1 3 #1. Page 2, line 9, by inserting after the word
1 4 "cases." the following: "In establishing hourly rates
1 5 or setting per case fee limitations, the state public
1 6 defender shall consider evidence of ordinary,
1 7 reasonable and customary charges; rates previously
1 8 paid by the state; the nature and penal consequences
1 9 associated with the offense charged; value and costs
1 10 associated with in-court time, value and costs
1 11 associated with out-of-court time; and any other
1 12 relevant factors."
1 13 #2. Page 2, by striking lines 20 through 32 and
1 14 inserting the following: "applicable law.
1 15 Notwithstanding chapter 17A, an appointed attorney
1 16 may seek expedited review of actions of the state
1 17 public defender with regard to a request for advance
1 18 approval for anticipated compensation in excess of any
1 19 fee limitation by filing a motion with the appointing
1 20 court."
1 21 #3. Page 3, by striking lines 6 through 11 and
1 22 inserting the following:
1 23 "Notwithstanding chapter 17A, an appointed attorney
1 24 may seek review of actions of the state public
1 25 defender which approve in part, deny, or modify a
1 26 claim for compensation by filing a motion with the
1 27 appointing court."
