  1  1    Amend the amendment, S-5497, to House File 2539, as
  1  2 amended, passed, and reprinted by the House, as
  1  3 follows:
  1  4    #1.  Page 1, by striking lines 7 through 18 and
  1  5 inserting the following:
  1  6    "#   .  Page 10, line 27, by inserting after the
  1  7 word "positions" the following:  "provided that the
  1  8 department of corrections shall not enter into a new
  1  9 contract, unless the contract is a renewal of an
  1 10 existing contract, for the expenditure of moneys in
  1 11 excess of $100,000 during the fiscal year beginning
  1 12 July 1, 1998, for the privatization of services
  1 13 performed by the department using state employees as
  1 14 of July 1, 1998, or for the privatization of new
  1 15 services by the department, without prior consultation
  1 16 with any applicable state employee organization
  1 17 affected by the proposed new contract and prior
  1 18 notification of the co-chairpersons and ranking
  1 19 members of the joint appropriations subcommittee on
  1 20 the justice system; and provided further that the
  1 21 department of corrections shall not enter into a lease
  1 22 or contractual agreement pursuant to section 904.809
  1 23 with a private corporation for the use of building
  1 24 space for the purpose of providing inmate employment
  1 25 without notifying, at least twenty-one calendar days
  1 26 prior to the execution of the lease or contractual
  1 27 agreement, the chairpersons and ranking members of the
  1 28 general assembly's joint appropriations subcommittee
  1 29 on the justice system of the name of the person
  1 30 entering into the lease or contract, and the terms of
  1 31 the lease or contract; and provided further that the
  1 32 department of corrections shall not enter into a lease
  1 33 or contractual agreement pursuant to section 904.809
  1 34 with a private corporation for the use of building
  1 35 space for the purpose of providing inmate employment
  1 36 without providing that the terms of the lease or
  1 37 contract establish safeguards to restrict, to the
  1 38 greatest extent feasible, access by inmates working
  1 39 for the private corporation to personal identifying
  1 40 information of citizens; and provided further that the
  1 41 department of corrections shall not enter into any
  1 42 agreement with a private for-profit agency or
  1 43 corporation for the purpose of transferring inmates
  1 44 under the custody of the department to a jail or
  1 45 correctional facility or institution in this state
  1 46 which is established, maintained, or operated by a
  1 47 private for-profit agency or corporation without prior
  1 48 approval by the general assembly".
