  1  4 APPROPRIATING FEDERAL FUNDS MADE AVAILABLE FROM FEDERAL
  1  5    BLOCK GRANTS AND OTHER FEDERAL GRANTS, ALLOCATING
  1  6    PORTIONS OF FEDERAL BLOCK GRANTS, AND PROVIDING
  1  7    PROCEDURES IF FEDERAL FUNDS ARE MORE OR LESS THAN
  1  8    ANTICIPATED OR IF FEDERAL BLOCK GRANTS ARE MORE OR
  1  9    LESS THAN ANTICIPATED.
  1 10 
  1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 12 
  1 13    Section 1.  SUBSTANCE ABUSE APPROPRIATION.
  1 14    1.  There is appropriated from the fund created by section
  1 15 8.41 to the Iowa department of public health for the federal
  1 16 fiscal year beginning October 1, 1998, and ending September
  1 17 30, 1999, the following amount:  
  1 18 .................................................. $ 11,945,086
  1 19    a.  Funds appropriated in this subsection are the
  1 20 anticipated funds to be received from the federal government
  1 21 for the designated federal fiscal year under 42 U.S.C.,
  1 22 chapter 6A, subchapter XVII, which provides for the substance
  1 23 abuse prevention and treatment block grant.  The department
  1 24 shall expend the funds appropriated in this subsection as
  1 25 provided in the federal law making the funds available and in
  1 26 conformance with chapter 17A.
  1 27    b.  Of the funds appropriated in this subsection, an amount
  1 28 not exceeding 5 percent shall be used by the department for
  1 29 administrative expenses.
  1 30    c.  The department shall expend no less than an amount
  1 31 equal to the amount expended for treatment services in state
  1 32 fiscal year beginning July 1, 1997, for pregnant women and
  1 33 women with dependent children.
  1 34    d.  Of the funds appropriated in this subsection, an amount
  1 35 not exceeding $24,585 shall be used for audits.
  2  1    e.  Of the funds appropriated in this subsection, an amount
  2  2 not exceeding $461,342 shall be used for current and former
  2  3 recipients of federal supplemental security income (SSI).
  2  4    2.  The funds remaining from the appropriation made in
  2  5 subsection 1 shall be allocated as follows:
  2  6    a.  At least 20 percent of the allocation shall be for
  2  7 prevention programs.
  2  8    b.  At least 35 percent of the allocation shall be spent on
  2  9 drug treatment and prevention activities.
  2 10    c.  At least 35 percent of the allocation shall be spent on
  2 11 alcohol treatment and prevention activities.
  2 12    3.  The substance abuse block grant funds received from the
  2 13 federal government in excess of the amount of the anticipated
  2 14 federal fiscal year 1998-1999 award appropriated in subsection
  2 15 1 shall be distributed at least 50 percent to treatment
  2 16 programs and 50 percent to prevention programs except that,
  2 17 based upon federal guidelines, the total amount of the excess
  2 18 awarded to prevention programs shall not exceed $1,000,000.
  2 19    Sec. 2.  COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
  2 20    1.  a.  There is appropriated from the fund created by
  2 21 section 8.41 to the Iowa department of human services for the
  2 22 federal fiscal year beginning October 1, 1998, and ending
  2 23 September 30, 1999, the following amount:  
  2 24 .................................................. $  2,740,750
  2 25    b.  Funds appropriated in this subsection are the
  2 26 anticipated funds to be received from the federal government
  2 27 for the designated federal fiscal year under 42 U.S.C.,
  2 28 chapter 6A, subchapter XVII, which provides for the community
  2 29 mental health services block grant.  The department shall
  2 30 expend the funds appropriated in this subsection as provided
  2 31 in the federal law making the funds available and in
  2 32 conformance with chapter 17A.
  2 33    c.  The administrator of the division of mental health and
  2 34 developmental disabilities shall allocate not less than 95
  2 35 percent of the amount of the block grant to eligible community
  3  1 mental health services providers for carrying out the plan
  3  2 submitted to and approved by the federal substance abuse and
  3  3 mental health services administration for the fiscal year
  3  4 involved.
