funds appropriated
  7 30 in this section, shall revert to the general fund of the state
  7 31 on August 31, 1998.  
  7 32               STATE DEPARTMENT OF TRANSPORTATION
  7 33    Sec. 11.  There is appropriated from the rebuild Iowa
  7 34 infrastructure fund to the state department of transportation
  7 35 for the fiscal year beginning July 1, 1997, and ending June
  8  1 30, 1998, the following amount, or so much thereof as is
  8  2 necessary, to be used for the purpose designated:
  8  3    For allocating $75,000 for the Nishna Valley trail project
  8  4 at Anita state park, for allocating $1,000,000 to be used for
  8  5 funding trails in cities or counties which connect with state
  8  6 trails or state parks, and for acquiring, constructing, and
  8  7 improving recreational trails within the state:  
  8  8 ................................................... $  2,000,000
  8  9                DEPARTMENT OF REVENUE AND FINANCE
  8 10    Sec. 12.  Notwithstanding section 8.57, subsection 5,
  8 11 paragraph "c", there is appropriated from the rebuild Iowa
  8 12 infrastructure fund to the department of revenue and finance
  8 13 for the fiscal year beginning July 1, 1997, and ending June
  8 14 30, 1998, the following amount, or so much thereof as is
  8 15 necessary, to be used for the purpose designated:
  8 16    For upgrades to the Iowa financial accounting system,
  8 17 provided that none of the moneys appropriated in this section
  8 18 shall be used for personnel expenses not associated with the
  8 19 installation of the upgrades to the system or for training
  8 20 expenses:  
  8 21 .................................................. $  1,875,000
  8 22                   DEPARTMENT OF PUBLIC SAFETY
  8 23    Sec. 13.  Notwithstanding section 8.57, subsection 5,
  8 24 paragraph "c", there is appropriated from the rebuild Iowa
  8 25 infrastructure fund to the department of public safety for the
  8 26 fiscal period beginning July 1, 1997, and ending June 30,
  8 27 2000, the following amount, or so much thereof as is
  8 28 necessary, to be used for the conversion of the department of
  8 29 public safety's radio system from analog to digital
  8 30 technology, provided that none of the moneys appropriated in
  8 31 this section shall be used for personnel expenses not
  8 32 associated with the installation of the radio system or for
  8 33 training expenses:
  8 34    1.  For the fiscal year beginning July 1, 1997, and ending
  8 35 June 30, 1998:

  9 12    Sec. 14.  There is appropriated from the rebuild Iowa
  9 13 infrastructure fund, notwithstanding section 8.57, subsection
  9 14 5, paragraph "c", to the department of agriculture and land
  9 15 stewardship for the fiscal period beginning July 1, 1997, and
  9 16 ending June 30, 1999, the following amounts, or so much
  9 17 thereof as is necessary, to be used for deposit in the
  9 18 alternative drainage system assistance fund created in section
  9 19 159.29A, if enacted by 1997 Iowa Acts, Senate File 473, for
  9 20 purposes of supporting the alternative drainage system
  9 21 assistance program administered by the soil conservation
  9 22 division of the department of agriculture and land stewardship
  9 23 as provided in section 159.29B, if enacted by 1997 Iowa Acts,
  9 24 Senate File 473:
  9 25    1.  For the fiscal year beginning July 1, 1997, and ending
  9 26 June 30, 1998:

  9 28    2.  For the fiscal year beginning July 1, 1998, and ending

  9 35 for the fiscal period beginning July 1, 1997, and ending June
 10  1 30, 1999, the following amounts, or so much thereof as is
 10  2 necessary, to be used for the integrated information system
 10  3 provided that none of the moneys appropriated in this section
 10  4 shall be used for personnel expenses not associated with the
 10  5 installation of the system or for training expenses:
 10  6    1.  For the fiscal year beginning July 1, 1997, and ending
 10  7 June 30, 1998:

 10 13    Sec. 16.  Notwithstanding section 8.57, subsection 5,
 10 14 paragraph "c", there is appropriated from the rebuild Iowa
 10 15 infrastructure fund to the department of human services for
 10 16 the fiscal period beginning July 1, 1997, and ending June 30,
 10 17 1999, the following amounts, or so much thereof as is
 10 18 necessary, to be used for implementing child support systems
