  1  1    Section 1.  Section 331.212, subsection 2, Code 1997, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  i.  Setting the compensation schedule of
  1  4 the elected county officers.
  1  5    Sec. 2.  Section 331.321, subsection 1, paragraph n, Code
  1  6 1997, is amended by striking the paragraph.
  1  7    Sec. 3.  Section 331.322, subsection 6, Code 1997, is
  1  8 amended to read as follows:
  1  9    6.  Review Annually review and prepare the final
  1 10 compensation schedule of the county compensation board and
  1 11 determine the final compensation schedule in accordance with
  1 12 section 331.907.
  1 13    Sec. 4.  Section 331.322, subsection 7, Code 1997, is
  1 14 amended by striking the subsection.
  1 15    Sec. 5.  Section 331.323, subsection 1, unnumbered
  1 16 paragraph 5, Code 1997, is amended to read as follows:
  1 17    When If the duties of an officer or employee are assigned
  1 18 to one or more elected officers, the board shall set the
  1 19 initial salary for each elected officer.  Thereafter, the
  1 20 salary shall be determined as provided in section 331.907.
  1 21    Sec. 6.  Section 331.907, subsection 1, Code 1997, is
  1 22 amended by striking the subsection and inserting in lieu
  1 23 thereof the following:
  1 24    1.  a.  The annual compensation of the auditor, treasurer,
  1 25 recorder, sheriff, county attorney, and supervisors shall be
  1 26 determined as provided in this section.  The board of
  1 27 supervisors shall annually review compensation paid to
  1 28 comparable officers in other counties of this state, other
  1 29 states, private enterprise, and the federal government, or as
  1 30 an alternative, the board may appoint a five-member committee
  1 31 to assist with the annual review and advise on the annual
  1 32 salaries of the elective county officers.
  1 33    b.  If an advisory committee is created, the advisory
  1 34 committee shall have five members appointed as follows:
  1 35    (1)  One member shall represent a recognized local, area,
  2  1 or state taxpayer association.
  2  2    (2)  One member shall represent a recognized local or state
  2  3 farm organization.
  2  4    (3)  One member shall represent a local or area chamber of
  2  5 commerce.
  2  6    (4)  Two members shall be electors of the county selected
  2  7 by the board.
  2  8    c.  The board shall invite each of the three recognized
  2  9 associations or organizations to appoint a member to the
  2 10 advisory committee.  The board shall provide the advisory
  2 11 committee with the necessary guidelines, assistance, and
  2 12 resources to carry out its advisory duties.
  2 13    d.  In setting the salary of the county sheriff, the board
  2 14 shall consider setting the sheriff's salary so that it is
  2 15 comparable to salaries paid to professional law enforcement
  2 16 administrators and command officers of the Iowa highway safety
  2 17 patrol, the division of criminal investigation of the
  2 18 department of public safety, and city police agencies in this
  2 19 state.
  2 20    e.  The board, with the assistance of the advisory
  2 21 committee if appointed, shall prepare a compensation schedule
  2 22 for the elective county officers for the succeeding fiscal
  2 23 year.  A majority vote of the membership of the board is
  2 24 required to approve the compensation schedule.
  2 25    Sec. 7.  Section 331.907, subsection 2, Code 1997, is
  2 26 amended to read as follows:
  2 27    2.  At the public hearing held on the county budget as
  2 28 provided in section 331.434, the county compensation board
  2 29 shall submit its recommended compensation schedule for the
  2 30 next fiscal year to the board of supervisors for inclusion in
  2 31 the county budget.  The board of supervisors shall review the
  2 32 recommended compensation schedule for the elected county
  2 33 officers and determine the final compensation schedule which
  2 34 shall not exceed the compensation schedule recommended by the
  2 35 county compensation board.  In determining the final compen-
  3  1 sation schedule if the board of supervisors wishes to reduce
  3  2 the amount of the recommended compensation schedule, the
  3  3 amount of salary increase proposed for each elected county
  3  4 officer shall be reduced an equal percentage.  A copy of the
  3  5 final compensation schedule shall be filed with the county
  3  6 budget at the office of the director of the department of
  3  7 management.  The final compensation schedule takes effect on
  3  8 July 1 following its adoption by the board of supervisors.
  3  9    Sec. 8.  Section 331.905, Code 1997, is repealed.  
  3 10                           EXPLANATION
  3 11    This bill abolishes the county compensation board and
  3 12 transfers to the county board of supervisors the duty of
  3 13 setting the compensation schedule for elective county
  3 14 officers.  The bill also authorizes the board of supervisors
  3 15 to appoint an advisory committee of five members to assist in
  3 16 determining salaries for elective county officers.  Two
  3 17 members are selected by the board of supervisors and three
  3 18 members are appointed to represent a taxpayers association, a
  3 19 farm organization, and a chamber of commerce.  Each of the
  3 20 three types of organizations are invited by the board of
  3 21 supervisors to appoint a member to the advisory committee.