  3  5    2.  An amount not exceeding 5 percent of the funds
  3  6 appropriated in subsection 1 shall be used by the department
  3  7 of human services for administrative expenses.  From the funds
  3  8 set aside by this subsection for administrative expenses, the
  3  9 division of mental health and developmental disabilities shall
  3 10 pay to the auditor of state an amount sufficient to pay the
  3 11 cost of auditing the use and administration of the state's
  3 12 portion of the funds appropriated in subsection 1.  The
  3 13 auditor of state shall bill the division of mental health and
  3 14 developmental disabilities for the costs of the audits.
  3 15    Sec. 3.  MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
  3 16    1.  There is appropriated from the fund created by section
  3 17 8.41 to the Iowa department of public health for the federal
  3 18 fiscal year beginning October 1, 1998, and ending September
  3 19 30, 1999, the following amount:  
  3 20 .................................................. $  6,888,880
  3 21    The funds appropriated in this subsection are the funds
  3 22 anticipated to be received from the federal government for the
  3 23 designated federal fiscal year under 42 U.S.C., chapter 7,
  3 24 subchapter V, which provides for the maternal and child health
  3 25 services block grant.  The department shall expend the funds
  3 26 appropriated in this subsection as provided in the federal law
  3 27 making the funds available and in conformance with chapter
  3 28 17A.
  3 29    Of the funds appropriated in this subsection, an amount not
  3 30 exceeding $45,700 shall be used for audits.
  3 31    Funds appropriated in this subsection shall not be used by
  3 32 the university of Iowa hospitals and clinics for indirect
  3 33 costs.
  3 34    2.  An amount not exceeding $150,000 of the funds
  3 35 appropriated in subsection 1 to the Iowa department of public
  4  1 health shall be used by the Iowa department of public health
  4  2 for administrative expenses in addition to the amount to be
  4  3 used for audits in subsection 1.
  4  4    The departments of public health, human services, and
  4  5 education and the university of Iowa's mobile and regional
  4  6 child health specialty clinics shall continue to pursue to the
  4  7 maximum extent feasible the coordination and integration of
  4  8 services to women and children.
  4  9    3.  a.  Sixty-three percent of the remaining funds
  4 10 appropriated in subsection 1 shall be allocated to supplement
  4 11 appropriations for maternal and child health programs within
  4 12 the Iowa department of public health.  Of these funds,
  4 13 $284,548 shall be set aside for the statewide perinatal care
  4 14 program.
  4 15    b.  Thirty-seven percent of the remaining funds
  4 16 appropriated in subsection 1 shall be allocated to the
  4 17 university of Iowa hospitals and clinics under the control of
  4 18 the state board of regents for mobile and regional child
  4 19 health specialty clinics.  The university of Iowa hospitals
  4 20 and clinics shall not receive an allocation for indirect costs
  4 21 from the funds for this program.  Priority shall be given to
  4 22 establishment and maintenance of a statewide system of mobile
  4 23 and regional child health specialty clinics.
  4 24    4.  The Iowa department of public health shall administer
  4 25 the statewide maternal and child health program and the
  4 26 crippled children's program by conducting mobile and regional
  4 27 child health specialty clinics and conducting other activities
  4 28 to improve the health of low-income women and children and to
  4 29 promote the welfare of children with actual or potential
  4 30 handicapping conditions and chronic illnesses in accordance
  4 31 with the requirements of Title V of the federal Social
  4 32 Security Act.
  4 33    Sec. 4.  PREVENTIVE HEALTH AND HEALTH SERVICES
  4 34 APPROPRIATIONS.
  4 35    1.  There is appropriated from the fund created by section
  5  1 8.41 to the Iowa department of public health for the federal
  5  2 fiscal year beginning October 1, 1998, and ending September
  5  3 30, 1999, the following amount:  
  5  4 .................................................. $  2,103,338
  5  5    Funds appropriated in this subsection are the funds
  5  6 anticipated to be received from the federal government for the
  5  7 designated federal fiscal year under 42 U.S.C., chapter 6A,
  5  8 subchapter XVII, which provides for the preventive health and
  5  9 health services block grant.  The department shall expend the
  5 10 funds appropriated in this subsection as provided in the
  5 11 federal law making the funds available and in conformance with
  5 12 chapter 17A.
