  1  4 RELATING TO JUDICIAL ADMINISTRATION.

  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  7 
  1  8    Section 1.  Section 602.5203, Code 1997, is amended to read
  1  9 as follows:
  1 10    602.5203  LAW CLERKS.
  1 11    The court of appeals may employ not more than six attorneys
  1 12 or graduates of a reputable law school to act as legal
  1 13 assistants to the court.
  1 14    Sec. 2.  Section 602.8103, subsection 4, paragraph i, Code
  1 15 1997, is amended to read as follows:
  1 16    i.  Court files, as provided by rules prescribed by the
  1 17 supreme court, ten years after final disposition in civil
  1 18 cases, or ten years after expiration of all sentences in
  1 19 criminal cases.  For purposes of this paragraph, "purging"
  1 20 means the removal and destruction of documents in the court
  1 21 file which have no legal, administrative, or historical value.
  1 22 Purging shall be done without reproduction of the removed
  1 23 documents.  For purposes of this paragraph, "civil cases" does
  1 24 not include divorce, dissolution of marriage, child support,
  1 25 or paternity cases, or juvenile, mental health, probate, or
  1 26 adoption proceedings.
  1 27    Sec. 3.  Section 602.8107, subsection 5, unnumbered
  1 28 paragraph 1, Code 1997, is amended to read as follows:
  1 29    If a county attorney does not file the notice and list of
  1 30 cases required in section 331.756, subsection 5, the judicial
  1 31 department may assign obligations cases to the centralized
  1 32 collection unit of the department of revenue and finance or
  1 33 its designee to collect delinquent debts owed to the clerk of
  1 34 the district court.
  1 35    Sec. 4.  Section 692A.5, Code 1997, is amended by adding
  2  1 the following new subsection:
  2  2    NEW SUBSECTION.  4.  The court may order an appropriate law
  2  3 enforcement agency or the county attorney to assist the court
  2  4 in performing the requirements of subsection 1.
  2  5    Sec. 5.  Section 907.4, Code 1997, is amended to read as
  2  6 follows:
  2  7    907.4  DEFERRED JUDGMENT DOCKET.
  2  8    A deferment of judgment under section 907.3 shall be
  2  9 reported promptly by the clerk of the district court, or the
  2 10 clerk's designee, to the state court administrator who shall
  2 11 maintain for entry in the deferred judgment docket.  The
  2 12 docket shall contain a permanent record of the deferred
  2 13 judgment including the name and date of birth of the
  2 14 defendant, the district court docket number, the nature of the
  2 15 offense, and the date of the deferred judgment.  Before
  2 16 granting deferred judgment in any case, the court shall
  2 17 request of the state court administrator a search of the
  2 18 deferred judgment docket and shall consider any prior record
  2 19 of a deferred judgment against the defendant.  The permanent
  2 20 record provided for in this section is a confidential record
  2 21 exempted from public access under section 22.7 and shall be
  2 22 available only to justices of the supreme court, judges of the
  2 23 court of appeals, district judges, district associate judges,
  2 24 judicial magistrates, clerks of the district court, and county
  2 25 attorneys requesting information pursuant to this section, or
  2 26 the designee of a justice, judge, magistrate, clerk, or county
  2 27 attorney.