 10 19 changes necessitated by changes in federal welfare reform
 10 20 legislation, provided that none of the moneys appropriated in
 10 21 this section shall be used for personnel expenses associated
 10 22 with the implementation of the systems changes or for training
 10 23 expenses:
 10 24    1.  For the fiscal year beginning July 1, 1997, and ending
 10 25 June 30, 1998:

 10 34 following amounts, or so much thereof as is necessary, to be
 10 35 used for the purposes designated:
 11  1    1.  For the fiscal year beginning July 1, 1997, and ending
 11  2 June 30, 1998, for planning for the relocation of judicial
 11  3 department offices out of the capitol:  
 11  4 .................................................. $  1,000,000
 11  5    2.  For the fiscal year beginning July 1, 1998, and ending
 11  6 June 30, 1999, for relocation expenses of the judicial
 11  7 department:

 11  9                 COMMISSION OF VETERANS AFFAIRS
 11 10    Sec. 18.  There is appropriated from the rebuild Iowa
 11 11 infrastructure fund to the commission of veterans affairs for
 11 12 the fiscal period beginning July 1, 1997, and ending June 30,
 11 13 1999, the following amounts, or so much thereof as is
 11 14 necessary, to be used for expansion of the food preparation
 11 15 area and dining room:
 11 16    1.  For the fiscal year beginning July 1, 1997, and ending
 11 17 June 30, 1998, of which not more than $850,000 shall be used
 11 18 for major maintenance projects:  
 11 19 .................................................. $  2,250,000
 11 20    2.  For the fiscal year beginning July 1, 1998, and ending
 11 21 June 30, 1999:  
 11 22 .................................................. $  1,900,000
 11 23    Notwithstanding section 8.33, the unencumbered or
 11 24 unobligated moneys remaining on June 30 of the fiscal year
 11 25 from the moneys appropriated in this section may be expended

 11 27       LOESS HILLS DEVELOPMENT AND CONSERVATION AUTHORITY
 11 28    Sec. 19.  There is appropriated from the rebuild Iowa
 11 29 infrastructure fund, notwithstanding section 8.57, subsection
 11 30 5, paragraph "c", to the Loess Hills development and
 11 31 conservation authority for the fiscal year beginning July 1,
 11 32 1997, and ending June 30, 1998, the following amount, or so
 11 33 much thereof as is necessary, to be used for the purpose
 11 34 designated:
 11 35    For deposit in the Loess Hills development and conservation
 12  1 fund created in section 161D.2 for the purposes specified in
 12  2 section 161D.1:  
 12  3 .................................................. $    742,500
 12  4                   IOWA STATE FAIR FOUNDATION
 12  5    Sec. 20.  There is appropriated from the rebuild Iowa
 12  6 infrastructure fund of the state to the Iowa state fair
 12  7 foundation for the fiscal period beginning July 1, 1997, and
 12  8 ending June 30, 1999, the following amounts, or so much
 12  9 thereof as is necessary, to be used for the purposes
 12 10 designated:
 12 11    1.  For the fiscal year beginning July 1, 1997, and ending
 12 12 June 30, 1998:
 12 13    a.  For renovation, restoration, and improvement projects
 12 14 on the state fairgrounds and for distributing in accordance
 12 15 with chapter 174, $1,060,000 to qualified fairs which belong
 12 16 to the association of Iowa fairs:  
 12 17 .................................................. $  5,460,000
 12 18    b.  For matching, on a dollar-for-dollar basis, private
 12 19 contributions:  
 12 20 .................................................. $  3,000,000
 12 21    2.  For the fiscal year beginning July 1, 1998, and ending
 12 22 June 30, 1999, for renovation, restoration, and improvement
 12 23 projects on the state fairgrounds and for distributing in

 12 31    Sec. 21.  Effective July 1, 1997, the departments of
 12 32 general services, workforce development, human services, and
 12 33 public safety, and the commission on veterans affairs are
 12 34 authorized to enter into contracts for the full cost of
 12 35 carrying out the projects for which appropriations are made in
 13  1 this division of this Act.  The state shall not be obligated
 13  2 for costs associated with contracts identified in this section
 13  3 in excess of funds appropriated by the general assembly.  
 13  4                           DIVISION II
 13  5                        BOARD OF REGENTS
 13  6    Sec. 22.