  5 13    Of the funds appropriated in this subsection, an amount not
  5 14 exceeding $5,522 shall be used for audits.
  5 15    2.  Of the funds appropriated in subsection 1, the specific
  5 16 amount of funds stipulated by the notice of block grant award
  5 17 shall be allocated for services to victims of sex offenses and
  5 18 for rape prevention education.
  5 19    3.  An amount not exceeding $94,670 of the remaining funds
  5 20 appropriated in subsections 1 and 2 shall be used by the Iowa
  5 21 department of public health for administrative expenses in
  5 22 addition to the amount to be used for audits in subsection 1.
  5 23    4.  After deducting the funds allocated in subsections 1,
  5 24 2, and 3, the remaining funds appropriated in subsection 1
  5 25 shall be used by the department for healthy people
  5 26 2000/healthy Iowans 2000 program objectives, preventive health
  5 27 advisory committee, and risk reduction services, including
  5 28 nutrition programs, health incentive programs, chronic disease
  5 29 services, emergency medical services, monitoring of the
  5 30 fluoridation program and start-up fluoridation grants, and
  5 31 acquired immune deficiency syndrome services.  The moneys
  5 32 specified in this subsection shall not be used by the
  5 33 university of Iowa hospitals and clinics or by the state
  5 34 hygienic laboratory for the funding of indirect costs.  Of the
  5 35 funds used by the department under this subsection, an amount
  6  1 not exceeding $90,000 shall be used for the monitoring of the
  6  2 fluoridation program and for start-up fluoridation grants to
  6  3 public water systems, and at least $50,000 shall be used to
  6  4 provide chlamydia testing.
  6  5    Sec. 5.  DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
  6  6 APPROPRIATION.
  6  7    1.  There is appropriated from the fund created in section
  6  8 8.41 to the office of the governor for the drug enforcement
  6  9 and abuse prevention coordinator for the federal fiscal year
  6 10 beginning October 1, 1998, and ending September 30, 1999, the
  6 11 following amount:  
  6 12 .................................................. $  5,806,000
  6 13    Funds appropriated in this subsection are the anticipated
  6 14 funds to be received from the federal government for the
  6 15 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  6 16 V, which provides for the drug control and system improvement
  6 17 grant program.  The drug enforcement and abuse prevention
  6 18 coordinator shall expend the funds appropriated in this
  6 19 subsection as provided in the federal law making the funds
  6 20 available and in conformance with chapter 17A.
  6 21    2.  An amount not exceeding 7 percent of the funds
  6 22 appropriated in subsection 1 shall be used by the drug
  6 23 enforcement and abuse prevention coordinator for
  6 24 administrative expenses.  From the funds set aside by this
  6 25 subsection for administrative expenses, the drug enforcement
  6 26 and abuse prevention coordinator shall pay to the auditor of
  6 27 state an amount sufficient to pay the cost of auditing the use
  6 28 and administration of the state's portion of the funds
  6 29 appropriated in subsection 1.
  6 30    Sec. 6.  STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
  6 31 APPROPRIATION.
  6 32    1.  There is appropriated from the fund created in section
  6 33 8.41 to the office of the governor for the drug enforcement
  6 34 and abuse prevention coordinator for the federal fiscal year
  6 35 beginning October 1, 1998, and ending September 30, 1999, the
  7  1 following amount:  
  7  2 .................................................. $  1,619,000
  7  3    Funds appropriated in this subsection are the anticipated
  7  4 funds to be received from the federal government for the
  7  5 designated fiscal year under 42 U.S.C., chapter 46, subchapter
  7  6 XII-H, which provides for grants to combat violent crimes
  7  7 against women.  The drug enforcement and abuse prevention
  7  8 coordinator shall expend the funds appropriated in this
  7  9 subsection as provided in the federal law making the funds
  7 10 available and in conformance with chapter 17A.
