PAG LIN 1 1 Section 1. Section 321.1, Code 1997, is amended by adding 1 2 the following new subsections: 1 3 NEW SUBSECTION. 15A. "Crane" means a machine for raising, 1 4 shifting, and lowering heavy weights by means of a projecting 1 5 swinging arm. 1 6 NEW SUBSECTION. 63A. "Retractable axle" means an axle 1 7 designed with the capability of manipulation or adjustment of 1 8 the weight on the axle by use of a manual device located on 1 9 the vehicle that is not accessible to the operator of the 1 10 vehicle during operation. A vehicle or combination of 1 11 vehicles operating with a retractable axle on a highway in 1 12 this state shall comply with this paragraph on or after July 1 13 1, 1999. 1 14 Sec. 2. Section 321.440, subsection 7, Code 1997, is 1 15 amended to read as follows: 1 16 7. Been regrooved or recut below the original tread design 1 17 depth, excepting special tires which have extra under tread 1 18 rubber and are identified as such, or if a pneumatic tire was 1 19 originally designed without grooves or tread, the safety1 20standards therefor shall be established by the director. 1 21 Sec. 3. Section 321.440, Code 1997, is amended by adding 1 22 the following new unnumbered paragraph after subsection 7: 1 23 NEW UNNUMBERED PARAGRAPH. A vehicle equipped with either 1 24 solid rubber or pneumatic tires shall not be operated where 1 25 the weight per inch of tire is greater than five hundred 1 26 seventy-five pounds per inch based on the tire width rating, 1 27 except on a steering axle, in which case six hundred pounds 1 28 per square inch is permitted based on the tire width rating. 1 29 Sec. 4. Section 321.456, Code 1997, is amended to read as 1 30 follows: 1 31 321.456 HEIGHT OF VEHICLES – PERMITS – EXEMPTION. 1 32 A vehicle unladen or with load shall not exceed a height of 1 33 thirteen feet, six inches, except by permit as provided in 1 34 this section. However, a vehicle or combination of vehicles 1 35 coupled together used exclusively for the transportation of 2 1 passenger vehicles, light delivery trucks, panel delivery 2 2 trucks, pickup trucks, or recreational vehicle chassis may 2 3 operate without a permit provided that the height of the 2 4 vehicle or vehicles coupled together does not exceed fourteen 2 5 feet. This section shall not be construed to require any 2 6 railroad or public authorities to provide sufficient vertical 2 7 clearance to permit the operation of such vehicle upon the 2 8 highways of this state. Any damage to highways, highway or 2 9 railroad structures or underpasses caused by the height of any 2 10 vehicle provided for by this section shall be borne by the 2 11 operator or owner of the vehicle. Vehicles unladen or with 2 12 load exceeding a height of thirteen feet, six inches but not 2 13 exceeding fourteen feet may be operated with a permit issued 2 14 by the department or jurisdictional local authorities. The 2 15 permits shall be issued annually for a fee of twenty-five 2 16 dollars and subject to rules adopted by the department. The 2 17 state or a political subdivision shall not be liable for 2 18 damage to any vehicle or its cargo if changes in vertical 2 19 clearance of a structure are made subsequent to the issuance 2 20 of a permit during the term of the permit. 2 21 Sec. 5. Section 321.463, Code 1997, is amended to read as 2 22 follows: 2 23 321.463 MAXIMUM GROSS WEIGHT – EXCEPTIONS – PENALTIES. 2 24 1. An axle may be divided into two or more parts, except 2 25 that all parts in the same vertical transverse plane shall be 2 26 considered as one axle. 2 27 2. The gross weight on any one axle of a vehicle, or of a 2 28 combination of vehicles, operated on the highways of this 2 29 state, shall not exceed twenty thousand pounds on an axle 2 30 equipped with pneumatic tires, and shall not exceed fourteen 2 31 thousand pounds on an axle equipped with solid rubber tires. 2 32 The gross weight on any tandem axle of a vehicle, or any 2 33 combination of vehicles, shall not exceed thirty-four thousand 2 34 pounds on an axle equipped with pneumatic tires. 