PAG LIN 1 1 Section 1. Section 331.212, subsection 2, Code 1997, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. i. Setting the compensation schedule of 1 4 the elected county officers. 1 5 Sec. 2. Section 331.321, subsection 1, paragraph n, Code 1 6 1997, is amended by striking the paragraph. 1 7 Sec. 3. Section 331.322, subsection 6, Code 1997, is 1 8 amended to read as follows: 1 9 6.ReviewAnnually review and prepare thefinal1 10compensation schedule of the county compensation board and1 11determine the finalcompensation schedule in accordance with 1 12 section 331.907. 1 13 Sec. 4. Section 331.322, subsection 7, Code 1997, is 1 14 amended by striking the subsection. 1 15 Sec. 5. Section 331.323, subsection 1, unnumbered 1 16 paragraph 5, Code 1997, is amended to read as follows: 1 17WhenIf the duties of an officer or employee are assigned 1 18 to one or more elected officers, the board shall set the 1 19initialsalary for each elected officer. Thereafter, the1 20salary shall be determinedas provided in section 331.907. 1 21 Sec. 6. Section 331.907, subsection 1, Code 1997, is 1 22 amended by striking the subsection and inserting in lieu 1 23 thereof the following: 1 24 1. a. The annual compensation of the auditor, treasurer, 1 25 recorder, sheriff, county attorney, and supervisors shall be 1 26 determined as provided in this section. The board of 1 27 supervisors shall annually review compensation paid to 1 28 comparable officers in other counties of this state, other 1 29 states, private enterprise, and the federal government. 1 30 b. In setting the salary of the county sheriff, the board 1 31 shall consider setting the sheriff's salary so that it is 1 32 comparable to salaries paid to professional law enforcement 1 33 administrators and command officers of the Iowa highway safety 1 34 patrol, the division of criminal investigation of the 1 35 department of public safety, and city police agencies in this 2 1 state. 2 2 c. The board shall prepare a compensation schedule for the 2 3 elective county officers for the succeeding fiscal year. A 2 4 majority vote of the membership of the board is required to 2 5 approve the compensation schedule. 2 6 Sec. 7. Section 331.907, subsection 2, Code 1997, is 2 7 amended to read as follows: 2 8 2. At the public hearing held on the county budget as 2 9 provided in section 331.434, thecounty compensationboard 2 10 shall submit itsrecommendedcompensation schedule for the 2 11 next fiscal yearto the board of supervisorsfor inclusion in 2 12 the county budget.The board of supervisors shall review the2 13recommended compensation schedule for the elected county2 14officers and determine the final compensation schedule which2 15shall not exceed the compensation schedule recommended by the2 16county compensation board. In determining the final compen-2 17sation schedule if the board of supervisors wishes to reduce2 18the amount of the recommended compensation schedule, the2 19amount of salary increase proposed for each elected county2 20officer shall be reduced an equal percentage.A copy of the 2 21finalcompensation schedule shall be filed with the county 2 22 budget at the office of the director of the department of 2 23 management. Thefinalcompensation schedule takes effect on 2 24 July 1 following its adoption by the board of supervisors. 2 25 Sec. 8. Chapter 2A, Code 1997, is repealed. 2 26 Sec. 9. Section 331.905, Code 1997, is repealed. 2 27 EXPLANATION 2 28 This bill abolishes the county compensation board and 2 29 transfers to the county board of supervisors the duty of 2 30 setting the compensation schedule for elective county 2 31 officers. 2 32 The bill abolishes the commission on compensation, 2 33 expenses, and salaries for elected state officials. The 2 34 current Code establishes the 15-member commission, requires 2 35 the commission to report biennially, sets forth provisions 3 1 relating to the commission members' terms and the expenses of 3 2 the commission, and requires the general assembly to consider 3 3 the recommendations of the commission. Action by the general 3 4 assembly is required to change the salaries of the elected 3 5 officials. 3 6 The current provisions require the commission to review the 3 7 compensation and expenses received by members of the general 3 8 assembly and the salaries of the other elective state 3 9 officials, and compare the compensation, expenses, and 3 10 salaries to those of comparable positions in other states, the 3 11 federal government, and private enterprise. Under the current 3 12 Code, the commission is required to make its determination as 3 13 to compensation and expense levels for the members of the 3 14 general assembly and for the other elective state officials 3 15 and to submit a recommendation to the governor and the general 3 16 assembly. 3 17 LSB 2711SV 77 3 18 rn/jw/5
