1 1 Section 1. Section 260C.22, subsection 4, unnumbered
1 2 paragraph 2, Code 1997, is amended to read as follows:
1 3 The revenues derived from the levies shall be placed in a
1 4 separate cash reserve fund. Notwithstanding subsection 3,
1 5 moneys from the cash reserve fund established by a merged area
1 6 under subsection 3 or this subsection shall be used only to
1 7 alleviate temporary cash shortages and for the acquisition,
1 8 lease, lease-purchase, installation, and maintenance of
1 9 instructional technology equipment, including hardware and
1 10 software, materials and supplies, and staff development and
1 11 training related to instructional technology. If moneys from
1 12 the cash reserve fund are used to alleviate a temporary cash
1 13 shortage, the cash reserve fund shall be reimbursed
1 14 immediately from the general fund of the community college as
1 15 funds in the general fund become available, but in no case
1 16 later than June 30 of the current fiscal year, to repay the
1 17 funds taken from the cash reserve fund.
1 18 EXPLANATION
1 19 This bill permits the board of directors of any merged area
1 20 to use revenues derived from the merged area's cash reserve
1 21 levy for the acquisition, lease, lease-purchase, installation,
1 22 and maintenance of instructional technology equipment,
1 23 including hardware and software, materials and supplies, and
1 24 staff development and training related to instructional
1 25 technology. Currently, a board can use the revenues only to
1 26 relieve temporary cash shortages, and must reimburse the cash
1 27 reserve fund from the general fund of the community college
1 28 when funds become available. The bill does not require
1 29 reimbursement of the fund when revenues are used for purposes
1 30 related to instructional technology.