  7 11    2.  An amount not exceeding 5 percent of the funds
  7 12 appropriated in subsection 1 shall be used by the drug
  7 13 enforcement and abuse prevention coordinator for
  7 14 administrative expenses.  From the funds set aside by this
  7 15 subsection for administrative expenses, the drug enforcement
  7 16 and abuse prevention coordinator shall pay to the auditor of
  7 17 the state an amount sufficient to pay the cost of auditing the
  7 18 use and administration of the state's portion of the funds
  7 19 appropriated in subsection 1.
  7 20    Sec. 7.  LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
  7 21    1.  There is appropriated from the fund created in section
  7 22 8.41 to the office of the governor for the drug enforcement
  7 23 and abuse prevention coordinator for the federal fiscal year
  7 24 beginning October 1, 1998, and ending September 30, 1999, the
  7 25 following amount:  
  7 26 .................................................. $    382,106
  7 27    Funds appropriated in this subsection are the funds
  7 28 anticipated to be received from the federal government for the
  7 29 designated federal fiscal year under the federal Omnibus
  7 30 Consolidated Recissions and Appropriations Act of 1997, Pub.
  7 31 L. No. 104-134, which provides for grants to reduce crime and
  7 32 improve public safety.  The drug enforcement and abuse
  7 33 prevention coordinator shall expend the funds appropriated in
  7 34 this subsection as provided in the federal law making the
  7 35 funds available and in conformance with chapter 17A.
  8  1    2.  An amount not exceeding 3 percent of the funds
  8  2 appropriated in subsection 1 shall be used by the drug
  8  3 enforcement and abuse prevention coordinator for
  8  4 administrative expenses.  From the funds set aside by this
  8  5 subsection for administrative expenses, the drug enforcement
  8  6 and abuse prevention coordinator shall pay to the auditor of
  8  7 state an amount sufficient to pay the cost of auditing the use
  8  8 and administration of the state's portion of the funds
  8  9 appropriated in subsection 1.
  8 10    Sec. 8.  RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
  8 11 PRISONERS FORMULA GRANT PROGRAM.  There is appropriated from
  8 12 the fund created in section 8.41 to the office of the governor
  8 13 for the drug enforcement and abuse prevention coordinator for
  8 14 the federal fiscal year beginning October 1, 1998, and ending
  8 15 September 30, 1999, the following amount:  
  8 16 .................................................. $    236,738
  8 17    Funds appropriated in this subsection are the funds
  8 18 anticipated to be received from the federal government for the
  8 19 designated federal fiscal year under 42 U.S.C., chapter 136,
  8 20 which provides grants for substance abuse treatment programs
  8 21 in state and local correctional facilities.  The drug
  8 22 enforcement and abuse prevention coordinator shall expend the
  8 23 funds appropriated in this subsection as provided in the
  8 24 federal law making the funds available and in conformance with
  8 25 chapter 17A.
  8 26    Sec. 9.  COMMUNITY SERVICES APPROPRIATIONS.
  8 27    1.  a.  There is appropriated from the fund created by
  8 28 section 8.41 to the division of community action agencies of
  8 29 the department of human rights for the federal fiscal year
  8 30 beginning October 1, 1998, and ending September 30, 1999, the
  8 31 following amount:  
  8 32 .................................................. $  5,307,702
  8 33    Funds appropriated in this subsection are the funds
  8 34 anticipated to be received from the federal government for the
  8 35 designated federal fiscal year under 42 U.S.C., chapter 106,
  9  1 which provides for the community services block grant.  The
  9  2 division of community action agencies of the department of
  9  3 human rights shall expend the funds appropriated in this
  9  4 subsection as provided in the federal law making the funds
  9  5 available and in conformance with chapter 17A.
  9  6    b.  The administrator of the division of community action
  9  7 agencies of the department of human rights shall allocate not
  9  8 less than 96 percent of the amount of the block grant to
  9  9 eligible community action agencies for programs benefiting
  9 10 low-income persons.  Each eligible agency shall receive a
  9 11 minimum allocation of not less than $100,000.  The minimum
  9 12 allocation shall be achieved by redistributing increased funds
  9 13 from agencies experiencing a greater share of available funds.
