  1  4 APPROPRIATING FUNDS TO THE DEPARTMENT OF ECONOMIC
  1  5    DEVELOPMENT, CERTAIN BOARD OF REGENTS INSTITUTIONS, 
  1  6    THE DEPARTMENT OF WORKFORCE DEVELOPMENT, THE PUBLIC 
  1  7    EMPLOYMENT RELATIONS BOARD, MAKING STATUTORY CHANGES, 
  1  8    AND PROVIDING AN EFFECTIVE DATE.
  1  9 
  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 11 
  1 12    Section 1.  DEPARTMENT OF ECONOMIC DEVELOPMENT.  There is
  1 13 appropriated from the general fund of the state and other
  1 14 designated funds to the department of economic development for
  1 15 the fiscal year beginning July 1, 1997, and ending June 30,
  1 16 1998, the following amounts, or so much thereof as is
  1 17 necessary, to be used for the purposes designated:
  1 18    1.  ADMINISTRATIVE SERVICES DIVISION
  1 19    a.  General administration
  1 20    For salaries, support, maintenance, miscellaneous purposes,
  1 21 and for providing that a business receiving moneys from the
  1 22 department for the purpose of job creation shall make
  1 23 available ten percent of the new jobs created for promise jobs
  1 24 program participants who are qualified for the jobs created
  1 25 and for not more than the following full-time equivalent
  1 26 positions:

  1 35    2.  BUSINESS DEVELOPMENT DIVISION
  2  1    a.  Business development operations
  2  2    For salaries, support, maintenance, miscellaneous purposes,
  2  3 for not more than the following full-time equivalent
  2  4 positions, for allocating $495,000 to support activities in
  2  5 conjunction with the Iowa manufacturing technology center,
  2  6 $150,000 to the graphic arts center, and $100,000 to the
  2  7 university of northern Iowa for operation of industrial
  2  8 technology programs at the ag based industrial lubrication
  2  9 center:

  2 12    The business development division may expend up to $125,000
  2 13 for a pilot project relating to labor availability recruitment
  2 14 in the areas of information technologists, engineering, and
  2 15 building trades.  If a pilot project is implemented, the
  2 16 business development division shall submit a progress report
  2 17 to the general assembly no later than January 1, 1998.
  2 18    The department shall develop minimum requirements for
  2 19 buildings and sites to be listed on the IMEDIA system.
  2 20    b.  Small business programs
  2 21    For salaries, support, maintenance, miscellaneous purposes,
  2 22 and for not more than the following full-time equivalent
  2 23 positions for the small business program, the small business
  2 24 advisory council, and targeted small business program:

  2 27    c.  Federal procurement office
  2 28    For salaries, support, maintenance, miscellaneous purposes,
  2 29 and for not more than the following full-time equivalent

  2 33    Notwithstanding section 8.33, moneys remaining unencumbered
  2 34 or unobligated on June 30, 1998, shall not revert and shall be
  2 35 available for expenditure during the fiscal year beginning
  3  1 July 1, 1998, for the same purposes.
  3  2    d.  Strategic investment fund
  3  3    For deposit in the strategic investment fund for salaries,
  3  4 support, for not more than the following full-time equivalent
  3  5 positions:

