  1  4 RELATING TO THE CRITERIA FOR ISSUANCE OF HANDICAPPED
  1  5    SPECIAL PLATES AND MAKING A CIVIL PENALTY APPLICABLE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 321.34, subsection 14, Code 1997, is
  1 10 amended to read as follows:
  1 11    14.  HANDICAPPED SPECIAL PLATES.  An owner referred to in
  1 12 subsection 12 who is a handicapped person, or who is the
  1 13 parent or guardian of a child who resides with the parent or
  1 14 guardian owner and who is a handicapped person, as defined in
  1 15 section 321L.1, may, upon written application to the
  1 16 department, order special registration plates with a
  1 17 handicapped processed emblem designed by the department
  1 18 bearing the international symbol of accessibility.  The
  1 19 special registration plates with a handicapped processed
  1 20 emblem shall only be issued if the application is accompanied
  1 21 with a statement from a physician licensed under chapter 148,
  1 22 149, 150, or 150A, a physician assistant licensed under
  1 23 chapter 148C, an advanced registered nurse practitioner
  1 24 licensed under chapter 152, or a chiropractor licensed under
  1 25 chapter 151, written on the physician's, physician
  1 26 assistant's, nurse practitioner's, or chiropractor's
  1 27 stationery, stating the nature of the applicant's or the
  1 28 applicant's child's handicap and such additional information
  1 29 as required by rules adopted by the department, including
  1 30 proof of residency of a child who is a handicapped person.  If
  1 31 the application is approved by the department the special
  1 32 registration plates with a handicapped processed emblem shall
  1 33 be issued to the applicant.  There shall be no fee in addition
  1 34 to the regular annual registration fee for the special
  1 35 registration plates with a handicapped processed emblem.  The
  2  1 authorization for special registration plates with a
  2  2 handicapped processed emblem shall not be renewed without the
  2  3 applicant furnishing evidence to the department that the owner
  2  4 of the motor vehicle or the owner's child is still a
  2  5 handicapped person as defined in section 321L.1.  An owner who
  2  6 has a child who is a handicapped person shall provide
  2  7 satisfactory evidence to the department that the handicapped
  2  8 child continues to reside with the owner.  The registration
  2  9 plates with a handicapped processed emblem shall be
  2 10 surrendered in exchange for regular registration plates as
  2 11 provided in subsection 12 when the owner of the motor vehicle
  2 12 or the owner's child no longer qualifies as a handicapped
  2 13 person as defined in section 321L.1 or when the owner's child
  2 14 who is a handicapped person no longer resides with the owner.
  2 15    Sec. 2.  Section 321L.2, subsection 1, paragraph a,
  2 16 unnumbered paragraph 1, Code 1997, is amended to read as
  2 17 follows:
  2 18    A handicapped resident of the state desiring a handicapped
  2 19 parking permit shall apply to the department upon an
  2 20 application form furnished by the department providing the
  2 21 applicant's name, address, date of birth, and social security
  2 22 number and shall also provide a statement from a physician
  2 23 licensed under chapter 148, 149, 150, or 150A, a physician
  2 24 assistant licensed under chapter 148C, an advanced registered
  2 25 nurse practitioner licensed under chapter 152, or a
  2 26 chiropractor licensed under chapter 151, or a physician,
  2 27 physician assistant, nurse practitioner, or chiropractor
  2 28 licensed to practice in a contiguous state, written on the
  2 29 physician's, physician assistant's, nurse practitioner's, or
  2 30 chiropractor's stationery, stating the nature of the
  2 31 applicant's handicap and such additional information as
  2 32 required by rules adopted by the department under section
  2 33 321L.8.  If the person is applying for a temporary handicapped
  2 34 parking permit, the physician's, physician assistant's, nurse
  2 35 practitioner's, or chiropractor's statement shall state the
  3  1 period of time during which the person is expected to be
  3  2 handicapped and the period of time for which the permit should
  3  3 be issued, not to exceed six months.
  3  4    Sec. 3.  Section 321L.2, subsection 1, paragraph a,
  3  5 subparagraph (3), Code 1997, is amended to read as follows:
  3  6    (3)  Removable windshield placard.  A handicapped person
  3  7 may apply for a temporary removable windshield placard which
  3  8 shall be valid for a period of up to six months, as determined
  3  9 by the physician's, physician assistant's, nurse
  3 10 practitioner's, or chiropractor's statement under this
  3 11 subsection or a removable windshield placard which shall be
  3 12 valid for a period of four years from the date of issuance.  A
  3 13 removable windshield placard shall be renewed within thirty
  3 14 days of the date of expiration.  To renew the placard, the
  3 15 person shall comply with the requirements for initial issuance
  3 16 of the placard under this section.  Persons seeking temporary
  3 17 removable windshield placards shall be required to furnish
  3 18 evidence upon initial application that they are temporarily
  3 19 handicapped and, in addition, furnish evidence at subsequent
  3 20 intervals that they remain temporarily handicapped.  Temporary
  3 21 removable windshield placards shall be of a distinctively
  3 22 different color from removable windshield placards.  The
  3 23 department shall issue one additional removable windshield
  3 24 placard upon the request of a handicapped person.
  3 25    Sec. 4.  Section 321L.2, subsection 2, Code 1997, is
  3 26 amended to read as follows:
  3 27    2.  Any person providing false information with the intent
  3 28 to defraud on the application for a handicapped parking permit
  3 29 used in establishing proof under subsection 1 is subject to a
  3 30 civil penalty of three hundred dollars which may be imposed by
  3 31 the department.  A physician, physician assistant, nurse
  3 32 practitioner, or chiropractor who provides false information
  3 33 with the intent to defraud on the physician's, physician
  3 34 assistant's, nurse practitioner's, or chiropractor's statement
  3 35 used in establishing proof under subsection 1 is subject to a
  4  1 civil penalty of three hundred dollars which may be imposed by
  4  2 the department.  In addition to the civil penalty, the
  4  3 department shall revoke the permit issued pursuant to this
  4  4 section.