  9 14 The funds shall be distributed on the basis of the poverty-
  9 15 level population in the area represented by the community
  9 16 action areas compared to the size of the poverty-level
  9 17 population in the state.
  9 18    2.  An amount not exceeding 4 percent of the funds
  9 19 appropriated in subsection 1 shall be used by the division of
  9 20 community action agencies of the department of human rights
  9 21 for administrative expenses.  From the funds set aside by this
  9 22 subsection for administrative expenses, the division of
  9 23 community action agencies of the department of human rights
  9 24 shall pay to the auditor of state an amount sufficient to pay
  9 25 the cost of auditing the use and administration of the state's
  9 26 portion of the funds appropriated in subsection 1.  The
  9 27 auditor of state shall bill the division of community action
  9 28 agencies for the costs of the audits.
  9 29    Sec. 10.  COMMUNITY DEVELOPMENT APPROPRIATIONS.
  9 30    1.  There is appropriated from the fund created by section
  9 31 8.41 to the department of economic development for the federal
  9 32 fiscal year beginning October 1, 1998, and ending September
  9 33 30, 1999, the following amount:  
  9 34 .................................................. $ 30,400,000
  9 35    Funds appropriated in this subsection are the funds
 10  1 anticipated to be received from the federal government for the
 10  2 designated federal fiscal year under 42 U.S.C., chapter 69,
 10  3 which provides for community development block grants.  The
 10  4 department of economic development shall expend the funds
 10  5 appropriated in this subsection as provided in the federal law
 10  6 making the funds available and in conformance with chapter
 10  7 17A.
 10  8    2.  An amount not exceeding $1,414,000 for the federal
 10  9 fiscal year beginning October 1, 1998, shall be used by the
 10 10 department of economic development for administrative expenses
 10 11 for the community development block grant.  The total amount
 10 12 used for administrative expenses includes $707,000 for the
 10 13 federal fiscal year beginning October 1, 1998, of funds
 10 14 appropriated in subsection 1 and a matching contribution from
 10 15 the state equal to $707,000 from the appropriation of state
 10 16 funds for the community development block grant and state
 10 17 appropriations for related activities of the department of
 10 18 economic development.  From the funds set aside for
 10 19 administrative expenses by this subsection, the department of
 10 20 economic development shall pay to the auditor of state an
 10 21 amount sufficient to pay the cost of auditing the use and
 10 22 administration of the state's portion of the funds
 10 23 appropriated in subsection 1.  The auditor of state shall bill
 10 24 the department for the costs of the audit.
 10 25    Sec. 11.  LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
 10 26    1.  There is appropriated from the fund created by section
 10 27 8.41 to the division of community action agencies of the
 10 28 department of human rights for the federal fiscal year
 10 29 beginning October 1, 1998, and ending September 30, 1999, the
 10 30 following amount:  
 10 31 .................................................. $ 18,143,877
 10 32    The funds appropriated in this subsection are the funds
 10 33 anticipated to be received from the federal government for the
 10 34 designated federal fiscal year under 42 U.S.C., chapter 94,
 10 35 subchapter II, which provides for the low-income home energy
 11  1 assistance block grants.  The division of community action
 11  2 agencies of the department of human rights shall expend the
 11  3 funds appropriated in this subsection as provided in the
 11  4 federal law making the funds available and in conformance with
 11  5 chapter 17A.
 11  6    2.  An amount not exceeding $1,542,229 or 10 percent of the
 11  7 funds appropriated in subsection 1, whichever is less, may be
 11  8 used for administrative expenses for the low-income home
 11  9 energy assistance program.  Not more than $290,000 shall be
 11 10 used for administrative expenses of the division of community
 11 11 action agencies of the department of human rights.  From the
 11 12 total funds set aside in this subsection for administrative
 11 13 expenses for the low-income home energy assistance program, an
 11 14 amount sufficient to pay the cost of an audit of the use and
 11 15 administration of the state's portion of the funds
 11 16 appropriated is allocated for that purpose.  The auditor of
 11 17 state shall bill the division of community action agencies for
 11 18 the costs of the audits.
