  1  1    Section 1.  Section 260C.15, subsection 1, Code 1997, is
  1  2 amended to read as follows:
  1  3    1.  Regular elections held annually by the merged area for
  1  4 the election of members of the board of directors as required
  1  5 by section 260C.11, for the renewal of the twenty and one-
  1  6 fourth forty and one-half cents per thousand dollars of
  1  7 assessed valuation levy authorized in section 260C.22, or for
  1  8 any other matter authorized by law and designated for election
  1  9 by the board of directors of the merged area, shall be held on
  1 10 the date of the school election as fixed by section 277.1.
  1 11 The election notice shall be made a part of the local school
  1 12 election notice published as provided in section 49.53 in each
  1 13 local school district where voting is to occur in the merged
  1 14 area election and the election shall be conducted by the
  1 15 county commissioner of elections pursuant to chapters 39 to 53
  1 16 and section 277.20.
  1 17    Sec. 2.  Section 260C.22, subsection 1, paragraph a, Code
  1 18 1997, is amended to read as follows:
  1 19    a.  (1)  In addition to the tax authorized under section
  1 20 260C.17, the voters in any merged area may at the annual
  1 21 school election vote a tax not exceeding twenty and one-fourth
  1 22 forty and one-half cents per thousand dollars of assessed
  1 23 value in any one year for a period not to exceed ten years for
  1 24 the purchase of grounds, construction of buildings, payment of
  1 25 debts contracted for the construction of buildings, purchase
  1 26 of buildings and equipment for buildings, and the acquisition
  1 27 of libraries, for the purpose of paying costs of utilities,
  1 28 and for the purpose of maintaining, remodeling, improving, or
  1 29 expanding the community college of the merged area.  If the
  1 30 tax levy is approved under this section, the costs of
  1 31 utilities shall be paid from the proceeds of the levy.  The
  1 32 tax shall be collected by the county treasurers and remitted
  1 33 to the treasurer of the merged area as provided in section
  1 34 331.552, subsection 29.  The proceeds of the tax shall be
  1 35 deposited in a separate and distinct fund to be known as the
  2  1 voted tax fund, to be paid out upon warrants drawn by the
  2  2 president and secretary of the board of directors of the
  2  3 merged area district for the payment of costs incurred in
  2  4 providing the school facilities for which the tax was voted.
  2  5    (2)  If the voters in a merged area have authorized a tax
  2  6 not exceeding twenty and one-fourth cents per thousand dollars
  2  7 of assessed valuation prior to July 1, 1998, pursuant to
  2  8 subparagraph (1), the levy shall continue for the period
  2  9 authorized, and the maximum levy that can be authorized by the
  2 10 voters on or after July 1, 1998, under this paragraph, is an
  2 11 additional twenty and one-fourth cents per thousand dollars of
  2 12 assessed valuation to coincide with the period for which the
  2 13 initial levy was approved.  
  2 14                           EXPLANATION
  2 15    This bill increases the maximum community college
  2 16 facilities levy, which the voters of the merged area may
  2 17 impose, from 21.25 cents per $1,000 of assessed value to 40.50
  2 18 cents per $1,000 of assessed value.  It provides for
  2 19 continuation of levies previously approved.
