  1  4 TO AMEND THE CRIME OF BURGLARY IN THE FIRST DEGREE TO INCLUDE
  1  5    COMMISSION OF SEXUAL ABUSE AS A POSSIBLE ELEMENT OF THE
  1  6    OFFENSE.
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  9 
  1 10    Section 1.  Section 713.3, Code 1997, is amended to read as
  1 11 follows:
  1 12    713.3  BURGLARY IN THE FIRST DEGREE.
  1 13    1.  A person commits burglary in the first degree if, while
  1 14 perpetrating a burglary in or upon an occupied structure in
  1 15 which one or more persons are present, the any of the
  1 16 following circumstances apply:
  1 17    a.  The person has possession of an explosive or incendiary
  1 18 device or material, or.
  1 19    b.  The person has possession of a dangerous weapon, or.
  1 20    c.  The person intentionally or recklessly inflicts bodily
  1 21 injury on any person.
  1 22    d.  The person performs or participates in a sex act with
  1 23 any person which would constitute sexual abuse under section
  1 24 709.1.
  1 25    2.  Burglary in the first degree is a class "B" felony.