 11 19    3.  The remaining funds appropriated in subsection 1 shall
 11 20 be allocated to help eligible households, as defined under 42
 11 21 U.S.C., chapter 94, subchapter II, to meet the costs of home
 11 22 energy.  After reserving a reasonable portion of the remaining
 11 23 funds not to exceed 10 percent of the funds appropriated in
 11 24 subsection 1, to carry forward into the federal fiscal year
 11 25 beginning October 1, 1999, at least 15 percent of the funds
 11 26 appropriated in subsection 1 shall be used for low-income
 11 27 residential weatherization or other related home repairs for
 11 28 low-income households.  Of this amount, an amount not
 11 29 exceeding 10 percent may be used for administrative expenses.
 11 30    4.  An eligible household must be willing to allow
 11 31 residential weatherization or other related home repairs in
 11 32 order to receive home energy assistance.  If the eligible
 11 33 household resides in rental property, the unwillingness of the
 11 34 landlord to allow residential weatherization or other related
 11 35 home repairs shall not prevent the household from receiving
 12  1 home energy assistance.
 12  2    5.  Not more than 5 percent of the funds appropriated in
 12  3 subsection 1 shall be used for assessment and resolution of
 12  4 energy problems.
 12  5    Sec. 12.  SOCIAL SERVICES APPROPRIATIONS.
 12  6    1.  There is appropriated from the fund created by section
 12  7 8.41 to the department of human services for the federal
 12  8 fiscal year beginning October 1, 1998, and ending September
 12  9 30, 1999, the following amount:  
 12 10 .................................................. $ 24,727,375
 12 11    Funds appropriated in this subsection are the funds
 12 12 anticipated to be received from the federal government for the
 12 13 designated federal fiscal year under 42 U.S.C., chapter 7,
 12 14 subchapter XX, which provides for the social services block
 12 15 grant.  The department of human services shall expend the
 12 16 funds appropriated in this subsection as provided in the
 12 17 federal law making the funds available and in conformance with
 12 18 chapter 17A.
 12 19    2.  Not more than $1,572,354 of the funds appropriated in
 12 20 subsection 1 shall be used by the department of human services
 12 21 for general administration.  From the funds set aside in this
 12 22 subsection for general administration, the department of human
 12 23 services shall pay to the auditor of state an amount
 12 24 sufficient to pay the cost of auditing the use and
 12 25 administration of the state's portion of the funds
 12 26 appropriated in subsection 1.
 12 27    3.  In addition to the allocation for general
 12 28 administration in subsection 2, the remaining funds
 12 29 appropriated in subsection 1 shall be allocated in the
 12 30 following amounts to supplement appropriations for the federal
 12 31 fiscal year beginning October 1, 1998, for the following
 12 32 programs within the department of human services:
 12 33    a.  Field operations:  
 12 34 .................................................. $  9,404,423
 12 35    b.  Child and family services:
 13  1 .................................................. $  1,406,640
 13  2    c.  Local administrative costs
 13  3 and other local services:
 13  4 .................................................. $    997,367
 13  5    d.  Volunteers:

 13  7    e.  Community-based services:

 13  9    f.  MH/MR/DD/BI community service (local purchase):
 13 10 .................................................. $ 11,112,237
 13 11    Sec. 13.  SOCIAL SERVICES BLOCK GRANT PLAN.  The department
 13 12 of human services during each state fiscal year shall develop
 13 13 a plan for the use of federal social services block grant
 13 14 funds for the subsequent state fiscal year.
 13 15    The proposed plan shall include all programs and services
 13 16 at the state level which the department proposes to fund with
 13 17 federal social services block grant funds, and shall identify
 13 18 state and other funds which the department proposes to use to
 13 19 fund the state programs and services.
 13 20    The proposed plan shall also include all local programs and
 13 21 services which are eligible to be funded with federal social
 13 22 services block grant funds, the total amount of federal social
 13 23 services block grant funds available for the local programs
 13 24 and services, and the manner of distribution of the federal
 13 25 social services block grant funds to the counties.  The
 13 26 proposed plan shall identify state and local funds which will
 13 27 be used to fund the local programs and services.