 13  7    1.  There is appropriated from the rebuild Iowa
 13  8 infrastructure fund of the state to the state board of regents
 13  9 for the fiscal period beginning July 1, 1997, and ending June
 13 10 30, 2001, the following amounts, or so much thereof as is
 13 11 necessary, to be used for major maintenance needs including
 13 12 health, life, and fire safety, for compliance with the federal
 13 13 Americans with disabilities Act for regents buildings and
 13 14 facilities, including a visual alert fire safety system at the
 13 15 Iowa school for the deaf and deferred maintenance at the Iowa
 13 16 braille and sight saving school, and for the projects
 13 17 designated in subsection 2:  
 13 18    a.  For the fiscal year beginning July 1, 1997, and ending 
 13 19 June 30, 1998:

 13 32 fiscal period beginning July 1, 1997, and ending June 30,
 13 33 2001, based upon project needs.  However, the total
 13 34 appropriated funds for a project for all fiscal years of that
 13 35 fiscal period shall not exceed the amount listed in subsection
 14  1 2 for that project.
 14  2    2.  The state board of regents is authorized to undertake,
 14  3 plan, construct, equip, and otherwise carry out the following
 14  4 projects at the institutions under the jurisdiction of the
 14  5 board in the following appropriated amounts:
 14  6    a.  For construction of the livestock infectious disease
 14  7 isolation facility at Iowa state university of science and
 14  8 technology:  
 14  9 .................................................. $  9,270,000
 14 10    b.  For construction and renovation of the medical
 14 11 education and biomedical research facilities at the university
 14 12 of Iowa:  
 14 13 .................................................. $ 27,000,000
 14 14    c.  For renovation of Lang hall at the university of
 14 15 northern Iowa:  
 14 16 .................................................. $ 12,900,000
 14 17    d.  For Phase II construction of the engineering teaching
 14 18 and research complex at Iowa state university of science and
 14 19 technology:  
 14 20 .................................................. $ 20,900,000
 14 21    e.  For improvements to the lakeside laboratory complex:  
 14 22 .................................................. $    140,000
 14 23    3.  Effective July 1, 1997, the state board of regents is
 14 24 authorized to enter into contracts for the full cost of
 14 25 carrying out the projects listed in subsection 2, for which
 14 26 appropriations are made in subsection 1, for the fiscal years
 14 27 beginning July 1, 1997, July 1, 1998, July 1, 1999, and July
 14 28 1, 2000.
 14 29    The state shall not be obligated for costs associated with
 14 30 contracts identified in this section in excess of funds
 14 31 appropriated by the general assembly.
 14 32    4.  a.  Notwithstanding section 8.33, funds appropriated in
 14 33 subsection 1, paragraph "a", for the fiscal year beginning
 14 34 July 1, 1997, which remain unexpended as of June 30, 1998,
 14 35 shall be available for expenditure through June 30, 2002.
 15  1    b.  Notwithstanding section 8.33, funds appropriated in
 15  2 subsection 1, paragraph "b", for the fiscal year beginning
 15  3 July 1, 1998, which remain unexpended as of June 30, 1999,
 15  4 shall be available for expenditure through June 30, 2003.
 15  5    c.  Notwithstanding section 8.33, funds appropriated in
 15  6 subsection 1, paragraph "c", for the fiscal year beginning
 15  7 July 1, 1999, which remain unexpended as of June 30, 2000,
 15  8 shall be available for expenditure through June 30, 2004.
 15  9    d.  Notwithstanding section 8.33, funds appropriated in
 15 10 subsection 1, paragraph "d", for the fiscal year beginning
 15 11 July 1, 2000, which remain unexpended as of June 30, 2001,
 15 12 shall be available for expenditure through June 30, 2005.
 15 13    The state board of regents shall not submit a request to
 15 14 the governor or general assembly for funding from the rebuild
 15 15 Iowa infrastructure fund or other funds for capital projects
 15 16 until fiscal year 2001.  
 15 17                          DIVISION III
 15 18            COMMUNITY COLLEGE VERTICAL INFRASTRUCTURE
 15 19               AND VOCATIONAL-TECHNICAL TECHNOLOGY
 15 20                       IMPROVEMENT PROGRAM
 15 21    Sec. 23.  NEW SECTION.  260A.1  COMMUNITY COLLEGE VERTICAL
 15 22 INFRASTRUCTURE VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT
 15 23 APPROPRIATION.
 15 24    1.  a.  Notwithstanding section 8.57, subsection 5,
 15 25 paragraph "c", there is appropriated from the rebuild Iowa
 15 26 infrastructure fund created in section 8.57, to the department
 15 27 of education for each fiscal year of the fiscal period
 15 28 beginning July 1, 1997, and ending June 30, 1999, the sum of
 15 29 two million five hundred thousand dollars for the community
 15 30 college vertical infrastructure vocational-technical
 15 31 technology improvement program.