  3  8    The department may allocate from the strategic investment
  3  9 fund up to $600,000 for the entrepreneurial ventures
  3 10 assistance program.  The department shall seek the advice,
  3 11 consultation, and cooperation of the entrepreneurial centers
  3 12 and the major benefactor of the centers in the implementation
  3 13 of the entrepreneurial ventures assistance program.
  3 14    The department may allocate from the strategic investment
  3 15 fund up to $100,000 for the microbusiness rural enterprise
  3 16 assistance program under section 15.114.
  3 17    The department shall provide an annual report on the
  3 18 progress made by the department in making the community
  3 19 economic betterment program a self-sustaining, revolving loan
  3 20 program.
  3 21    e.  Insurance economic development
  3 22    There is appropriated from moneys collected by the division
  3 23 of insurance in excess of the anticipated gross revenues under
  3 24 section 505.7, subsection 3, to the department for the fiscal
  3 25 year beginning July 1, 1997, and ending June 30, 1998, the
  3 26 following amount, or so much thereof as is necessary, for
  3 27 insurance economic development and international insurance
  3 28 economic development:  
  3 29 .................................................. $    200,000
  3 30    f.  Value-added agriculture
  3 31    There is appropriated from the moneys available to support
  3 32 value-added agricultural products and processes, four percent,
  3 33 or so much thereof as is necessary, of the total moneys
  3 34 available to support value-added agricultural products and
  3 35 processes pursuant to section 423.24 each quarter for
  4  1 administration of the value-added agricultural products and
  4  2 processes financial assistance program as provided in section
  4  3 15E.111, including salaries, support, maintenance,
  4  4 miscellaneous purposes, and for not more than 2.00 FTEs.
  4  5    3.  COMMUNITY DEVELOPMENT DIVISION
  4  6    a.  Community assistance
  4  7    For salaries, support, maintenance, miscellaneous purposes,
  4  8 and for not more than the following full-time equivalent
  4  9 positions for administration of the community economic
  4 10 preparedness program, the Iowa community betterment program,
  4 11 and the city development boards:  
  4 12 .................................................. $    589,741
  4 13 ............................................... FTEs       8.50
  4 14    There is also appropriated from the rural community 2000
  4 15 program revolving fund established in section 15.287 to the
  4 16 community assistance program for the purposes of the community
  4 17 economic preparedness program:

  4 19    b.  Main street/rural main street program
  4 20    For salaries and support for not more than the following
  4 21 full-time equivalent positions:

  4 24    Notwithstanding section 8.33, moneys committed to grantees
  4 25 under contract from the general fund of the state that remain
  4 26 unexpended on June 30, 1998, shall not revert to any fund but
  4 27 shall be available for expenditure for purposes of the
  4 28 contract during the fiscal year beginning July 1, 1998.
  4 29    c.  Community development program
  4 30    For salaries, support, maintenance, miscellaneous purposes,
  4 31 for not more than the following full-time equivalent
  4 32 positions, for rural resource coordination, rural community
  4 33 leadership, rural innovations grant program, and the rural
  4 34 enterprise fund:  
  4 35 .................................................. $    720,055

  5  2    From moneys appropriated under this paragraph, the
  5  3 department shall distribute $150,000 equally to Iowa's
  5  4 councils of governments for planning and technical assistance
  5  5 to assist local governments in developing community
  5  6 development strategies for addressing long-term and short-term
  5  7 community needs.  
  5  8    There is also appropriated from the rural community 2000
  5  9 program revolving fund established in section 15.287 to the
  5 10 rural development program for the purposes of the program
  5 11 including the rural enterprise fund and collaborative skills
  5 12 development training:  
  5 13 .................................................. $    529,000
  5 14    Notwithstanding section 8.33, moneys committed to grantees
  5 15 under contract from the general fund of the state or through
  5 16 transfers from the Iowa community development loan fund or
  5 17 from the rural community 2000 program revolving fund that
  5 18 remain unexpended on June 30, 1998, shall not revert but shall
  5 19 be available for expenditure for purposes of the contract
  5 20 during the fiscal year beginning July 1, 1998.
  5 21    d.  Community development block grant and HOME
  5 22    For administration and related federal housing and urban
  5 23 development grant administration for salaries, support,
  5 24 maintenance, miscellaneous purposes, and for not more than the
  5 25 following full-time equivalent positions:  
  5 26 .................................................. $    412,505

  5 28    e.  Housing development fund
  5 29    For providing technical assistance to communities of all
  5 30 sizes and local financial institutions to help meet local
  5 31 housing needs and to provide and transfer matching funds for
  5 32 the HOME program:

