  1  1    Section 1.  There is appropriated from the general fund of
  1  2 the state to the Iowa communications network fund created in
  1  3 section 8D.14 for the fiscal year beginning July 1, 1996, and
  1  4 ending June 30, 1997, the following amount, or so much thereof
  1  5 as is necessary, to be used for the purpose designated:
  1  6    For debt service:  
  1  7 .................................................. $ 12,754,000
  1  8    Upon the appropriation of the funds in this section to the
  1  9 Iowa communications network fund, the Iowa telecommunications
  1 10 and technology commission shall immediately transfer
  1 11 $12,754,000 of the appropriated amount to a separate fund
  1 12 established in the office of the treasurer of state, to be
  1 13 used solely for debt service for the Iowa communications
  1 14 network.  The commission shall certify to the treasurer of
  1 15 state when a debt service payment is due, and upon receipt of
  1 16 the certification the treasurer shall make the payment.  The
  1 17 commission shall pay any additional amount due from funds
  1 18 deposited in the Iowa communications network fund.
  1 19    Sec.2.  PART III RELATED APPROPRIATIONS.
  1 20    1.  PART III AUTHORIZED USERS.
  1 21    a.  There is appropriated from the rebuild Iowa
  1 22 infrastructure fund of the state created in section 8.57,
  1 23 subsection 5, to the Iowa communications network fund under
  1 24 the control of the Iowa telecommunications and technology
  1 25 commission for the fiscal year beginning July 1, 1996, and
  1 26 ending June 30, 1997, the following amount, or so much thereof
  1 27 as is necessary, to be used for the purpose designated:
  1 28    For the connection of a minimum of 110 Part III authorized
  1 29 users as determined by the commission and communicated to the
  1 30 general assembly:  
  1 31 .................................................. $ 19,600,095
  1 32    b.  It is the intent of the general assembly that the
  1 33 connection of the authorized user sites pursuant to this
  1 34 subsection be awarded based upon the Part III contracts
  1 35 executed in 1995.
  2  1    c.  It is also the intent of the general assembly that the
  2  2 commission lease DS-1 or T-1 circuits for Part III connections
  2  3 currently using analog technology.
  2  4    d.  Notwithstanding the fact that funds appropriated
  2  5 pursuant to this subsection will not be made available prior
  2  6 to July 1, 1996, the Iowa telecommunications and technology
  2  7 commission is authorized to negotiate and enter into contracts
  2  8 for ordering necessary equipment related to the completion of
  2  9 the connections authorized in paragraph "a" as deemed
  2 10 appropriate by the commission upon the effective date of this
  2 11 paragraph.
  2 12    2.  PART III NETWORK COSTS – SUBSIDIZATION FUND.  There is
  2 13 appropriated from the general fund of the state to the Iowa
  2 14 communications network fund created in section 8D.14 for the
  2 15 fiscal year beginning July 1, 1996, and ending June 30, 1997,
  2 16 the following amount, or so much thereof as is necessary, to
  2 17 be used for the purposes designated in this subsection:
  2 18    For the subsidization of video rates for authorized users
  2 19 as determined by the commission and consistent with chapter
  2 20 8D:  
  2 21 .................................................. $  2,400,000
  2 22 ............................................... FTEs      57.00
  2 23    3.  PART III NETWORK COSTS – MAINTENANCE AND LEASE COSTS.
  2 24    a.  There is appropriated from the rebuild Iowa
  2 25 infrastructure fund of the state created in section 8.57,
  2 26 subsection 5, to the Iowa communications network fund under
  2 27 the control of the Iowa telecommunications and technology
  2 28 commission for the fiscal year beginning July 1, 1996, and
  2 29 ending June 30, 1997, the following amount, or so much thereof
  2 30 as is necessary, to be used for the purpose designated:
  2 31    For maintenance costs and recurring lease costs as provided
  2 32 in this subsection:  
  2 33 .................................................. $  1,199,905
  2 34    b.  As a condition of the appropriation in this subsection,
  2 35 $209,298 of the amount appropriated shall be expended by the
  3  1 Iowa telecommunications and technology commission for
  3  2 maintenance costs associated with Part III connections of the
  3  3 network.
  3  4    c.  As a further condition of the appropriation in this
  3  5 subsection, $990,607 of the amount appropriated shall be
  3  6 expended by the Iowa telecommunications and technology
  3  7 commission for recurring lease costs associated with Part III
  3  8 connections of the network.