 15 32    b.  There is appropriated from the general fund of the
 15 33 state to the department of education for each fiscal year of
 15 34 the fiscal period beginning July 1, 1999, and ending June 30,
 15 35 2001, the sum of two million five hundred thousand dollars for
 16  1 the community college vocational-technical technology
 16  2 improvement program.
 16  3    2.  Moneys appropriated in subsection 1 shall be allocated
 16  4 by the department of education to each community college in
 16  5 the proportion that the allocation to that community college
 16  6 in 1996 Iowa Acts, chapter 1215, section 6, subsection 15,
 16  7 bears to the total appropriation made in 1996 Iowa Acts,
 16  8 chapter 1215, section 6, subsection 15, to all community
 16  9 colleges.
 16 10    3.  For each year in which an appropriation is made to the
 16 11 program, the department of education shall notify the
 16 12 department of revenue and finance of the amount to be paid to
 16 13 each community college based upon the allocation criteria set
 16 14 forth for the appropriation pursuant to subsection 2.
 16 15 Allocations to each community college under this section shall
 16 16 be made in one payment on or about October 15 and one payment
 16 17 on or about February 15 of the fiscal year in which the
 16 18 appropriation is made, taking into consideration the relative
 16 19 budget and cash position of the state resources.
 16 20    4.  Moneys received by a community college under this
 16 21 section shall not be commingled with general state financial
 16 22 aid, including financial aid to merged areas in lieu of
 16 23 personal property tax replacement payments under section
 16 24 427A.13, to merged areas as defined in section 260C.2, and
 16 25 including moneys received for vocational education programs in
 16 26 accordance with chapters 258 and 260C.  Payments made to a
 16 27 community college shall be accounted for by the community
 16 28 college separately from other state aid payments.  Each
 16 29 community college shall maintain a separate listing within its
 16 30 budget accounting for payments received and expenditures made
 16 31 pursuant to this section and section 260A.3.
 16 32    5.  Moneys received under this section shall supplement,
 16 33 not supplant, the moneys each community college budgets for
 16 34 vertical infrastructure projects and technology.  A community
 16 35 college shall not be eligible for funds under this section
 17  1 unless the community college, without including moneys
 17  2 received under this section, maintains the same average amount
 17  3 of expenditure for technology per year as the community
 17  4 college maintains during the fiscal period beginning July 1,
 17  5 1994, and ending June 30, 1997.
 17  6    6.  Moneys received under this section shall not be used
 17  7 for payment of any collective bargaining agreement or
 17  8 arbitrator's decision negotiated or awarded under chapter 20.
 17  9    Sec. 24.  NEW SECTION.  260A.2  COMMUNITY COLLEGE VERTICAL
 17 10 INFRASTRUCTURE AND VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT
 17 11 PLANS.
 17 12    Prior to receiving moneys under this chapter, the board of
 17 13 directors of a community college shall adopt a vertical
 17 14 infrastructure improvement plan if any of the moneys received
 17 15 through the program will be used for vertical infrastructure
 17 16 projects.  The board shall also adopt a technology plan that
 17 17 supports community college vocational-technical technology
 17 18 improvement efforts, authorizes a needs assessment of business
 17 19 and industry in the district, and includes an evaluation
 17 20 component, and shall provide to the department of education
 17 21 adequate assurance that funds received under this chapter will
 17 22 be used in accordance with the technology plan.  The plan
 17 23 shall be developed by licensed professional staff of the
 17 24 community college, including both faculty members and school
 17 25 administrators, the private sector, trade and professional
 17 26 organizations, and other interested parties, and shall, at a
 17 27 minimum, focus on the attainment of the vocational-technical
 17 28 skills and achievement goals of the student.  The plan shall
 17 29 consider the community college's interconnectivity with the
 17 30 Iowa communications network, and shall demonstrate how, over a
 17 31 four-year period, the board will utilize technology to improve
 17 32 vocational-technical student achievement.  The technology plan
 17 33 shall be kept on file at the community college.  Progress made
 17 34 under the plan shall be reported annually to the department of
 17 35 education in a manner prescribed by the department of
 18  1 education.
 18  2    Sec. 25.  NEW SECTION.  260A.3  COMMUNITY COLLEGE VERTICAL
 18  3 INFRASTRUCTURE VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT
 18  4 EXPENDITURES.
 18  5    A community college shall expend funds received pursuant to
 18  6 section 260A.1 for vertical infrastructure projects in
 18  7 accordance with section 8.57, subsection 5, paragraph "c" or
 18  8 for the acquisition, lease, lease-purchase, installation, and
 18  9 maintenance of instructional technology equipment used in
 18 10 vocational-technical programs, including hardware and
 18 11 software, materials and supplies related to instructional
 18 12 technology, and faculty development and training related to
 18 13 instructional technology, and shall establish priorities for
 18 14 the use of the funds.  However, funds received by a community
 18 15 college pursuant to section 260A.1 shall not be expended to
 18 16 add a full-time equivalent position or otherwise increase
 18 17 staffing.
