  1  4 RELATING TO NOTIFICATION REQUIREMENTS FOR COMMUNICATIONS
  1  5    BETWEEN A DEBT COLLECTOR AND A DEBTOR.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 537.7103, subsection 4, paragraph b,
  1 10 Code 1997, is amended to read as follows:
  1 11    b.  The failure to clearly disclose in all the initial
  1 12 written communications made to collect or attempt to collect a
  1 13 debt or to obtain or attempt to obtain information about a
  1 14 debtor communication with the debtor and, in addition, if the
  1 15 initial communication with the debtor is oral, in that initial
  1 16 oral communication, that the debt collector is attempting to
  1 17 collect a debt and that information obtained will be used for
  1 18 that purpose, and the failure to disclose in subsequent
  1 19 communications that the communication is from a debt
  1 20 collector, except where disclosure would tend to embarrass the
  1 21 debtor that this paragraph does not apply to a formal pleading
  1 22 made in connection with a legal action.
