1 1 Section 1. Section 455B.310, subsection 3, Code 1997, is
1 2 amended to read as follows:
1 3 3. Solid waste disposal facilities with special provisions
1 4 which limit the site to disposal of construction and
1 5 demolition waste, landscape waste, coal combustion waste,
1 6 foundry sand, and solid waste materials approved by the
1 7 department for lining or capping, or for construction berms,
1 8 dikes, or roads in a sanitary disposal project or sanitary
1 9 landfill, and solid waste disposal facilities with outstanding
1 10 public debt incurred prior to January 1, 1998, to construct a
1 11 solid waste disposal project to comply with section 455B.302
1 12 are exempt from the tonnage fees imposed under this section.
1 13 However, solid waste disposal facilities under this subsection
1 14 are subject to the fees imposed pursuant to section 455B.105,
1 15 subsection 11, paragraph "a". A solid waste disposal facility
1 16 with outstanding public debt shall use all tonnage fees
1 17 exempted under this section to satisfy the public debt.
1 18 Notwithstanding the provisions of section 455B.105, subsection
1 19 11, paragraph "b", the fees collected pursuant to this
1 20 subsection shall be used by the department for the regulation
1 21 of these solid waste disposal facilities.
1 22 EXPLANATION
1 23 This bill provides that solid waste disposal facilities
1 24 with outstanding public debt incurred prior to January 1,
1 25 1998, to construct a solid waste disposal project to comply
1 26 with Code section 455B.302, which requires sanitary disposal
1 27 projects for the final disposal of solid waste, are exempt
1 28 from the tonnage fees imposed pursuant to Code section
1 29 455B.310. The bill requires that the exempted tonnage fees be
1 30 used to satisfy the public debt.