 18 18    Sec. 26.  NEW SECTION.  260A.4  FUTURE REPEAL.
 18 19    This chapter is repealed effective July 1, 2001.  
 18 20                           DIVISION IV
 18 21                 MISCELLANEOUS STATUTORY CHANGES
 18 22    Sec. 27.  NEW SECTION.  7E.5A  BUILDINGS AND INFRASTRUCTURE
 18 23 – MAINTENANCE FUNDING.
 18 24    1.  For each new vertical infrastructure project undertaken
 18 25 on or after July 1, 1997, the department in control of the
 18 26 vertical infrastructure shall identify and recommend to the
 18 27 general assembly funding sufficient to meet the projected
 18 28 maintenance, repair, and replacement needs of the vertical
 18 29 infrastructure.
 18 30    2.  As used in this section, "vertical infrastructure"
 18 31 means the same as defined in section 8.57, subsection 5,
 18 32 paragraph "c".
 18 33    Sec. 28.  NEW SECTION.  15.350  HISTORIC SITE PRESERVATION
 18 34 GRANT PROGRAM.
 18 35    There is established a historic site preservation grant
 19  1 program to provide grants to cities, counties, and historical
 19  2 societies for the restoration and preservation of tourism
 19  3 oriented historic sites in the state.  Projects funded through
 19  4 the program shall meet the definition of vertical
 19  5 infrastructure in section 8.57, subsection 5, paragraph "c".
 19  6 The department shall adopt administrative rules to implement
 19  7 this section.
 19  8    Sec. 29.  NEW SECTION.  15E.176  MAIN STREET LINKED
 19  9 INVESTMENTS LOAN PROGRAM.
 19 10    The department shall adopt rules to implement a main street
 19 11 linked investments loan program to increase the availability
 19 12 of lower cost funds to stimulate building restorations or
 19 13 rehabilitations of historic buildings within the central
 19 14 business district of a city which is a certified local
 19 15 government project area, or in the Iowa main street program or
 19 16 the rural main street program.  The rules shall include the
 19 17 following conditions:
 19 18    1.  Linked investment loans shall be limited to projects
 19 19 for a building restoration or rehabilitation located in the
 19 20 central business district whose boundaries are the same as the
 19 21 main street or rural main street or central business district
 19 22 of a city which is a certified local government project area.
 19 23    2.  Eligible borrowers are limited to the property owner,
 19 24 contract purchaser of record, or long-term lessee.
 19 25    3.  Loan applications under this program shall be for the
 19 26 restoration or rehabilitation of facades of buildings which
 19 27 are eligible or nominated or listed on the national register
 19 28 of historic places.  Public buildings are excluded.
 19 29    4.  A facade restoration or rehabilitation must follow
 19 30 United States secretary of interior's standards for
 19 31 rehabilitation and guidelines for rehabilitating historic
 19 32 buildings.
 19 33    5.  The maximum loan amount under the main street linked
 19 34 investments loan program is fifty thousand dollars per
 19 35 project.
 20  1    Sec. 30.  NEW SECTION.  15.177  APPLICATION PROCESS.
 20  2    Applicants shall be certified as eligible for assistance
 20  3 prior to submitting applications to the department for loans
 20  4 under the main street linked investment loan program.
 20  5 Administrative rules pursuant to chapter 17A shall be adopted
 20  6 jointly by the department and by the department of cultural
 20  7 affairs to require applicants to do the following:
 20  8    1.  Show evidence of preliminary design assistance from the
 20  9 Iowa main street program of the department of economic
 20 10 development or the state historic preservation office of the
 20 11 department of cultural affairs.
 20 12    2.  Show evidence of preliminary design review approval
 20 13 from the local design review committee.
 20 14    3.  Submit project plans and specifications prepared by a
 20 15 design professional with historic preservation experience.
 20 16 The plans shall be submitted to a final design review board
 20 17 comprised of representatives of the state historic
 20 18 preservation office, the Iowa main street program, and one
 20 19 private sector architect selected jointly by the directors of
 20 20 the departments of economic development and cultural affairs.
 20 21 The design review board shall provide certification of
 20 22 eligible projects to the department following the review.
