PAG LIN 1 1 Section 1. Section 282.31, subsection 1, Code 1997, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. c. Notwithstanding paragraph "a", for 1 4 purposes of juvenile detention home educational program 1 5 services provided by an area education agency pursuant to 1 6 section 282.30, subsection 1, paragraph "a", the deductions 1 7 made from state foundation aid pursuant to paragraph "a" shall 1 8 be made solely from the state foundation aid attributable to 1 9 the portion of weighted enrollment that is additional 1 10 enrollment because of special education determined pursuant to 1 11 section 257.6, subsection 3. The portion that shall be 1 12 deducted for a particular school district shall correspond to 1 13 the ratio that the additional weighted enrollment because of 1 14 special education for the school district bears to the total 1 15 additional weighted enrollment because of special education 1 16 for all school districts in the state for the budget year in 1 17 which the deduction is made. 1 18 Sec. 2. This Act applies to school years beginning on or 1 19 after July 1, 1999. 1 20 EXPLANATION 1 21 This bill provides for a change in the manner in which 1 22 amounts transferred by the department of revenue and finance 1 23 to an area education agency for educational services provided 1 24 to a child living in a juvenile detention facility, as defined 1 25 in Code section 232.2, subsection 32, are deducted in the 1 26 subsequent fiscal year from the state foundation aid paid to a 1 27 school district. Code section 282.31, subsection 1, paragraph 1 28 "a", currently provides that the department of revenue and 1 29 finance shall pay the approved budget amount for juvenile 1 30 detention facility education services provided by an area 1 31 education agency to the agency from the moneys appropriated 1 32 under Code section 257.16 for foundation aid and supplementary 1 33 aid. The amounts paid shall be deducted from the state 1 34 foundation aid paid under Code section 257.16 to all school 1 35 districts in the state during the subsequent fiscal year, in 2 1 the ratio that the budget enrollment for the budget year for a 2 2 school district bears to the total budget enrollment in the 2 3 state for that budget year. The bill provides that the amount 2 4 deducted shall be deducted solely from the state foundation 2 5 aid paid under Code section 257.16 which is attributable to 2 6 the portion of weighted enrollment that is additional 2 7 enrollment because of special education. The bill provides 2 8 that the amount deducted for a particular school district 2 9 shall be in the ratio that the additional weighted enrollment 2 10 for special education for the district bears to the total 2 11 additional weighted enrollment for special education for all 2 12 school districts in the state. 2 13 The bill applies to school years beginning on or after July 2 14 1, 1999. 2 15 LSB 4023HH 77 2 16 rn/jw/5