 13 28    The proposed plan shall be submitted with the department's
 13 29 budget requests to the governor and the general assembly.
 13 30    Sec. 14.  PROJECTS FOR ASSISTANCE IN TRANSITION FROM
 13 31 HOMELESSNESS.  Upon receipt of the minimum formula grant from
 13 32 the federal alcohol, drug abuse, and mental health
 13 33 administration to provide mental health services for the
 13 34 homeless, the division of mental health and developmental
 13 35 disabilities of the department of human services shall assure
 14  1 that a project which receives funds under the formula grant
 14  2 from either the federal or local match share of 25 percent in
 14  3 order to provide outreach services to persons who are
 14  4 chronically mentally ill and homeless or who are subject to a
 14  5 significant probability of becoming homeless shall do all of
 14  6 the following:
 14  7    1.  Provide community mental health services, diagnostic
 14  8 services, crisis intervention services, and habilitation and
 14  9 rehabilitation services.
 14 10    2.  Refer clients to medical facilities for necessary
 14 11 hospital services, and to entities that provide primary health
 14 12 services and substance abuse services.
 14 13    3.  Provide appropriate training to persons who provide
 14 14 services to persons targeted by the grant.
 14 15    4.  Provide case management to homeless persons.
 14 16    5.  Provide supportive and supervisory services to certain
 14 17 homeless persons living in residential settings which are not
 14 18 otherwise supported.
 14 19    6.  Projects may expend funds for housing services
 14 20 including minor renovation, expansion and repair of housing,
 14 21 security deposits, planning of housing, technical assistance
 14 22 in applying for housing, improving the coordination of housing
 14 23 services, the costs associated with matching eligible homeless
 14 24 individuals with appropriate housing, and one-time rental
 14 25 payments to prevent eviction.
 14 26    Sec. 15.  CHILD CARE AND DEVELOPMENT FUND.  There is
 14 27 appropriated from the fund created by section 8.41 to the
 14 28 department of human services for the federal fiscal year
 14 29 beginning October 1, 1998, and ending September 30, 1999, the
 14 30 following amount:  
 14 31 .................................................. $ 26,452,639
 14 32    Funds appropriated in this section are the funds
 14 33 anticipated to be received from the federal government under
 14 34 42 U.S.C., chapter 105, subchapter II-B, which provides for
 14 35 the child care and development fund.  The department shall
 15  1 expend the funds appropriated in this section as provided in
 15  2 the federal law making the funds available and in conformance
 15  3 with chapter 17A.
 15  4    Sec. 16.  PROCEDURE FOR REDUCED FEDERAL FUNDS.
 15  5    1.  If the funds received from the federal government for
 15  6 the block grants specified in this Act are less than the
 15  7 amounts appropriated, the funds actually received shall be
 15  8 prorated by the governor for the various programs, other than
 15  9 for the services to victims of sex offenses and for rape
 15 10 prevention education under section 4, subsection 2, of this
 15 11 Act, for which each block grant is available according to the
 15 12 percentages that each program is to receive as specified in
 15 13 this Act.  However, if the governor determines that the funds
 15 14 allocated by the percentages will not be sufficient to effect
 15 15 the purposes of a particular program, or if the appropriation
 15 16 is not allocated by percentage, the governor may allocate the
 15 17 funds in a manner which will effect to the greatest extent
 15 18 possible the purposes of the various programs for which the
 15 19 block grants are available.
 15 20    2.  Before the governor implements the actions provided for
 15 21 in subsection 1, the following procedures shall be taken:
 15 22    a.  The chairpersons and ranking members of the senate and
 15 23 house standing committees on appropriations, the appropriate
 15 24 chairpersons and ranking members of subcommittees of those
 15 25 committees, the director of the legislative service bureau,
 15 26 and the director of the legislative fiscal bureau shall be
 15 27 notified of the proposed action.