  5 34    Notwithstanding section 8.33, moneys committed to grantees
  5 35 under contract from the housing development fund and moneys
  6  1 transferred for matching funds for the HOME program that
  6  2 remain unexpended or unobligated on June 30, 1998, shall not
  6  3 revert to any fund but shall be available for obligation and
  6  4 expenditure for purposes of those programs during the fiscal
  6  5 year beginning July 1, 1998.
  6  6    f.  Shelter assistance program
  6  7    For the purposes of the shelter assistance fund:  
  6  8 .................................................. $    400,000
  6  9    4.  INTERNATIONAL DIVISION
  6 10    a.  International trade operations
  6 11    For salaries, support, maintenance, miscellaneous purposes,
  6 12 for allocating $100,000 to develop markets in, investment
  6 13 opportunities with, and direct trade with greater China, none
  6 14 of which is to be used for gubernatorial or legislative travel
  6 15 purposes, and for not more than the following full-time
  6 16 equivalent positions:  
  6 17 .................................................. $  1,317,360
  6 18 ............................................... FTEs      10.00
  6 19    From among the full-time equivalent positions authorized by
  6 20 this lettered paragraph, one position shall concentrate on the
  6 21 export sale of grain, one on the export sale of livestock, and
  6 22 one on the export sale of value-added agricultural products.
  6 23    b.  Foreign trade offices
  6 24    For salaries, support, maintenance, and miscellaneous
  6 25 purposes:  
  6 26 .................................................. $    651,150
  6 27    c.  Export trade assistance program
  6 28    For export trade activities, including a program to
  6 29 encourage and increase participation in trade shows and trade
  6 30 missions by providing financial assistance to businesses for a
  6 31 percentage of their costs of participating in trade shows and
  6 32 trade missions, by providing for the lease/sublease of
  6 33 showcase space in existing world trade centers, by providing
  6 34 temporary office space for foreign buyers, international
  6 35 prospects, and potential reverse investors, and by providing
  7  1 other promotional and assistance activities, including
  7  2 salaries and support:  
  7  3 .................................................. $    425,000
  7  4    Notwithstanding section 8.33, moneys appropriated by this
  7  5 lettered paragraph which remain unobligated or unexpended on
  7  6 June 30, 1998, shall not revert to the general fund of the
  7  7 state but shall be transferred to and deposited in the
  7  8 strategic investment fund created in section 15.313.  
  7  9    d.  Agricultural product advisory council
  7 10    For support, maintenance, and miscellaneous purposes:  
  7 11 .................................................. $      1,300
  7 12    e.  For transfer to the partner state program which the
  7 13 department may use to contract with private groups or
  7 14 organizations which are the most appropriate to administer
  7 15 this program and the groups and organizations participating in
  7 16 the program shall, to the fullest extent possible, provide the
  7 17 funds to match the appropriation made in this paragraph of the
  7 18 funds transferred:

