1 1 Section 1. Section 708.3A, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. An assault against a peace officer in
1 4 subsections 1, 2, 3, and 4 includes an assault against a peace
1 5 officer who, at the time of the assault, is off-duty and
1 6 providing private duty security while carrying the peace
1 7 officer's badge or wearing the peace officer's official
1 8 uniform, provided that the peace officer has secured the prior
1 9 approval of the agency or political subdivision in which the
1 10 person is regularly employed to engage in the activity.
1 11 EXPLANATION
1 12 This bill provides that an assault against a peace officer
1 13 includes an assault against a peace officer who, at the time
1 14 of the assault, is off-duty and providing private duty
1 15 security while carrying the peace officer's badge or wearing
1 16 the peace officer's official uniform, provided that the peace
1 17 officer has secured the prior approval of the agency or
1 18 political subdivision in which the person is regularly
1 19 employed to engage in the activity.
