1 4 PROVIDING IMMUNITY FROM CIVIL LIABILITY FOR AN EMPLOYER OR
1 5 EMPLOYER'S REPRESENTATIVE WHO ACTS REASONABLY IN
1 6 PROVIDING WORK-RELATED INFORMATION ABOUT A CURRENT OR
1 7 FORMER EMPLOYEE OF THE EMPLOYER.

1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 11 Section 1. NEW SECTION. 91B.2 INFORMATION PROVIDED BY
1 12 EMPLOYERS ABOUT CURRENT OR FORMER EMPLOYEES – IMMUNITY.
1 13 1. An employer or an employer's representative who, upon
1 14 request by or authorization of a current or former employee or
1 15 upon request made by a person who in good faith is believed to
1 16 be a representative of a prospective employer of a current or
1 17 former employee, provides work-related information about a
1 18 current or former employee, is immune from civil liability
1 19 unless the employer or the employer's representative acted
1 20 unreasonably in providing the work-related information.
1 21 2. For purposes of this section, an employer acts
1 22 unreasonably if any of the following are present:
1 23 a. The work-related information violates a civil right of
1 24 the current or former employee.
1 25 b. The work-related information knowingly is provided to a
1 26 person who has no legitimate and common interest in receiving
1 27 the work-related information.
1 28 c. The work-related information is not relevant to the
1 29 inquiry being made, is provided with malice, or is provided
1 30 with no good faith belief that it is true.
1 31 3. For purposes of this section, "employer" and "employee"
1 32 are defined as provided in section 91A.2.