2 35 3. Notwithstanding other provisions of this chapter to the 3 1 contrary, indivisible loads operating under the permit 3 2 requirements of sections 321E.7, 321E.8, and 321E.9 shall be 3 3 allowed a maximum of twenty thousand pounds per axle. 3 4A group of two or more consecutive axles of any vehicle or3 5combination of vehicles, shall not carry a load in pounds in3 6excess of the overall gross weight determined by application3 7of the following formula: W equals 500 (LN/N-1 + 12N + 36). W3 8equals the overall gross weight on any group of two or more3 9consecutive axles to the nearest five hundred pounds, L equals3 10the distance in feet, rounded to the nearest whole foot,3 11between the extreme of any group of two or more consecutive3 12axles, and N equals the number of axles in the group under3 13consideration. The following are exceptions to application of3 14the formula:3 151. Two consecutive sets of tandem axles may carry a gross3 16load of thirty-four thousand pounds each providing the overall3 17distance between the first and last axles of the consecutive3 18sets of tandem axles is thirty-six feet or more.3 192. On highways not part of the interstate system, a3 20vehicle or combination of vehicles having:3 21a. Four axles where the extreme axles are eighteen feet3 22apart may carry a gross load of fifty-three thousand pounds.3 23b. Five axles where the extreme axles are thirty-two feet3 24apart may carry a gross load of sixty-seven thousand five3 25hundred pounds.3 26c. Six or more axles where the extreme axles are forty-one3 27feet apart may carry a gross load of seventy-eight thousand3 28pounds.3 29For every foot of distance between extreme axles less than the3 30above axle spacings, the overall gross weight of the vehicle3 31or combination of vehicles shall be determined by deducting3 32one thousand pounds from the gross loads specified in3 33paragraphs "a", "b" and "c". All measurements between extreme3 34axles shall be rounded to the nearest whole foot.3 35The maximum gross weight shall not exceed eighty thousand4 1pounds.4 2 4. a. The weight on any one axle, including a tandem axle, of 8 2 a vehicle which is transporting livestock on highways not part 8 3 of the interstate system may exceed the legal maximum weight 8 4 given in this chapter providing that the gross weight on any 8 5 particular group of axles on such vehicle does not exceed the 8 6 gross weight allowable under this chapter for such groups of 8 7 axles. 8 8 6. In addition, the weight on any one axle, including a 8 9 tandem axle, of a vehicle which is transporting raw materials 8 10 from a designated borrow site to a construction project or 8 11 transporting raw materials from a construction project, may 8 12 exceed the legal maximum weight otherwise allowed under this 8 13 chapter by ten percent if the gross weight on any particular 8 14 group of axles on the vehicle does not exceed the gross weight 8 15 allowed under this chapter for that group of axles. However, 8 16 if the vehicle exceeds the ten percent tolerance allowed for 8 17 any one axle or tandem axle under this paragraph the fine to 8 18 be assessed for the axle or tandem axle shall be computed on 8 19 the difference between the actual weight and the ten percent 8 20 tolerance weight allowed for the axle or tandem axle under 8 21 this paragraph. This paragraph applies only to vehicles 8 22 operating along a route of travel approved by the department. 8 23 7. A vehicle or combination of vehicles transporting 8 24 materials to or from a construction project or commercial 8 25 plant site shall comply with the formula under this section 8 26 which is used for travel on highways that are part of the 8 27 interstate system. This paragraph applies only to a vehicle 8 28 or combination of vehicles operating along a route of travel 8 29 approved by the department or appropriate local authority. 8 30 8. A vehicle designed to tow wrecked or disabled vehicles 8 31 shall be exempt from the weight limitations in this section 8 32 while the vehicle is towing a wrecked or disabled vehicle. 