1 1 Section 1. Section 239B.3, subsection 2, Code Supplement
1 2 1997, is amended to read as follows:
1 3 2. For an applicant or participant family, the department
1 4 shall calculate and pay the cash assistance grant on a monthly
1 5 basis, taking into consideration all of the following:
1 6 a. The income and resources of the family.
1 7 b. Whether the family has entered into a limited benefit
1 8 plan.
1 9 c. The size of the family.
1 10 d. Available funding.
1 11 e. Whether the department is paying for the family's
1 12 housing as provided in this section.
1 13 Sec. 2. Section 239B.3, Code Supplement 1997, is amended
1 14 by adding the following new subsection:
1 15 NEW SUBSECTION. 5. Upon request of an applicant or
1 16 participant family or a landlord or other provider of housing
1 17 to an applicant or participant family, the department may make
1 18 the family's housing payments directly to the landlord or
1 19 other provider of housing. The department shall reduce the
1 20 amount of the applicant or participant family's cash
1 21 assistance grant in an amount equal to the housing payment
1 22 made by the department. The department shall adopt rules
1 23 establishing simple procedures for persons making the requests
1 24 and for making the payments.
1 25 EXPLANATION
1 26 This bill authorizes the department of human services to
1 27 pay housing costs to the provider directly on behalf of an
1 28 applicant or participant family in the family investment
1 29 program.
1 30 Code section 239B.3, relating to cash assistance under the
1 31 program, is amended. The amendment would allow the department
1 32 to take into consideration any housing payments made when
1 33 calculating and making cash assistance payments.
1 34 A new subsection is added to Code section 239B.3
1 35 authorizing the housing payments. The department may make the
2 1 housing payments upon receiving a request from an applicant or
2 2 participant family in the program or from a landlord or other
2 3 provider of housing to applicants or participants in the
2 4 program. The department is directed to reduce the amount of
2 5 the applicant or participant family's cash assistance in an
2 6 amount equal to the housing payment.
2 7 The department is to adopt rules establishing simple
2 8 procedures for persons making the requests and for making the
2 9 payments.
