  1  4 PROVIDING FOR CHILD DAY CARE REQUIREMENTS FOR VOLUNTEERS AND
  1  5    FOR THE NUMBER OF CHILDREN RECEIVING CARE UNDER THE CHILD
  1  6    CARE HOME PILOT PROJECTS AND PROVIDING AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 237A.3A, subsection 3, paragraph d,
  1 11 Code Supplement 1997, is amended to read as follows:
  1 12    d.  (1)  Four levels of registration requirements are
  1 13 applicable to registered child care homes in accordance with
  1 14 subsections 10 through 13 and rules adopted to implement this
  1 15 section.  The rules shall apply requirements to each level for
  1 16 the amount of space available per child, provider
  1 17 qualifications and training, and other minimum standards.
  1 18    (2)  The rules shall allow a child day care home to be
  1 19 registered at level II, III, or IV for which the provider is
  1 20 qualified even though the amount of space required to be
  1 21 available for the maximum number of children authorized for
  1 22 that level exceeds the actual amount of space available in
  1 23 that child care home.  However, the total number of children
  1 24 authorized for the child care home at that level of
  1 25 registration shall be limited by the amount of space available
  1 26 per child.
  1 27    Sec. 2.  Section 237A.3A, subsection 13, paragraph a, Code
  1 28 Supplement 1997, is amended to read as follows:
  1 29    a.  Except as otherwise provided in this subsection, not
  1 30 more than twelve children shall be present at any one time.
  1 31 If more than seven eight children are present, a second person
  1 32 must be present who meets the individual qualifications for
  1 33 child care home registration established by rule of the
  1 34 department.
  1 35    Sec. 3.  Section 237A.5, Code Supplement 1997, is amended
  2  1 by adding the following new subsection:
  2  2    NEW SUBSECTION.  7.  A person who serves as an unpaid
  2  3 volunteer in a child day care facility shall not be required
  2  4 to complete training as a mandatory reporter of child abuse
  2  5 under section 232.69 or under any other requirement.
  2  6    Sec. 4.  CHILD CARE HOME PILOT PROJECTS – TRANSITION
  2  7 EXCEPTION.  The exception provisions of this section are
  2  8 applicable to child care homes registering under section
  2  9 237A.3A during a transition period beginning with the
  2 10 effective date of this Act and ending two years from that
  2 11 date.  During the transition period, the following provisions
  2 12 shall apply, notwithstanding section 237A.3A:
  2 13    1.  A child care home provider who is providing child day
  2 14 care to four infants at the time of registration in the pilot
  2 15 project at level I, II, or III may continue to provide care to
  2 16 those four infants.  However, if the child care home no longer
  2 17 provides care to one or more of the infants or one or more of
  2 18 the infants reaches the age of twenty-four months, the
  2 19 transition period exception authorized in this section shall
  2 20 no longer apply.  The overall limitation on the number of
  2 21 children authorized for the level of care remains applicable.
  2 22    2.  A child care home provider who at the time of
  2 23 registration in the pilot project at level I, II, or III is
  2 24 providing child day care to school age children in excess of
  2 25 the number of school age children authorized for the
  2 26 registration level may continue to provide care for those
  2 27 children.  The child care home provider may exceed the total
  2 28 number of children authorized for the level of registration by
  2 29 the number of school age children in excess of the number
  2 30 authorized for the registration level.  This transition period
  2 31 exception is subject to all of the following:
  2 32    a.  The provider must comply with the other requirements as
  2 33 to number of children which are applicable to that
  2 34 registration level.
  2 35    b.  The maximum number of children attributable to the
  3  1 authorization for school age children at the applicable
  3  2 registration level is five.
  3  3    c.  If more than eight children are present at any one
  3  4 time, the provider shall be assisted by a responsible person
  3  5 who is at least fourteen years of age.
  3  6    d.  If the child care home no longer provides care to an
  3  7 individual school age child who was receiving care at the time
  3  8 of the registration, the excess number of children allowed
  3  9 under the transition period exception shall be reduced
  3 10 accordingly.
  3 11    Sec. 5.  CHILD DAY CARE AVAILABILITY.  The department of
  3 12 human services shall consult with the child day care advisory
  3 13 council and child day care resource and referral services in
  3 14 studying the availability, accessibility, affordability, and
  3 15 quality of child day care services in the state.  The report
  3 16 of the study shall be submitted to the governor and the
  3 17 general assembly by January 1, 1999.  The report shall include
  3 18 estimates as to the need for child day care services in all
  3 19 areas of the state, the availability of providers versus the
  3 20 need, and identification of the areas with the greatest need
  3 21 and the extent of the need.
  3 22    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
  3 23 immediate importance, takes effect upon enactment.