8 33 9. a. A person who operates a vehicle in violation of the 8 34 provisions of this section, and an owner, or any other person, 8 35 employing or otherwise directing the operator of a vehicle, 9 1 who requires or knowingly permits the operation of a vehicle 9 2 in violation of the provisions of this section shall be fined 9 3 according to the following schedule: 9 4 AXLE, TANDEM AXLE, 9 5 AND GROUP OF AXLES 9 6 WEIGHT VIOLATIONS 9 7 Pounds Overloaded Amount of Fine 9 8 Up to and including $10 plus one-half cent 9 9 1,000 pounds per pound 9 10 Over 1,000 pounds to and $15 plus one-half cent 9 11 including 2,000 pounds per pound 9 12 Over 2,000 pounds to and $80 plus three cents 9 13 including 3,000 pounds per pound 9 14 Over 3,000 pounds to and $100 plus four cents 9 15 including 4,000 pounds per pound 9 16 Over 4,000 pounds to and $150 plus five cents 9 17 including 5,000 pounds per pound 9 18 Over 5,000 pounds to and $200 plus seven cents 9 19 including 6,000 pounds per pound 9 20 Over 6,000 pounds $200 plus ten cents 9 21 per pound 9 22 b. Fines for gross weight violations for vehicles or 9 23 combinations of vehicles shall be assessed at one-half of the 9 24 fine rate schedule for axle, tandem axle, and groups of axles 9 25 weight violations. 9 26 c. Except as otherwise provided, the amount of the fine to 9 27 be assessed shall be computed on the difference between the 9 28 actual weight and the maximum legal weight specified in this 9 29 section by applying the appropriate rate in the preceding 9 30 schedule for the total amount of overload. 9 31 d. The schedule of fines may be assessed in addition to 9 32 any other penalties provided for in this chapter. 9 33 10. Overloads on axles and tandem axles and overloads on 9 34 groups of axles or on an entire vehicle or combination of 9 35 vehicles shall be considered as separate violations of the 10 1 provisions of this section. 10 2 11. A person who issues or executes, or causes to be 10 3 issued or executed, a bill of lading, manifest, or shipping 10 4 document of any kind which states a false weight of the cargo 10 5 set forth on such bill, manifest, or document, which is less 10 6 than the actual weight of the cargo, shall, upon conviction, 10 7 be guilty of a simple misdemeanor. 10 8 Sec. 6. Section 321E.7, subsection 1, Code 1997, is 10 9 amended to read as follows: 10 10 1. The gross weight on any axle of any vehicle or 10 11 combination of vehicles traveling under a permit issued in 10 12 accordance with the provisions of this chapter shall not 10 13 exceed the maximum axle load prescribed in section 321.463; 10 14 except that, cranes being temporarily moved on streets, roads, 10 15 or highways may have a gross weight of twenty-four thousand 10 16 pounds on any single axle; and construction machinery being 10 17 temporarily moved on streets, roads, or highways may have a 10 18 gross weight of thirty-six thousand pounds on any single axle 10 19 equipped with a minimum size twenty-six point five-inch by 10 20 twenty-five-inch flotation pneumatic tires and a maximum gross 10 21 weight of twenty thousand pounds on any single axle equipped 10 22 with minimum size eighteen-inch by twenty-five-inch flotation 10 23 pneumatic tires, with the department authorized to adopt rules 10 24 to permit the use of tire sizes and weights within the minimum 10 25 and maximum specifications provided in this section, provided 10 26 that the total gross weight of the vehicle or a combination of 10 27 vehicles does not exceed a maximum of one hundred twenty-six 10 28 thousand pounds; and except that a manufacturer of machinery 10 29 or equipment manufactured or assembled in Iowa may be granted 10 30 a permit for the movement of such machinery or equipment 10 31 mounted on pneumatic tires with axle loads exceeding the 10 32 maximum axle load prescribed in section 321.463 for distances 10 33 not to exceed twenty-five miles at a speed not greater than 10 34 twenty miles per hour. The movement of such machinery or 10 35 equipment shall be over a specified route between the place of 11 1 assembly or manufacture and a storage area, shipping point, 11 2 proving ground, experimental area, weighing station, or 11 3 another manufacturing plant. 11 4 Sec. 7. Section 321E.8, subsection 1, Code 1997, is 11 5 amended to read as follows: 11 6 1. Vehicles with indivisible loads having an overall width 11 7 not to exceed twelve feet five inches or mobile homes 11 8 including appurtenances not to exceed twelve feet five inches 11 9 and an overall length not to exceedseventy-fiveone hundred 11 10 feet zero inches may be moved on highways specified by the 11 11 permitting authority for unlimited distances. The vehicle and 11 12 load shall not exceed the height ofthirteen feet tenfourteen 11 13 feet zero inchesand the total gross weight as prescribed in11 14section 321.463. The gross weight on any one axle shall not 11 15 exceed the maximum prescribed in section 321.463, and the 11 16 total gross weight shall not exceed one hundred thirty-six 11 17 thousand pounds. The vehicle owner or operator shall verify 11 18 with the permitting authority prior to movement of the load 11 19 that highway conditions have not changed so as to prohibit 11 20 movement of the vehicle. Any cost to repair damage to 11 21 highways or highway structures shall be borne by the owner or 11 22 operator of the vehicle causing the damage. Permitted 11 23 vehicles exceeding a gross weight of eighty thousand pounds 11 24 shall not be permitted on any portion of the interstate 11 25 highway system. 