 20 23    Sec. 31.  NEW SECTION.  18.24  COORDINATION OF VERTICAL
 20 24 INFRASTRUCTURE DATABASES.
 20 25    1.  The director shall establish by administrative rule,
 20 26 and as part of a survey conducted regarding the condition of
 20 27 state-owned property, a uniform system for evaluating and
 20 28 rating vertical infrastructure needs in the state so that the
 20 29 vertical infrastructure needs of each state entity and
 20 30 proposed vertical infrastructure projects, including the state
 20 31 board of regents, can be compared.  The director shall consult
 20 32 with state entities which already have databases regarding
 20 33 their vertical infrastructure needs and shall seek input from
 20 34 individuals or organizations with expertise in public vertical
 20 35 infrastructure assessment in drafting proposed rules.
 21  1    2.  As used in this section, "vertical infrastructure" has
 21  2 the same meaning as in section 8.57, subsection 5, paragraph
 21  3 "c".
 21  4    Sec. 32.  NEW SECTION.  161A.80  BLUFFLANDS PROTECTION
 21  5 PROGRAM – REVOLVING FUND.
 21  6    1.  As used in this section, unless the context otherwise
 21  7 requires:
 21  8    a.  "Bluffland" means a cliff, headland, or hill with a
 21  9 broad steep face along the channel or floodplain of a river
 21 10 and its tributaries.
 21 11    b.  "Conservation organization" means a nonprofit
 21 12 corporation incorporated in Iowa or an entity organized and
 21 13 operated primarily to enhance and protect natural resources in
 21 14 this state.
 21 15    2.  A blufflands protection revolving fund is created in
 21 16 the state treasury.  The proceeds of the revolving fund are
 21 17 appropriated to make loans to conservation organizations which
 21 18 agree to purchase conservation easements on blufflands in this
 21 19 state or to purchase blufflands in this state for resale with
 21 20 restrictive covenants attached to the property.  The
 21 21 administrative director of the division of soil conservation
 21 22 shall administer the revolving fund.  Notwithstanding section
 21 23 12C.7, interest or earnings on investments made pursuant to
 21 24 this section or as provided in section 12B.10 shall be
 21 25 credited to the blufflands protection revolving fund.
 21 26 Notwithstanding section 8.33, unobligated or unencumbered
 21 27 funds credited to the blufflands protection revolving fund
 21 28 shall not revert at the close of a fiscal year.  However, the
 21 29 maximum balance in the blufflands protection fund shall not
 21 30 exceed two million five hundred thousand dollars.  Any funds
 21 31 in excess of two million five hundred thousand dollars shall
 21 32 be credited to the rebuild Iowa infrastructure fund.
 21 33    3.  The administrative director of the division shall
 21 34 establish a blufflands protection program to demonstrate
 21 35 creative land protection techniques and encourage private
 22  1 landowners to protect the natural beauty of the blufflands in
 22  2 this state.  The commissioners of each soil and water
 22  3 conservation district which includes blufflands shall
 22  4 cooperate with and assist the director in administering the
 22  5 blufflands protection program within their respective
 22  6 districts.  The director shall provide, by rule, for a uniform
 22  7 application form, the content of the form, provisions for a
 22  8 loan agreement model conservation easement and restrictive
 22  9 covenant requirements for blufflands, and minimum
 22 10 qualifications of conservation organizations which are
 22 11 eligible to participate in the blufflands protection program.
 22 12 The administrative director shall specify the eligible
 22 13 purposes for which a loan authorized under this section can be
 22 14 expended including, but not limited to, the purchase of
 22 15 blufflands, the acquisition of conservation easements on
 22 16 blufflands, the establishment of landowner associations,
 22 17 payment for loss of land value due to restrictive covenants,
 22 18 and payment for legal costs.  The payment of administrative
 22 19 costs is not an eligible purpose.
 22 20    4.  An applicant for a loan from the blufflands protection
 22 21 revolving fund shall apply to the soil and water conservation
 22 22 district of the county in which the bluffland is located.  The
 22 23 application shall be on forms prepared by the division and
 22 24 shall include the information required by rule of the
 22 25 division.  Each conservation organization which applies for a
 22 26 loan under this section shall demonstrate its financial
 22 27 capability to qualify for a loan to the commissioners and its
 22 28 commitment to natural resource protection and appropriate
 22 29 development.  The application shall be reviewed and
 22 30 feasibility of the proposed project shall be investigated by
 22 31 the commissioners of the district and its report and
 22 32 recommendation shall be sent to the administrative director
 22 33 and the committee for approval.