  7 20    5.  TOURISM DIVISION
  7 21    a.  Tourism operations
  7 22    For salaries, support, maintenance, miscellaneous purposes,
  7 23 for not more than the following full-time equivalent
  7 24 positions, provided that the appropriation shall not be used
  7 25 for advertising placements for in-state and out-of-state
  7 26 tourism marketing:  
  7 27 .................................................. $    772,037
  7 28 ............................................... FTEs      18.52
  7 29    b.  Tourism advertising
  7 30    For contracting exclusively for tourism advertising for in-
  7 31 state and out-of-state tourism marketing services, tourism
  7 32 promotion programs, electronic media, print media, and printed
  7 33 materials:  
  7 34 .................................................. $  4,127,000
  7 35    The department shall not use the moneys appropriated in
  8  1 this lettered paragraph, unless the department develops
  8  2 public-private partnerships with Iowa businesses in the
  8  3 tourism industry, Iowa tour groups, Iowa tourism
  8  4 organizations, and political subdivisions in this state to
  8  5 assist in the development of advertising efforts.  The
  8  6 department shall, to the fullest extent possible, develop
  8  7 cooperative efforts for advertising with contributions from
  8  8 other sources.
  8  9    Sec. 2.  COMMUNITY DEVELOPMENT LOAN FUND.  Notwithstanding
  8 10 section 15E.120, subsections 5, 6, and 7, and section 15.287,
  8 11 there is appropriated from the Iowa community development loan
  8 12 fund all the moneys available during the fiscal year beginning
  8 13 July 1, 1997, and ending June 30, 1998, to the department of
  8 14 economic development for the rural development program to be
  8 15 used by the department for the purposes of the program.
  8 16    Sec. 3.  JOB TRAINING FUND.  Notwithstanding section
  8 17 15.251, subsection 2, there is appropriated from the job
  8 18 training fund to the department of economic development for
  8 19 the fiscal year beginning July 1, 1997, and ending June 30,
  8 20 1998, the following amount, or so much thereof as is
  8 21 necessary, to be used for the purposes designated:
  8 22    For administration of chapter 260E, including salaries,
  8 23 support, maintenance, miscellaneous purposes, and for not more
  8 24 than the following full-time equivalent positions:  
  8 25 .................................................. $    185,000
  8 26 ............................................... FTEs       2.40
  8 27    Appropriations to the department of economic development
  8 28 for administration of chapter 260E and the department of
  8 29 workforce development for the target alliance program shall be
  8 30 funded on a proportional basis if receipts to the job training
  8 31 fund are insufficient to fund both appropriations in their
  8 32 entirety.
  8 33    Sec. 4.  WORKFORCE DEVELOPMENT FUND.  There is appropriated
  8 34 from the workforce development fund account created in section
  8 35 15.342A, for the fiscal year beginning July 1, 1997, and
  9  1 ending June 30, 1998, to the workforce development fund
  9  2 created in section 15.343, the following amount, for the
  9  3 purposes of the workforce development fund:  
  9  4 .................................................. $  5,531,028
  9  5    Sec. 5.  APPRENTICESHIP PROGRAM.  It is the intent of the
  9  6 general assembly that the department of economic development
  9  7 allocate $600,000 for high technology apprenticeship programs
  9  8 for the fiscal year beginning July 1, 1997, under the
  9  9 procedures specified in section 15.343.
  9 10    Sec. 6.  Of all funds appropriated to or receipts credited
  9 11 to the job training fund created in section 260F.6, subsection
  9 12 1, up to $150,000 for the fiscal year beginning July 1, 1997,
  9 13 and ending June 30, 1998, and not more than 1.30 FTEs may be
  9 14 used for the administration of the Iowa jobs training Act.
  9 15    Sec. 7.  IOWA STATE UNIVERSITY.  There is appropriated from
  9 16 the general fund of the state to the Iowa state university of
  9 17 science and technology for the fiscal year beginning July 1,
  9 18 1997, and ending June 30, 1998, the following amounts, or so
  9 19 much thereof as is necessary, to be used for the purposes
  9 20 designated:
  9 21    1.  For funding and maintaining in their current locations
  9 22 the existing small business development centers, and for not
  9 23 more than the following full-time equivalent positions:  
  9 24 .................................................. $  1,222,880
  9 25 ............................................... FTEs       5.80
  9 26    2.  For the Iowa state university of science and technology
  9 27 research park, including salaries, support, maintenance,
  9 28 miscellaneous purposes, and for not more than the following
  9 29 full-time equivalent positions:

  9 32    3.  For funding the institute for physical research and
  9 33 technology, provided that $318,358 shall be allocated to the
  9 34 industrial incentive program in accordance with the intent of
  9 35 the general assembly, and for not more than the following
 10  1 full-time equivalent positions:

