                        REFUSAL OF GOVERNORS APPOINTMENT

                       (Individual Confirmation Calendar)

         Senator Black called up the appointment of Esther M. Strother as a
    member of the Environmental Protection Commission, placed on the
    Individual Confirmation Calendar on March 29, 1995, without
    recommendation, and found on page 943 of the Senate Journal.

         Senator Black moved that the foregoing appointment be confirmed by
    the Senate.

         On the question Shall the appointee be confirmed? the vote was:

         Rule 23, requiring all Senators present to vote except those who
    express a conflict of interest, was invoked.

         The appointee not having received a two-thirds vote, the Chair
    declared the Senate refused to confirm the appointment of Esther M.
    Strother.
