  1  1    Section 1.  Section 478.1, unnumbered paragraph 2, Code
  1  2 1997, is amended to read as follows:
  1  3    If the transmission line, wire, or cable is capable of
  1  4 operating only at an electric voltage of less than thirty-four
  1  5 and one-half kilovolts, no franchise is required.  However,
  1  6 the utilities board shall retain jurisdiction over all such
  1  7 lines, wires, or cables and shall prescribe the contents of a
  1  8 written notice and map to be timely provided to the board and
  1  9 affected parties including owners of electric supply lines
  1 10 located within six-tenths of one mile of proposed construction
  1 11 of such lines, wires or cables.  A person who seeks to
  1 12 construct, erect, maintain or operate a transmission line,
  1 13 wire, or cable which will operate at an electric voltage of
  1 14 less than thirty-four and one-half kilovolts outside of cities
  1 15 and which cannot secure the necessary voluntary easements to
  1 16 do so may petition the board pursuant to section 478.3,
  1 17 subsection 1, for a franchise granting authority for such
  1 18 construction, erection, maintenance, or operation, and for the
  1 19 use of the right of eminent domain.  
  1 20                           EXPLANATION
  1 21    This bill strikes the language directing the utilities
  1 22 board to prescribe the contents of a written notice and map to
  1 23 be filed with the board and certain other individuals
  1 24 regarding the location of construction of a proposed electric
  1 25 transmission line, wire, or cable.  This requirement currently
  1 26 applies to a transmission line, wire, or cable which is
  1 27 capable of operating only at an electric voltage of less than
  1 28 34.5 kilovolts.  Under the bill, this notice and map would no
  1 29 longer be filed with the board.