 10  4    It is the intent of the general assembly that the incentive
 10  5 program focus on Iowa industrial sectors and seek
 10  6 contributions and in-kind donations from businesses,
 10  7 industrial foundations, and trade associations and that moneys
 10  8 for the institute for physical research and technology
 10  9 industrial incentive program shall only be allocated for
 10 10 projects which are matched by private sector moneys for
 10 11 directed contract research or for nondirected research.  The
 10 12 match required of small businesses as defined in section
 10 13 15.102, subsection 4, for directed contract research or for
 10 14 nondirected research shall be $1 for each $3 of state funds.
 10 15 The match required for other businesses for directed contract
 10 16 research or for nondirected research shall be $1 for each $1
 10 17 of state funds.  The match required of industrial foundations
 10 18 or trade associations shall be $1 for each $1 of state funds.
 10 19    Iowa state university of science and technology shall
 10 20 report annually to the joint appropriations subcommittee on
 10 21 economic development and legislative fiscal bureau the total
 10 22 amounts of private contributions, the proportion of
 10 23 contributions from small businesses and other businesses, and
 10 24 the proportion for directed contract research and nondirected
 10 25 research of benefit to Iowa businesses and industrial sectors.
 10 26    Notwithstanding section 8.33, moneys appropriated for the
 10 27 fiscal year which remain unobligated and unexpended at the end
 10 28 of the fiscal year shall not revert but shall be available for
 10 29 expenditure the following fiscal year.
 10 30    Sec. 8.  UNIVERSITY OF IOWA.  There is appropriated from
 10 31 the general fund of the state to the state university of Iowa
 10 32 for the fiscal year beginning July 1, 1997, and ending June
 10 33 30, 1998, the following amounts, or so much thereof as is
 10 34 necessary, to be used for the purposes designated:
 10 35    1.  For the university of Iowa research park, including
 11  1 salaries, support, maintenance, equipment, miscellaneous
 11  2 purposes, and for not more than the following full-time
 11  3 equivalent positions:  
 11  4 .................................................. $    321,700
 11  5 ............................................... FTEs       4.35
 11  6    2.  For funding the advanced drug development program at
 11  7 the Oakdale research park and for not more than the following
 11  8 full-time equivalent positions:

 11 11    The board of regents shall submit a report on the progress
 11 12 of regents institutions in meeting the strategic plan for
 11 13 technology transfer and economic development to the
 11 14 chairpersons of the joint appropriations subcommittee on
 11 15 economic development, the joint appropriations subcommittee on
 11 16 education, the majority leader and minority leader of the
 11 17 senate, the majority and minority leaders of the house of
 11 18 representatives, the secretary of the senate, the chief clerk
 11 19 of the house of representatives, and the legislative fiscal
 11 20 bureau by December 1, 1997.
 11 21    Sec. 9.  UNIVERSITY OF NORTHERN IOWA.  There is
 11 22 appropriated from the general fund of the state to the
 11 23 university of northern Iowa for the fiscal year beginning July
 11 24 1, 1997, and ending June 30, 1998, the following amounts, or
 11 25 so much thereof as is necessary, to be used for the purposes
 11 26 designated:
 11 27    1.  For the metal casting institute, including salaries,
 11 28 support, maintenance, miscellaneous purposes, and for not more
 11 29 than the following full-time equivalent positions:  
 11 30 .................................................. $    160,000

 11 32    2.  For the institute of decision making, including
 11 33 salaries, support, maintenance, miscellaneous purposes, and

 12  3    Sec. 10.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There is

 12  6 beginning July 1, 1997, and ending June 30, 1998, the
 12  7 following amounts, or so much thereof as is necessary, for the
 12  8 purposes designated:
 12  9    1.  DIVISION OF LABOR SERVICES
 12 10    For the division of labor services, including salaries,
 12 11 support, maintenance, miscellaneous purposes, and for not more
 12 12 than the following full-time equivalent positions:

 12 15    From the contractor registration fees, the division of
 12 16 labor services shall reimburse the department of inspections
 12 17 and appeals for all costs associated with hearings under

 12 20    For salaries, support, maintenance, miscellaneous purposes,
 12 21 and for not more than the following full-time equivalent

 13 17    b.  Workforce investment program
 13 18    For a competitive grant program by the department for
 13 19 projects that increase Iowa's pool of available labor via
 13 20 training and support services with priority given to projects
 13 21 which serve displaced homemakers or welfare recipients,
 13 22 including salaries and support, and not more than the
 13 23 following full-time equivalent position:  
 13 24 .................................................. $    479,831
 13 25 ................................................ FTE       0.90
 13 26    The department shall ensure that the workforce investment
 13 27 program is coordinated with services provided under the
 13 28 federal Job Training Partnership Act and that welfare
 13 29 recipients receive priority for services under both programs.
 13 30    Notwithstanding section 8.33, moneys committed to grantees
 13 31 under contract that remain unexpended on June 30, 1998, shall
 13 32 not revert to any fund but shall be available for expenditure
 13 33 for purposes of the contract during the fiscal year beginning
 13 34 July 1, 1998.
 13 35    c.  Labor management coordinator
 14  1    For salaries, support, maintenance, miscellaneous purposes,
 14  2 and for not more than the following full-time equivalent
 14  3 position:  
 14  4 .................................................. $     65,935
 14  5 ................................................ FTE       1.00
 14  6    The Iowa workforce development board shall be responsible
 14  7 for the functions previously conducted by the state labor
 14  8 management cooperation council.  The board, the department of
 14  9 workforce development, and the labor management coordinator
 14 10 shall cooperate to improve communications and facilitate
 14 11 dialogue between labor, management, and government on
 14 12 workforce development problems facing the state, to form in-
 14 13 plant labor management committees, and to provide technical
 14 14 assistance to establish effective labor management policies in
 14 15 the state.
 14 16    Sec. 11.  JOB TRAINING FUND.  Notwithstanding section
 14 17 15.251, subsection 2, there is appropriated from the job
 14 18 training fund to the department of workforce development for
 14 19 the fiscal year beginning July 1, 1997, and ending June 30,
 14 20 1998, the following amount, or so much thereof as is
 14 21 necessary, to be used for the purpose designated:
 14 22    For the target alliance program:

