  1  1    Amend the amendment, S-5733, to the House
  1  2 amendment, S-5359, to Senate File 2320, as passed by
  1  3 the Senate, as follows:
  1  4    #1.  Page 2, by inserting after line 20 the
  1  5 following:
  1  6    "Sec. ___.  Section 99F.11, Code 1997, is amended
  1  7 by adding the following new unnumbered paragraph:
  1  8    NEW UNNUMBERED PARAGRAPH.  Notwithstanding section
  1  9 99F.5A, the moratorium shall be implemented only if
  1 10 all gambling facilities in this state are taxed at the
  1 11 same tax rate and all pari-mutuel tracks are taxed at
  1 12 the same tax rate including gambling facilities owned
  1 13 and operated by native Americans."