11 26 Sec. 8. Section 321E.9, Code 1997, is amended by adding 11 27 the following new subsection: 11 28 NEW SUBSECTION. 4. Cranes, exceeding the maximum gross 11 29 weight on any axle as prescribed in section 321.463, but not 11 30 exceeding twenty-four thousand pounds, may be moved in 11 31 accordance with rules adopted pursuant to chapter 17A. 11 32 Sec. 9. Section 321E.9A, Code 1997, is amended to read as 11 33 follows: 11 34 321E.9A MULTI-TRIP PERMITS. 11 35 Subject to the discretion and judgment provided for in 12 1 section 321E.1, a multi-trip permit shall be issued for 12 2 operation of vehicles, in accordance with the following: 12 3 1. Vehicles with indivisible loads having an overall 12 4 length not to exceed one hundred twenty feet, an overall width 12 5 not to exceedelevensixteen feet, andan overallof any 12 6 heightnot to exceed fourteen feet, four inches,may be moved 12 7 on highways specified by the permitting authority, provided 12 8 the gross weight on any one axle shall not exceed the maximum 12 9 prescribed in section 321.463 and the total gross weight is 12 10 not greater than one hundred fifty-six thousand pounds. 12 112. Vehicles or combinations of vehicles consisting of12 12construction machinery not exceeding the height, length, and12 13width limitations of this section being temporarily moved on12 14highways with a maximum total gross weight limitation and a12 15single axle weight limitation in accordance with section12 16321E.7 may be moved.12 173.2. The department shall adopt rules pursuant to chapter 12 18 17A governing the issuance of permits under this section. 12 19 Sec. 10. Section 321E.14, unnumbered paragraph 1, Code 12 20 1997, is amended to read as follows: 12 21 The department or local authorities issuing permits shall 12 22 charge a fee oftwenty-fivefive hundred dollars for an annual 12 23 permit issued under section 321E.8, subsection 1, where the 12 24 total gross weight is at least eighty thousand pounds but not 12 25 more than one hundred thirty-six thousand pounds, and twenty- 12 26 five dollars for all other annual permits, a fee ofonetwo 12 27 hundred dollars for a multi-trip permit, and a fee of ten 12 28 dollars for a single-trip permit, and shall determine charges 12 29 for special permits issued pursuant to section 321E.29 by 12 30 rules adopted pursuant to chapter 17A. Fees for the movement 12 31 of buildings, parts of buildings, or unusual vehicles or loads 12 32 may be increased to cover the costs of inspections by the 12 33 issuing authority. A fee not to exceed two hundred fifty 12 34 dollars per day or a prorated fraction of that fee per person 12 35 and car for escort service may be charged when requested or 13 1 when required under this chapter. Proration of escort fees 13 2 between state and local authorities when more than one 13 3 governmental authority provides or is required to provide 13 4 escort for a movement during the period of a day shall be 13 5 determined by rule under section 321E.15. The department and 13 6 local authorities may charge a permit applicant for the cost 13 7 of trimming trees and removal and replacement of natural 13 8 obstructions or official signs and signals or other public or 13 9 private property required to be removed during the movement of 13 10 a vehicle and load. In addition to the fees provided in this 13 11 section, the annual fee for a permit for special mobile 13 12 equipment, as defined in section 321.1, subsection 75, 13 13 operated pursuant to section 321E.7, subsection 2, with a 13 14 combined gross weight up to and including eighty thousand 13 15 pounds shall be twenty-five dollars and for a combined gross 13 16 weight exceeding eighty thousand pounds, fifty dollars. 