 14 24    Sec. 12.  ADMINISTRATIVE CONTRIBUTION SURCHARGE FUND.
 14 25 There is appropriated from the administrative contribution
 14 26 surcharge fund of the state to the department of workforce
 14 27 development for the fiscal year beginning July 1, 1997, and
 14 28 ending June 30, 1998, the following amount, or so much thereof
 14 29 as is necessary, for the purposes designated:
 14 30    DIVISION OF JOB SERVICE
 14 31    Notwithstanding section 96.7, subsection 12, paragraph "c",
 14 32 for salaries, support, maintenance, conducting labor
 14 33 availability surveys, miscellaneous purposes, and for not more
 14 34 than the following full-time equivalent positions:  
 14 35 .................................................. $  6,720,000
 15  1 ............................................... FTEs     144.12
 15  2    The division shall continue charging a $65 filing fee for
 15  3 workers' compensation cases.  The filing fee shall be paid by
 15  4 the petitioner of a claim.  However, the fee can be taxed as a
 15  5 cost and paid by the losing party, except in cases where it
 15  6 would impose an undue hardship or be unjust under the
 15  7 circumstances.
 15  8    Sec. 13.  EMPLOYMENT SECURITY CONTINGENCY FUND.  There is
 15  9 appropriated from the special employment security contingency
 15 10 fund to the department of workforce development for the fiscal
 15 11 year beginning July 1, 1997, and ending June 30, 1998, the
 15 12 following amounts, or so much thereof as is necessary, for the
 15 13 purposes designated:
 15 14    1.  DIVISION OF LABOR SERVICES
 15 15    For salaries, support, maintenance, and miscellaneous
 15 16 purposes:  
 15 17 .................................................. $    296,000
 15 18    2.  DIVISION OF INDUSTRIAL SERVICES
 15 19    For salaries, support, maintenance, and miscellaneous
 15 20 purposes:  
 15 21 .................................................. $    175,000
 15 22    Any additional penalty and interest revenue may be used to
 15 23 accomplish the mission of the department.
 15 24    Sec. 14.  PUBLIC EMPLOYMENT RELATIONS BOARD.  There is
 15 25 appropriated from the general fund of the state to the public
 15 26 employment relations board for the fiscal year beginning July
 15 27 1, 1997, and ending June 30, 1998, the following amount, or so
 15 28 much thereof as is necessary, for the purposes designated:
 15 29    For salaries, support, maintenance, miscellaneous purposes,
 15 30 and for not more than the following full-time equivalent
 15 31 positions:  
 15 32 .................................................. $    818,685
 15 33 ............................................... FTEs      12.80
 15 34    Sec. 15.  Moneys remaining in the division-approved
 15 35 training fund created in 1990 Iowa Acts, chapter 1261, section
 16  1 5, subsection 2, paragraph "d", is appropriated to the
 16  2 department of workforce development to provide training and
 16  3 direct client services to promise jobs recipients in the
 16  4 fiscal year beginning July 1, 1997.  The division-approved
 16  5 training fund is closed out June 30, 1998.
 16  6    Sec. 16.  NEW SECTION.  15.350  SHELTER ASSISTANCE FUND.
 16  7    A shelter assistance fund is created as a revolving fund in
 16  8 the state treasury under the control of the department
 16  9 consisting of any moneys appropriated by the general assembly
 16 10 and received under section 428A.8 for purposes of the
 16 11 construction, rehabilitation, expansion, or costs of
 16 12 operations of group home shelters for the homeless and
 16 13 domestic violence shelters.  Of the moneys in the fund, not
 16 14 less than five hundred forty-six thousand dollars shall be
 16 15 spent annually on homeless shelter projects.  Notwithstanding
 16 16 section 8.33, all moneys in the shelter assistance fund which
 16 17 remain unexpended or unobligated at the close of the fiscal
