PAG LIN 1 1 Section 1. Section 15E.192, subsection 2, Code Supplement 1 2 1997, is amended to read as follows: 1 3 2. A citywith a population of twenty-four thousand or1 4more, as shown by the 1990 certified federal census,may 1 5 create an economic development enterprise zone as authorized 1 6 in this division, subject to certification by the department 1 7 of economic development, by designating one or more contiguous 1 8 census tracts, as determined in the most recent federal 1 9 census, or designating other geographic units approved by the 1 10 department of economic development for that purpose. If there 1 11 is an area in the city which meets the requirements for 1 12 eligibility for an urban or rural enterprise community under 1 13 Title XIII of the federal Omnibus Budget Reconciliation Act of 1 14 1993, such area shall be designated by the state an economic 1 15 development enterprise zone. The area meeting the 1 16 requirements for eligibility for an urban or rural enterprise 1 17 community shall not be included for the purpose of determining 1 18 the area limitation pursuant to subsection 3. In creating an 1 19 enterprise zone, a citywith a population of twenty-four1 20thousand or more, as shown by the 1990 certified federal1 21census,may designate as part of the area tracts or approved 1 22 geographic units located in a contiguous city if such tracts 1 23 or approved geographic units meet the criteria and the city 1 24 agrees to being included. The city may establish more than 1 25 one enterprise zone.Reference in this division to "city"1 26means a city with a population of twenty-four thousand or1 27more, as shown by the 1990 certified federal census.1 28 EXPLANATION 1 29 This bill allows any city in the state to be eligible to 1 30 participate in the enterprise zone program provided other 1 31 criteria are met. Currently, only cities with a population of 1 32 24,000 or more are eligible to participate in the program 1 33 provided other criteria are met. 1 34 The enterprise zone program was passed by the general 1 35 assembly during the 1997 legislative session. The program 2 1 allows certain cities and counties to establish economic 2 2 development enterprise zones which are subject to 2 3 certification by the department of economic development. 2 4 Eligible businesses located in an enterprise zone are eligible 2 5 to receive various incentives and assistance. 2 6 LSB 3356HH 77 2 7 tm/sc/14.1