13 17 Sec. 11. EFFECTIVE DATES. The maximum gross vehicle 13 18 weight provisions in section 321.463, subsection 4, paragraph 13 19 "a", take effect for vehicles operating on the primary road 13 20 system on July 1, 1997, and take effect for vehicles operating 13 21 on the urban and secondary road system on December 31, 1998. 13 22 However, prior to December 31, 1998, routes of travel on the 13 23 urban and secondary system by vehicles weighing ninety-six 13 24 thousand pounds may be approved by local authorities. 13 25 EXPLANATION 13 26 This bill does the following: 13 27 1. Code section 321.1 is amended to define a crane as a 13 28 machine for raising, shifting, and lowering heavy weights by 13 29 means of a projecting swinging arm. 13 30 2. Code section 321.440, regarding restrictions as to tire 13 31 equipment, is amended to eliminate the requirement that the 13 32 director of transportation adopt safety standards regarding 13 33 pneumatic tires designed originally without grooves or tread. 13 34 Code section 321.440 is also amended to prohibit vehicles from 13 35 operating with tire weights per inch of tire that are greater 14 1 than 575 pounds per inch on a nonsteering axle and 600 pounds 14 2 per inch on a steering axle based on the tire width rating. 14 3 3. Code section 321.456, regarding height of vehicles, is 14 4 amended to provide that vehicles used solely for the hauling 14 5 of automobiles, light trucks, and recreational vehicle chassis 14 6 are exempt from the need to get a permit if the load vehicle 14 7 is 14 feet tall or under. 14 8 Code section 321.463 is amended to state the maximum 14 9 allowable vehicle weights for interstate and noninterstate 14 10 highways in chart form. The maximum weight is also increased 14 11 to 96,000 pounds for vehicles on the interstate system. 14 12 4. Code section 321E.7, regarding load limits per axle of 14 13 excessive size and weight vehicles, is amended to provide that 14 14 cranes may temporarily be moved on streets, roads, or highways 14 15 with gross weights per axle of up to 24,000 pounds. 14 16 5. Code section 321E.8, regarding annual permits, is 14 17 amended to provide that vehicles with loads not more than 12 14 18 feet five inches in width and not greater than 100 feet in 14 19 length may be moved on highways specified by the permitting 14 20 authority, provided that the vehicle owner or operator 14 21 verifies to the permitting authority before moving the load 14 22 that road conditions have not changed so as to prohibit the 14 23 load from being moved. The vehicle owner or operator is also 14 24 liable for damages done to highways or highway structures from 14 25 the load. Section 321E.8 is also amended to prohibit these 14 26 vehicles from traveling on the interstate highway system if 14 27 the vehicle exceeds 80,000 pounds gross weight. 14 28 6. Code section 321E.9 is amended to provide that cranes 14 29 exceeding the maximum gross axle weight allowed in section 14 30 321.463 but not exceeding 24,000 pounds in axle weight may be 14 31 moved under a single-trip permit in accordance with rules 14 32 adopted by the department. 14 33 7. Code section 321E.9A is amended to provide that 14 34 vehicles not more than 120 feet in length and 16 feet in width 14 35 may be moved on highways designated by the permitting 15 1 authority under a multi-trip permit provided that the total 15 2 vehicle gross weight is not more than 156,000 pounds. 15 3 Subsection 2 of that Code section is stricken. Current size 15 4 limitations are 11 feet in width, 120 feet in length, and 14 15 5 feet four inches in height, and the weight limitation is 15 6 determined under section 321E.7. 15 7 8. Code section 321E.14 is amended to increase the annual 15 8 permit fee for vehicles with gross weights between 80,000 and 15 9 136,000 pounds from $25 to $500. The fee for all other annual 15 10 permits remains at $25. The fee for a multi-trip permit is 15 11 increased from $100 to $200. 15 12 The increase, to 96,000 pounds, in maximum gross weight for 15 13 vehicles on the primary road system takes effect July 1, 1997, 15 14 and takes effect for the urban and secondary road system on 15 15 December 31, 1998. Prior to that date, local authorities may 15 16 approve routes of travel for 96,000-pound vehicles on urban 15 17 and secondary roads. 15 18 LSB 1340DP 77 15 19 mk/sc/14.1