 16 18 year shall not revert to the general fund of the state but
 16 19 shall remain available for expenditure for subsequent fiscal
 16 20 years.
 16 21    Sec. 17.  Section 16.5, Code 1997, is amended by adding the
 16 22 following new subsection:
 16 23    NEW SUBSECTION.  17.  Provide moneys to the shelter
 16 24 assistance fund created in section 15.350.
 16 25    Sec. 18.  Section 16.40, subsection 2, Code 1997, is
 16 26 amended by striking the subsection.
 16 27    Sec. 19.  Section 16.100, subsection 2, paragraph a, Code
 16 28 1997, is amended by striking the subsection.
 16 29    Sec. 20.  Section 260F.2, subsection 11, Code 1997, is
 16 30 amended to read as follows:
 16 31    11.  "Project" means a training arrangement which is the
 16 32 subject of an agreement entered into between the community
 16 33 college and a business to provide program services.  "Project"
 16 34 also means a department-sponsored training arrangement which
 16 35 is sponsored by the department and administered under sections
 17  1 260F.6A and 260F.6B.
 17  2    Sec. 21.  NEW SECTION.  260F.6B  HIGH TECHNOLOGY
 17  3 APPRENTICESHIP PROGRAM.
 17  4    The community colleges and the department of economic
 17  5 development are authorized to fund high technology
 17  6 apprenticeship programs which comply with the requirements
 17  7 specified in section 260C.44 and which may include both new
 17  8 and statewide apprenticeship programs.  Notwithstanding the
 17  9 provisions of section 260F.6, subsection 2, relating to
 17 10 maximum award amounts, moneys allocated to the community
 17 11 colleges with high technology apprenticeship programs shall be
 17 12 distributed to the community colleges based upon contact hours
 17 13 under the programs administered during the prior fiscal year
 17 14 as determined by the department of education.  The department
 17 15 of economic development shall adopt rules governing this
 17 16 section's operation and participant eligibility.
 17 17    Sec. 22.  Section 428A.8, unnumbered paragraph 1, Code
 17 18 1997, is amended to read as follows:
 17 19    On or before the tenth day of each month the county
 17 20 recorder shall determine and pay to the treasurer of state
 17 21 eighty-two and three-fourths percent of the receipts from the
 17 22 real estate transfer tax collected during the preceding month
 17 23 and the treasurer of state shall deposit ninety-five percent
 17 24 of the receipts in the general fund of the state and transfer
 17 25 five percent of the receipts to the Iowa finance authority for
 17 26 deposit in the housing improvement fund created in section
 17 27 16.100 shelter assistance fund created in section 15.350.
 17 28    Sec. 23.  1996 Iowa Acts, chapter 1218, section 55,
 17 29 subsection 3, is amended to read as follows:
 17 30    3.  The moneys appropriated in this section shall be used
 17 31 only for providing assistance in the form of loan guarantees,
 17 32 irrevocable letters of credit, and accordance with section
 17 33 15E.175, subsection 3, paragraph "b".  However, to be eligible
 17 34 for funding an indemnification for liability agreements
 17 35 agreement shall be entered into prior to October 15, 1996 June
 18  1 30, 1998.
 18  2    Sec. 24.  1996 Iowa Acts, chapter 1219, section 92, is
 18  3 amended to read as follows:
 18  4    SEC. 92.  There is allocated from the unobligated funds
 18  5 remaining in the Wallace technology transfer foundation fund,
 18  6 after the allocation in section 78, subsection 2, paragraph
 18  7 "d", of this Act, on June 30, 1996, $100,000 for deposit in
 18  8 the housing improvement fund created in section 16.100 for the
 18  9 purposes of the fund.  Any funds remaining shall not revert to
 18 10 any fund, notwithstanding section 8.33.  Unobligated funds
 18 11 remaining on June 30, 1997, shall revert to the general fund
 18 12 of the state strategic investment fund created in section