 22 34    5.  Except as otherwise provided in this subsection, each
 22 35 loan made under this section shall be for a period not to
 23  1 exceed five years, shall bear no interest for the first year,
 23  2 and shall be repayable to the blufflands protection revolving
 23  3 fund.  After the first year and for each subsequent year that
 23  4 the principal remains unpaid, interest shall be charged
 23  5 against any unpaid balance of the loan.  The interest rate
 23  6 shall be set at the prevailing market rate for similar real
 23  7 estate in the county as determined by the director.  All
 23  8 interest payments shall be credited to the blufflands
 23  9 protection revolving fund.  Each loan shall be repaid as
 23 10 provided in the loan agreement.  However, interest on the
 23 11 principal of a loan shall be due and payable thirty days after
 23 12 the conclusion of the second year and each subsequent year
 23 13 that the principal or a part of the principal remains unpaid.
 23 14 A loan may be extended annually beyond the original five years
 23 15 with the approval of the district commissioners and the
 23 16 administrative director.
 23 17    6.  The administrative director may:
 23 18    a.  Contract, sue and be sued, and adopt administrative
 23 19 rules pursuant to chapter 17A and approved by the committee,
 23 20 necessary to carry out this section, but the administrative
 23 21 director, the committee, or the district commissioners shall
 23 22 not directly or indirectly pledge the credit of the state of
 23 23 Iowa.
 23 24    b.  Authorize payment from the blufflands protection
 23 25 revolving fund from the five hundred thousand dollars
 23 26 appropriated from the rebuild Iowa infrastructure fund for the
 23 27 fiscal year beginning July 1, 1997, and ending June 30, 1998,
 23 28 and from any income received by investments of any money in
 23 29 the fund for costs, commissions, attorney fees, and other
 23 30 reasonable expenses related to and necessary for the making
 23 31 and protecting of direct loans under this section, and for
 23 32 recovery of moneys loaned or the management of property
 23 33 acquired in connection with the loans.
 23 34    Sec. 33.  Section 174.1, subsection 1, Code 1997, is
 23 35 amended to read as follows:
 24  1    1.  "Fair" shall mean a bona fide exhibition of
 24  2 agricultural, dairy, and kindred products, livestock, and farm
 24  3 implements an annual gathering of people that incorporates
 24  4 agricultural exhibits, shows, or competition which has the
 24  5 following activities:
 24  6    a.  Extension, 4-H, or future farmers of American programs.
 24  7    b.  Commercial and educational exhibits.
 24  8    c.  Competition in the fine or home craft arts.
 24  9    Sec. 34.  Section 174.9, unnumbered paragraph 1, Code 1997,
 24 10 is amended to read as follows:
 24 11    Each eligible society which is a member of the association
 24 12 of Iowa fairs and which conducts a county fair shall be
 24 13 entitled to receive aid from the state as provided in this
 24 14 chapter.  In order to be eligible for state aid, a society
 24 15 must file with the treasurer of state Iowa state fair
 24 16 foundation, as established in section 173.22, on or before
 24 17 November 1 of each year, a statement which shall show:
 24 18    Sec. 35.  Section 174.9, subsection 4, Code 1997, is
 24 19 amended to read as follows:
 24 20    4.  A copy of the published financial statement published
 24 21 as required by law, together with proof of such publication
 24 22 and a certified statement showing an itemized list of premiums
 24 23 awarded, and such other information as the treasurer of state
 24 24 Iowa state fair foundation may require.
 24 25    Sec. 36.  Section 174.10, subsections 1 and 2, Code 1997,
 24 26 are amended to read as follows:
 24 27    1.  Each county shall receive an equal share of any Any
 24 28 moneys appropriated to support one or more societies
 24 29 conducting one or more county or other local fairs in that
 24 30 county, if the society or societies are eligible for the state
 24 31 aid shall be received by the county.  Moneys shall be paid
 24 32 directly The county shall pay the moneys received to each
 24 33 eligible society in amounts sufficient to provide that each
 24 34 fair receives an equal amount of funding.
 24 35    2.  The association of Iowa fairs shall provide the
 25  1 treasurer of state Iowa state fair foundation with a list of
 25  2 each society in a county which is a member of the association
 25  3 and conducts a fair in that county as provided in this
 25  4 chapter.  If a county has more than one fair, the association
 25  5 shall list the name of each society conducting a fair in that
 25  6 county for three or more years.  The treasurer of state Iowa
 25  7 state fair foundation shall not authorize payment of state aid
 25  8 to a society, unless the society complies with section 174.9
 25  9 and the name of the society appears on the association's list.
