  1  1    Section 1.  NEW SECTION.  260A.1  LEGISLATIVE FINDINGS AND
  1  2 INTENT.
  1  3    The general assembly finds that it is in the public
  1  4 interest to increase the availability of instructional
  1  5 technology within the community colleges of this state to
  1  6 ensure that students and faculty are equipped and prepared to
  1  7 excel in the twenty-first century.  Toward that goal, it is
  1  8 the intent of this chapter to establish and fund a community
  1  9 college technology improvement program.
  1 10    Sec. 2.  NEW SECTION.  260A.2  COMMUNITY COLLEGE TECHNOLOGY
  1 11 IMPROVEMENT APPROPRIATION.
  1 12    1.  There is appropriated from the general fund of the
  1 13 state to the department of education for each fiscal year of
  1 14 the fiscal period beginning July 1, 1997, and ending June 30,
  1 15 2002, the sum of three million dollars for the community
  1 16 college technology improvement program.
  1 17    2.  Moneys appropriated in subsection 1 shall be allocated
  1 18 to each community college by the department of education in
  1 19 the proportion that the allocation to that community college
  1 20 in 1996 Iowa Acts, chapter 1215, section 6, subsection 15,
  1 21 bears to the total appropriation made in 1996 Iowa Acts,
  1 22 section 6, subsection 15.
  1 23    3.  For each year in which an appropriation is made to the
  1 24 community college technology improvement program, the
  1 25 department of education shall notify the department of revenue
  1 26 and finance of the amount to be paid to each community college
  1 27 based upon the allocation criteria set forth for the
  1 28 appropriation pursuant to subsection 2.  The allocation to
  1 29 each community college under this section shall be made in one
  1 30 payment on or about October 15 of the fiscal year in which the
  1 31 appropriation is made, taking into consideration the relative
  1 32 budget and cash position of the state resources.
  1 33    4.  Moneys received under this section shall not be
  1 34 commingled with general state financial aid, including
  1 35 financial aid to merged areas in lieu of personal property tax
  2  1 replacement payments under section 427A.13, to merged areas as
  2  2 defined in section 260C.2, and including moneys received for
  2  3 vocational education programs in accordance with chapters 258
  2  4 and 260C.  Payments made to a community college shall be
  2  5 accounted for by the community college separately from state
  2  6 aid payments.  Each community college shall maintain a
  2  7 separate listing within its budget accounting for payments
  2  8 received and expenditures made pursuant to this section.
  2  9    5.  Moneys received under this section shall not be used
  2 10 for payment of any collective bargaining agreement or
  2 11 arbitrator's decision negotiated or awarded under chapter 20.
  2 12    Sec. 3.  NEW SECTION.  260A.3  COMMUNITY COLLEGE TECHNOLOGY
  2 13 IMPROVEMENT PLANS.
  2 14    Prior to receiving moneys under this chapter, the board of
  2 15 directors of a community college shall adopt a technology plan
  2 16 that supports community college technology improvement efforts
  2 17 and includes an evaluation component, and shall provide to the
  2 18 department of education adequate assurance that funds received
  2 19 under this chapter will be used in accordance with the
  2 20 technology plan.  The plan shall be developed by licensed
  2 21 professional staff of the community college, including both
  2 22 faculty members and school administrators, and shall, at a
  2 23 minimum, focus on the attainment of student achievement goals.
  2 24 The plan shall consider the community college's
  2 25 interconnectivity with the Iowa communications network, and
  2 26 shall demonstrate how, over a five-year period, the board will
  2 27 utilize technology to improve student achievement.  The
  2 28 technology plan shall be kept on file at the community
  2 29 college.  Progress made under the plan shall be reported
  2 30 annually to the department of education in a manner prescribed
  2 31 by the department of education.
  2 32    Sec. 4.  NEW SECTION.  260A.4  COMMUNITY COLLEGE TECHNOLOGY
  2 33 IMPROVEMENT EXPENDITURES.
  2 34    A community college shall expend funds received pursuant to
  2 35 section 260A.2 for the acquisition, lease, lease-purchase,
  3  1 installation, and maintenance of instructional technology
  3  2 equipment, including hardware and software, materials and
  3  3 supplies related to instructional technology, and staff
  3  4 development and training related to instructional technology,
  3  5 and shall establish priorities for the use of the funds.
  3  6 However, funds received by a community college pursuant to
  3  7 section 260A.2 shall not be expended to add a full-time
  3  8 equivalent position or otherwise increase staffing.
  3  9    Sec. 5.  NEW SECTION.  260A.5  FUTURE REPEAL.
  3 10    This chapter is repealed effective July 1, 2002.  
  3 11                           EXPLANATION
  3 12    This bill establishes a community college technology
  3 13 improvement program similar to the school improvement
  3 14 technology program established for school districts and area
  3 15 education agencies by the general assembly in 1996.
  3 16    The bill appropriates $3 million from the general fund of
  3 17 the state to the department of education for each fiscal year
  3 18 of the fiscal period beginning July 1, 1997, and ending June
  3 19 30, 2002, for the community college technology improvement
  3 20 program.  The moneys are to be allocated to the community
  3 21 colleges in the same proportions as state aid was allocated to
  3 22 the community colleges in House File 2477, the education
  3 23 appropriations Act enacted in 1996.
  3 24    Under the bill, the allocation to each community college is
  3 25 to be made in one payment on or about October 15 of the fiscal
  3 26 year in which the appropriation is made, taking into
  3 27 consideration the relative budget and cash position of the
  3 28 state resources.  Moneys received by a community college shall
  3 29 not be commingled with other state aid.  Payments made to a
  3 30 community college must be accounted for by the community
  3 31 college separately from state aid payments, and each community
  3 32 college shall maintain a separate listing within its budget
  3 33 for payments received and expenditures made under the program.
  3 34    The bill prohibits the program moneys from being used to
  3 35 pay any collective bargaining agreement or arbitrator's
  4  1 decision negotiated or awarded under chapter 20.
  4  2    Prior to receiving program moneys, the board of directors
  4  3 of a community college must adopt a technology plan that
  4  4 includes an evaluation component and must provide to the
  4  5 department of education adequate assurance that program funds
  4  6 will be used in accordance with the technology plan.  The plan
  4  7 shall be developed by licensed faculty members and school
  4  8 administrators of the community college and shall, at a
  4  9 minimum, focus on the attainment of student achievement goals,
  4 10 shall consider the community college's interconnectivity with
  4 11 the Iowa communications network, and shall demonstrate how,
  4 12 over a five-year period, the board will utilize technology to
  4 13 improve student achievement.  The community college is
  4 14 directed to keep the technology plan on file.  Progress made
  4 15 under the plan shall be reported annually to the department of
  4 16 education.
  4 17    Under the bill, program moneys may be used by a community

  4 25    The bill provides for the repeal of the chapter effective
  4 26 July 1, 2002.