 18 13 15.313.
 18 14    Sec. 25.  To the extent possible, the administrative rules
 18 15 for the high technology apprenticeship programs authorized in
 18 16 section 260F.6B shall be generally consistent with the current
 18 17 administrative rules in 261 IAC ch. 17, with the exception
 18 18 that the definition of "currently existing program" shall be
 18 19 stricken.
 18 20    Sec. 26.  All physical assets of the Wallace technology
 18 21 transfer foundation shall be transferred to the possession of
 18 22 the department of economic development on June 30, 1997.
 18 23    Sec. 27.  In providing moneys from the shelter assistance
 18 24 fund to homeless shelter programs, the department is requested
 18 25 to consider exploring the potential to allocate moneys to
 18 26 homeless shelter programs based in part on their ability to
 18 27 move their clients toward self-sufficiency.
 18 28    Sec. 28.  The department of economic development and the
 18 29 department of workforce development shall within the budget
 18 30 proposals for the fiscal year beginning July 1, 1999, detail
 18 31 the number of FTEs and contract employees included in the
 18 32 budget proposal.  During the budget process for the fiscal
 18 33 year beginning July 1, 1999, the joint economic development
 18 34 appropriation subcommittee shall examine contract employees in
 18 35 relationship to the budgets of the department of economic
 19  1 development and the department of workforce development.
 19  2    Sec. 29.  On or before June 30, 1998, the board of
 19  3 directors of the Iowa seed capital corporation shall wind up
 19  4 the affairs of the corporation, including termination of
 19  5 staff, dissolution of the corporation, and transfer of
 19  6 remaining assets and liabilities to the Iowa capital
 19  7 investment board pursuant to H.F. 652, if enacted.  In the
 19  8 event that the remaining assets and liabilities cannot be
 19  9 transferred to the Iowa capital investment board, the board of
 19 10 directors of the Iowa seed capital corporation shall provide
 19 11 for the orderly liquidation of all assets, settle existing
 19 12 liabilities, and transfer remaining moneys to the general fund
 19 13 of the state.  The joint appropriations subcommittee on
 19 14 economic development supports the implementation of H.F. 652
 19 15 relating to the increasing of venture capital in Iowa.
 19 16    Sec. 30.  HOUSING ASSISTANCE INTERIM STUDY.  As housing in
 19 17 Iowa is a critical need, the legislative council is requested
 19 18 to establish an interim committee to provide the opportunity
 19 19 to learn about housing assistance organizations.  By October
 19 20 30, 1997, the study committee shall submit a report to the
 19 21 general assembly.
 19 22    Sec. 31.  HOUSING ASSISTANCE INFORMATION.  By October 15,
 19 23 1997, all housing assistance organizations in Iowa are
 19 24 requested to submit a report to the secretary of the senate
 19 25 and the chief clerk of the house of representatives based on
 19 26 such information as is needed for the interim study requested
 19 27 in section 30.
 19 28    Sec. 32.  BUDGET PROPOSALS.  The department of economic
 19 29 development and the department of workforce development shall
 19 30 submit all budget proposals in the traditional format as well
 19 31 as in the budgeting for results format for the fiscal year
 19 32 beginning July 1, 1998.
 19 33    Sec. 33.  FEDERAL GRANTS.  All federal grants to and the
 19 34 federal receipts of agencies appropriated funds under this
 19 35 Act, not otherwise appropriated, are appropriated for the
 20  1 purposes set forth in the federal grants or receipts unless
 20  2 otherwise provided by the general assembly.
 20  3    Sec. 34.  EFFECTIVE DATE.  Sections 23 and 24 of this Act,
 20  4 being deemed of immediate importance, take effect upon
 20  5 enactment.