 25 10    Sec. 37.  Section 174.12, unnumbered paragraph 1, Code
 25 11 1997, is amended to read as follows:
 25 12    The department of revenue and finance shall issue a warrant
 25 13 to a society for the amount due in state aid, less five
 25 14 hundred dollars, as provided in this chapter.  The treasurer
 25 15 of state Iowa state fair foundation must certify to the
 25 16 department that the society is eligible under this chapter to
 25 17 receive the amount due provided in section 174.10.  The
 25 18 department shall issue a warrant to the society for the
 25 19 remaining five hundred dollars, if all of the following apply:
 25 20    Sec. 38.  Section 452A.79, unnumbered paragraph 2, Code
 25 21 1997, is amended to read as follows:
 25 22    All moneys derived from the excise tax on the sale of motor
 25 23 fuel used in watercraft shall be deposited in the general fund
 25 24 of the state.  Moneys deposited to the general fund under this
 25 25 section and section 452A.84 are subject to the requirements of
 25 26 section 8.60 and are subject to appropriation by the general
 25 27 assembly to the department of natural resources for use in its
 25 28 recreational boating program, which may include but is not
 25 29 limited to as follows:
 25 30    Sec. 39.  NEW SECTION.  461A.3A  RESTORE THE OUTDOORS
 25 31 PROGRAM.
 25 32    1.  The department shall establish a restore the outdoors
 25 33 program.  The purpose of the program is to provide funding for
 25 34 projects involving existing vertical infrastructure as defined
 25 35 in section 8.57, subsection 5, paragraph "c", or the
 26  1 construction of new vertical infrastructure if the new
 26  2 construction is required due to increased demand for
 26  3 facilities at the park or if it is not cost-effective to
 26  4 repair or renovate the existing vertical infrastructure.
 26  5 Projects shall be limited to existing state parks and other
 26  6 public facilities managed by the department and city and
 26  7 county parks as provided in subsection 2.
 26  8    2.  There is appropriated from the rebuild Iowa
 26  9 infrastructure fund for each fiscal year of the fiscal period
 26 10 beginning July 1, 1997, and ending June 30, 2001, the sum of
 26 11 four million dollars to the department for use in the restore
 26 12 the outdoors program of which, one million dollars shall be
 26 13 used to fund projects in city or county parks which are
 26 14 connected by a recreational trail or a state park or the state
 26 15 recreational trail system.  Notwithstanding section 8.33,
 26 16 unencumbered or unobligated moneys remaining at the end of a
 26 17 fiscal year shall not revert but shall remain available for
 26 18 expenditure during the following fiscal year for purposes of
 26 19 the restore the outdoors program.
 26 20    The department shall provide in its annual budget
 26 21 documentations to the governor and general assembly a report
 26 22 on the use of moneys under the program since the last report
 26 23 and the projected use of future moneys.  
 26 24                           EXPLANATION
 26 25    The bill makes appropriations for fiscal years during the
 26 26 period beginning July 1, 1997, and ending June 30, 2001, for
 26 27 various capital and other projects.  These appropriations
 26 28 include capital projects for the departments of cultural
 26 29 affairs, general services, economic development, public
 26 30 defense, natural resources, human services, revenue and
 26 31 finance, public safety, transportation, workforce development,
 26 32 and agriculture and land stewardship, and for the commission
 26 33 of veterans affairs, Loess Hills development and conservation
 26 34 authority, state fair foundation, and board of regents.
 26 35    The bill also establishes the restore the outdoors program
 27  1 in the department of natural resources to provide maintenance
 27  2 and infrastructure improvements to existing state parks and
 27  3 other public facilities managed by the department.  The bill
 27  4 provides for an appropriation of $3 million each fiscal year
 27  5 starting July 1, 1997, and ending June 30, 2001, from the
 27  6 rebuild Iowa infrastructure fund to the department of natural
 27  7 resources for the program.
 27  8    The bill also establishes the community college vocational-
 27  9 technical technology improvement program to supplement
 27 10 community college budgets for technology.  The bill provides
 27 11 for an appropriation of $2.5 million each fiscal year starting
 27 12 July 1, 1997, and ending June 30, 2001, from the rebuild Iowa
 27 13 infrastructure fund to the department of education for the
 27 14 program.
 27 15    The bill also makes other statutory changes related to
 27 16 appropriations from the rebuild Iowa infrastructure fund or
 27 17 the general fund including providing for the distribution of
 27 18 moneys to county fairs through the state fair foundation
 27 19 instead of the treasurer of state and establishing a main
 27 20 street linked investment program.
