  1  4 RELATING TO THE REGULATION OF THE PRACTICE OF RESPIRATORY
  1  5    CARE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 152B.2, subsection 5, unnumbered
  1 10 paragraph 3, Code 1997, is amended to read as follows:
  1 11    "Respiratory care protocols" as used in this section means
  1 12 policies and procedures developed by an organized health care
  1 13 system through consultation, when appropriate, with
  1 14 administrators, licensed physicians and surgeons, certified
  1 15 licensed registered nurses, licensed physical therapists,
  1 16 licensed respiratory care practitioners, and other licensed
  1 17 health care practitioners.
  1 18    Sec. 2.  Section 152B.7A, subsection 3, Code 1997, is
  1 19 amended by striking the subsection and inserting in lieu
  1 20 thereof the following:
  1 21    This chapter is not intended to limit, preclude, or
  1 22 otherwise interfere with the practice of other health care
  1 23 providers not otherwise licensed under this chapter who are
  1 24 licensed and certified by this state to administer respiratory
  1 25 care procedures.
  1 26    Sec. 3.  Section 152B.11, Code 1997, is amended by adding
  1 27 the following new unnumbered paragraph:
  1 28    NEW UNNUMBERED PARAGRAPH.  Except for those licensed by the
  1 29 board, this section does not apply to persons who are licensed
  1 30 to practice a health profession covered by chapter 147, when
  1 31 the licensee's performance of respiratory care practices falls
  1 32 within the scope of practice, as permitted by their respective
  1 33 licensing board.
