PAG LIN 1 1 Section 1. Section 99B.1, Code 1997, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 8A. "Casino-type gambling" means a game 1 4 or activity traditionally conducted at a casino and includes, 1 5 but is not limited to, roulette, craps, poker, slot machines, 1 6 blackjack, klondike, faro, keno, and electronic, mechanical, 1 7 or video machines offering such games. 1 8 Sec. 2. Section 99B.1, subsections 14 and 15, Code 1997, 1 9 are amended to read as follows: 1 10 14. "Game of chance" means a game whereby the result is 1 11 determined by chance and the player in order to win aligns 1 12 objects or balls in a prescribed pattern or order or makes 1 13 certain color patterns appear and specifically includes but is 1 14 not limited to the game defined as bingo. "Game of chance" 1 15 does not include a slot machine or other casino-type gambling. 1 16 15. "Game of skill" means a game whereby the result is 1 17 determined by the player directing or throwing objects to 1 18 designated areas or targets, or by maneuvering water or an 1 19 object into a designated area, or by maneuvering a dragline 1 20 device to pick up particular items, or by shooting a gun or 1 21 rifle. "Game of skill" does not include casino-type gambling. 1 22 Sec. 3. Section 99B.8, subsection 1, unnumbered paragraph 1 23 1, Code 1997, is amended to read as follows: 1 24 Games of skill, games of chance, card games,andraffles, 1 25 and casino-type gambling other than slot machines and 1 26 electronic, mechanical, or video machines offering casino-type 1 27 gambling, lawfully may be conducted during a period of twelve 1 28 consecutive hours once each year by any person. The games or 1 29 raffles may be conducted at any location except one for which 1 30 a license is required pursuant to section 99B.3 or section 1 31 99B.5, but only if all of the following are complied with: 1 32 Sec. 4. Section 99B.10, Code 1997, is amended by adding 1 33 the following new unnumbered paragraph: 1 34 NEW UNNUMBERED PARAGRAPH. An amusement device does not 1 35 include casino-type gambling. 2 1 Sec. 5. Section 725.9, subsection 2, Code 1997, is amended 2 2 by striking the subsection. 2 3 Sec. 6. Section 725.9, subsection 3, Code 1997, is amended 2 4 to read as follows: 2 5 3. "Gambling device" means a device used or adapted or 2 6 designed to be used for gambling and includes, but is not 2 7 limited to, roulette wheels, klondike tables, punchboards, 2 8 faro layouts, keno layouts, numbers tickets, slot machines, 2 9pinball machines,push cards, jar tickets and pull-tabs. 2 10 However, "gambling device" does not include an antique slot 2 11 machine, antique pinball machine,or any device regularly 2 12 manufactured and offered for sale and sold as a toy, except 2 13 that any use of such a toy,or antique slot machineor antique2 14pinball machinefor gambling purposes constitutes unlawful 2 15 gambling. 2 16 EXPLANATION 2 17 The amendments to section 99B.1, subsections 14 and 15, 2 18 specify that "games of chance" and "games of skill" do not 2 19 include casino-type gambling which is also defined in the 2 20 bill. "Casino-type gambling" is defined as a game or activity 2 21 traditionally conducted at a casino, including but not limited 2 22 to roulette, craps, poker, slot machines, blackjack, klondike, 2 23 faro, keno, and electronic, mechanical, or video machines 2 24 offering such games. 2 25 The bill provides that casino-type gambling may be 2 26 conducted at annual game nights; however, slot machines and 2 27 video gambling games are excluded from the annual game nights. 2 28 The bill also specifies that an amusement device does not 2 29 include casino-type gambling as defined in the bill. 2 30 The bill also strikes the definition of antique pinball 2 31 machine from section 725.9 and strikes the terms antique 2 32 pinball machine and pinball machine from the definition of 2 33 gambling device in that section. 2 34 A violation of chapter 99B is a serious misdemeanor 2 35 punishable by a fine of not less than $250 but not more than 3 1 $1,500.
