  1  4 TO PROHIBIT ACTS BY INMATES OF JAILS OR CORRECTIONAL INSTITU-
  1  5    TIONS WHICH RESULT IN CONTACT WITH CERTAIN BODILY FLUIDS OR
  1  6    SECRETIONS OR THE CASTING OR EXPELLING OF CERTAIN BODILY
  1  7    FLUIDS OR SECRETIONS ON JAIL AND CORRECTIONAL EMPLOYEES, AND
  1  8    PROVIDING PENALTIES.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 11 
  1 12    Section 1.  NEW SECTION.  708.3B  INMATE ASSAULTS – BODILY
  1 13 FLUIDS OR SECRETIONS.
  1 14    A person who, while confined in a jail or in an institution
  1 15 or facility under the control of the department of
  1 16 corrections, commits any of the following acts commits a class
  1 17 "D" felony:
  1 18    1.  An assault, as defined under section 708.1, upon an
  1 19 employee of the jail or institution or facility under the
  1 20 control of the department of corrections, which results in the
  1 21 employee's contact with blood, seminal fluid, urine, or feces.
  1 22    2.  An act which is intended to cause pain or injury or be
  1 23 insulting or offensive and which results in blood, seminal
  1 24 fluid, urine, or feces being cast or expelled upon an employee
  1 25 of the jail or institution or facility under the control of
  1 26 the department of corrections.
