PAG LIN 1 1 Section 1. Section 904.107, Code 1997, is amended to read 1 2 as follows: 1 3 904.107 DIRECTOR – APPOINTMENT AND QUALIFICATIONS. 1 4 The chief administrative officer for the department is the 1 5 director. The director shall be appointed by the governor 1 6 subject to confirmation by the senate and shall serve at the 1 7 pleasure of the governor. The director shall be qualified in 1 8 reformatory and prison management, knowledgeable in community- 1 9 based corrections and criminology, and shall possess 1 10 administrative ability.The director shall also have1 11experience in the field of criminology and discipline and in1 12the supervision of inmates in corrective penal institutions.1 13 The director shall not be selected on the basis of political 1 14 affiliation, and while employed as the director, shall not be 1 15 a member of a political committee, participate in a political 1 16 campaign, be a candidate for a partisan elective office, and 1 17 shall not contribute to a political campaign fund, except that 1 18 the director may designate on the checkoff portion of the 1 19 state or federal income tax return, or both, a party or 1 20 parties to which a contribution is made pursuant to the 1 21 checkoff. The director shall not hold any other office under 1 22 the laws of the United States or of this or any state or hold 1 23 any position for profit and shall devote full time to the 1 24 duties of office. 1 25 EXPLANATION 1 26 This bill eliminates the requirement that the director of 1 27 the department of corrections have experience in the 1 28 supervision of inmates in corrective penal institutions. The 1 29 requirements that the director be qualified in prison 1 30 management and knowledgeable in community-based corrections 1 31 and criminology are retained. 1 32 LSB 2249SV 77 1 33 ec/jj/8