 15 28    b.  The notice shall include the proposed allocations, and
 15 29 information on the reasons why particular percentages or
 15 30 amounts of funds are allocated to the individual programs, the
 15 31 departments and programs affected, and other information
 15 32 deemed useful.  Chairpersons notified shall be allowed at
 15 33 least two weeks to review and comment on the proposed action
 15 34 before the action is taken.
 15 35    3.  If the amount of moneys received from the federal
 16  1 government for a specific grant number specified in this Act
 16  2 is less than the amount appropriated, the amount appropriated
 16  3 shall be reduced accordingly.  An annual report listing any
 16  4 such appropriation reduction shall be submitted to the fiscal
 16  5 committee of the legislative council.
 16  6    Sec. 17.  PROCEDURE FOR INCREASED FEDERAL FUNDS.
 16  7    1.  If funds received from the federal government in the
 16  8 form of block grants exceed the amounts appropriated in
 16  9 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
 16 10 shall be prorated to the appropriate programs according to the
 16 11 percentages specified in those sections, except additional
 16 12 funds shall not be prorated for administrative expenses.
 16 13    2.  If funds received from the federal government from
 16 14 block grants exceed the amount appropriated in section 11 of
 16 15 this Act for the low-income home energy assistance program, 15
 16 16 percent of the excess shall be allocated to the low-income
 16 17 residential weatherization program.
 16 18    3.  If funds received from the federal government from
 16 19 community services block grants exceed the amount appropriated
 16 20 in section 9 of this Act, 100 percent of the excess is
 16 21 allocated to the community services block grant program.
 16 22    4.  If the amount of moneys received from the federal
 16 23 government for a specific grant number specified in this Act
 16 24 exceeds the amount appropriated, the excess amount is
 16 25 appropriated for the purpose designated in the specific
 16 26 grant's appropriation.  An annual report listing any such
 16 27 excess appropriations shall be submitted to the fiscal
 16 28 committee of the legislative council.
 16 29    Sec. 18.  PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
 16 30 FUNDS.  If other federal grants, receipts, and funds and other
 16 31 nonstate grants, receipts, and funds become available or are
 16 32 awarded which are not available or awarded during the period
 16 33 in which the general assembly is in session, but which require
 16 34 expenditure by the applicable department or agency prior to
 16 35 March 15 of the fiscal year beginning July 1, 1998, and ending
 17  1 June 30, 1999, these grants, receipts, and funds are
 17  2 appropriated to the extent necessary, provided that the fiscal
 17  3 committee of the legislative council is notified within thirty
 17  4 days of receipt of the grants, receipts, or funds and the
 17  5 fiscal committee of the legislative council has an opportunity
 17  6 to comment on the expenditure of the grants, receipts, or
 17  7 funds.
 17  8    Sec. 19.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP.

 40 23 appropriated to the commission of veterans affairs for the

 42  2    Sec. 58.  LIHEAP FUNDING – DISCONNECTION PROHIBITION.  It
 42  3 is the intent of the general assembly that if the governor
 42  4 determines federal funds are insufficient to adequately
 42  5 provide for certification of eligibility for the low-income
 42  6 home energy assistance program by the community action
 42  7 agencies during the federal fiscal year which commences
 42  8 October 1, 1998, the Iowa utilities board shall issue an order
 42  9 prohibiting disconnection of service from November 1 through
 42 10 April 1 by a regulated public utility furnishing gas or
 42 11 electricity to households whose income falls at or below one
 42 12 hundred fifty percent of the federal poverty level as
 42 13 established by the United States office of management and
 42 14 budget.  The board shall promptly adopt rules in accordance
 42 15 with section 17A.4, subsection 2, and section 17A.5,
 42 16 subsection 2, paragraph "b", to implement this requirement.
 42 17 The energy assistance bureau of the department of human
 42 18 rights, in consultation with the community action agencies,
 42 19 shall certify to the utilities, households that are eligible
 42 20 for moratorium protection utilizing the agency's existing
 42 21 electronic database.  Rules adopted under this section shall
 42 22 also be published as a notice of intended action as provided
 42 23 in section 17A.4.
