  1  1    Amend House File 2539 as follows:
  1  2    #1.  Page 34, by inserting after line 27 the
  1  3 following:
  1  4    "Sec. ___.  DIVISION OF CRIMINAL AND JUVENILE
  1  5 JUSTICE PLANNING – LOCAL CORRECTIONS INFRASTRUCTURE
  1  6 FUND.  There is appropriated from the general fund of
  1  7 the state to the department of human rights, division
  1  8 of criminal and juvenile justice planning for the
  1  9 fiscal year beginning July 1, 1998, and ending June
  1 10 30, 1999, the following amount, or so much thereof as
  1 11 is necessary, to be used for the purpose designated:
  1 12    For deposit in the local corrections infrastructure
  1 13 revolving fund established in section 905A.1:  
  1 14 .................................................. $  3,500,000
  1 15    Sec. ___.  NEW SECTION.  905A.1  LOCAL CORRECTIONS
  1 16 INFRASTRUCTURE REVOLVING FUND.
  1 17    1.  A local corrections infrastructure revolving
  1 18 fund is created in the office of the treasurer of
  1 19 state to provide grants, loans, or loan guarantees to
  1 20 eligible recipients for the purposes provided in this
  1 21 section.  The fund is under the authority of the
  1 22 division of criminal and juvenile justice planning of
  1 23 the department of human rights.  The division shall
  1 24 adopt rules pursuant to chapter 17A as necessary to
  1 25 administer the revolving fund and to establish
  1 26 criteria for providing grants, loans, or loan
  1 27 guarantees from the fund.  In establishing criteria,
  1 28 the division shall give preference to cities or
  1 29 counties willing to provide a local match for moneys
  1 30 provided from the revolving fund.  Notwithstanding
  1 31 section 8.33, moneys in the fund at the end of a
  1 32 fiscal year shall not revert to any other fund or to
  1 33 the general fund of the state but shall remain in the
  1 34 revolving fund.  The fund shall consist of all
  1 35 appropriations, grants, or gifts received by the
  1 36 division specifically for use as provided by this
  1 37 section and all repayments of loans or grants made
  1 38 under this section.
  1 39    2.  A grant, loan, or loan guarantee authorized by
  1 40 this section shall be utilized for any or all of the
  1 41 following projects:
  1 42    a.  A county jail.
  1 43    b.  A regional or multicounty jail.
  1 44    c.  A county juvenile detention or shelter care
  1 45 home, including retirement of outstanding debt for
  1 46 such a home.
  1 47    d.  A regional or multicounty juvenile detention or
  1 48 shelter care home.
  1 49    3.  For purposes of this section, "eligible
  1 50 recipients" means a city or county which expends funds
  2  1 for incarceration or supervision of individuals
  2  2 charged with or convicted of a felony, an aggravated
  2  3 misdemeanor, or a serious misdemeanor, or one or more
  2  4 cities or counties as described in this subsection
  2  5 within a judicial election district as described in
  2  6 section 602.6109."
