1 2 #1. Page 18, by inserting after line 34 the
1 3 following:
1 4 "Sec. . Section 282.30, subsection 1, Code
1 5 1997, is amended by adding the following new
1 6 paragraph:
1 7 NEW PARAGRAPH. c. (1) In lieu of the educational
1 8 programs provided for under paragraph "b", a facility
1 9 specified in paragraph "a" may submit a plan and
1 10 proposed budget for the education of a child living in
1 11 the facility to the department of education by January
1 12 1 annually. The department of education shall notify
1 13 the facility of its approval or denial of the plan in
1 14 writing by February 1. Notification, if the plan is
1 15 denied, shall identify any areas of noncompliance with
1 16 the education standards provided in section 256.11,
1 17 and shall contain recommendations for corrective
1 18 action necessary for compliance.
1 19 (2) Notwithstanding section 282.31, if the plan is
1 20 approved, the department of education shall direct the
1 21 department of revenue and finance to pay the approved
1 22 budget amount provided for in the plan to the facility
1 23 in monthly installments beginning September 15 and
1 24 ending June 15 of the next succeeding school year.
1 25 The installments shall be as nearly equal as possible
1 26 as determined by the department of management, taking
1 27 into consideration the relative budget and cash
1 28 position of the state's resources. The department of
1 29 revenue and finance shall transfer the approved budget
1 30 amount for the facility from the moneys appropriated
1 31 under section 257.16 and make the payments to the
1 32 facility. The facility shall submit an accounting for
1 33 the actual cost of the plan to the department of
1 34 education by August 1 of the following school year.
1 35 The department shall review and approve or modify all
1 36 expenditures incurred in compliance with rules adopted
1 37 by the state board of education pursuant to section
1 38 256.7, subsection 10, and shall notify the department
1 39 of revenue and finance of the approved accounting
1 40 amount. The approved accounting amount shall be
1 41 compared with any amounts paid by the department of
1 42 revenue and finance to the facility and any
1 43 differences added to or subtracted from the October
1 44 payment made under this paragraph for the next school
1 45 year. Any amount paid by the department of revenue
1 46 and finance shall be deducted monthly from the state
1 47 foundation aid paid under section 257.16 to all school
1 48 districts in the state during the subsequent fiscal
1 49 year. The portion of the total amount of the approved
1 50 budget that shall be deducted from the state aid of a
2 1 school district shall be the same as the ratio that
2 2 the budget enrollment for the budget year of the
2 3 school district bears to the total budget enrollment
2 4 in the state for that budget year in which the
2 5 deduction is made.
2 6 (3) A facility may appeal a decision by the
2 7 department of education to deny the plan submitted
2 8 pursuant to this paragraph, to the state board of
2 9 education. The decision of the state board is final."
