                        REFUSAL OF GOVERNORS APPOINTMENT

                       (Individual Confirmation Calendar)

         Senator Fraise called up the appointment of Donald Culp, as a
    member of the State Judicial Nominating Commission, placed on the
    Individual Confirmation Calendar on March 28, 1995, without
    recommendation, and found on page 921 of the Senate Journal.

         Senator Fraise moved that the foregoing appointment be confirmed by
    the Senate.

         On the question Shall the appointee be confirmed? the vote was:

         The appointee not having received a two-thirds vote, the Chair