  3  9    4.  SUPPORT SERVICES.  There is appropriated from the
  3 10 general fund of the state to the Iowa communications network
  3 11 fund created in section 8D.14 for the fiscal year beginning
  3 12 July 1, 1996, and ending June 30, 1997, the following amount,
  3 13 or so much thereof as is necessary, to be used for the
  3 14 purposes designated:
  3 15    For purposes designated in paragraphs "a" and "b", and for
  3 16 not more than the following full-time equivalent positions:  
  3 17 .................................................. $  1,950,000
  3 18 ................................................FTEs      10.00
  3 19    a.  As a condition of the appropriation in this subsection,
  3 20 $450,000 of the amount appropriated shall be expended by the
  3 21 public broadcasting division of the department of education to
  3 22 provide support for functions related to the network,
  3 23 including but not limited to the following functions:
  3 24 scheduling for video classrooms; development of distance
  3 25 learning applications; development of a central information
  3 26 source on the Internet relating to educational uses of the
  3 27 network; second-line technical support for network sites;
  3 28 testing and initializing sites onto the network; and
  3 29 coordinating the work of the education telecommunications
  3 30 council.  The division is authorized an additional 5.00 FTEs
  3 31 for a total of 10.00 FTEs for the purpose of providing such
  3 32 support.
  3 33    b.  As a further condition of the appropriation in this
  3 34 subsection, $1,500,000 of the amount appropriated shall be
  3 35 allocated by the public broadcasting division of the
  4  1 department of education to the regional telecommunications
  4  2 councils established in section 8D.5.  The regional
  4  3 telecommunications councils shall use the funds to provide
  4  4 technical assistance for network classrooms, planning and
  4  5 troubleshooting for local area networks, scheduling of video
  4  6 sites, and other related support activities.
  4  7    5.  SPARE PARTS.  There is appropriated from the rebuild
  4  8 Iowa infrastructure fund of the state created in section 8.57,
  4  9 subsection 5, to the Iowa communications network fund created
  4 10 in section 8D.14, for the fiscal year beginning July 1, 1996,
  4 11 and ending June 30, 1997, the following amount, or so much
  4 12 thereof as is necessary, to be used for the purpose
  4 13 designated:
  4 14    For establishing and maintaining a spare parts depot
  4 15 related to the network:  
  4 16 .................................................. $    220,000
  4 17    6.  COMPUTERS, INTERNET CONNECTION, AND RELATED COSTS.
  4 18 There is appropriated from the rebuild Iowa infrastructure
  4 19 fund of the state created in section 8.57, subsection 5, to
  4 20 the Iowa communications network fund created in section 8D.14,
  4 21 for the fiscal year beginning July 1, 1996, and ending June
  4 22 30, 1997, the following amount, or so much thereof as is
  4 23 necessary, to be used for the purpose designated:
  4 24    For the purchase of computer equipment to be used in
  4 25 connection with the network, providing for connections to the
  4 26 Internet through the use of the network, and for maintaining
  4 27 the regional scheduling system:  
  4 28 .................................................. $    110,000
  4 29    Sec. 3.  There is appropriated from the general fund of the
  4 30 state to the state board of regents for the fiscal year
  4 31 beginning July 1, 1996, and ending June 30, 1997, the
  4 32 following amount, or so much thereof as is necessary, to be
  4 33 used for the purpose designated:
  4 34    For the center for educational technology at the university
  4 35 of northern Iowa to coordinate staff development for educators
  5  1 using educational technology in this state:  
  5  2 .................................................. $    500,000
  5  3    Sec. 4.  LEGISLATIVE INTENT.
  5  4    1.  It is the intent of the general assembly that the Iowa
  5  5 telecommunications and technology commission develop
  5  6 recommendations concerning the expenses which should be
  5  7 recovered in the rates established by the commission for use
  5  8 of the network, and any necessary subsidies.  The commission
  5  9 shall file a written report concerning these recommendations
  5 10 with the senate committee on communications and information
  5 11 policy and the house of representatives committee on
  5 12 technology by no later than January 13, 1997.
  5 13    2.  It is also the intent of the general assembly that the
  5 14 education telecommunications council and the regional
  5 15 telecommunications councils give priority to network video
  5 16 usage during the normal school hours for grades
  5 17 prekindergarten through twelve at those video sites which are
  5 18 located within school district facilities.  The commission, in
  5 19 consultation with the education telecommunications council,
  5 20 shall establish a policy for flexibility of use for
  5 21 educational video classrooms during normal school hours for
  5 22 events unrelated to network use.
  5 23    Sec. 5.  CONTRACT MODIFICATION.  Notwithstanding section
  5 24 8D.13, the commission is authorized to negotiate a contract
  5 25 with Sooland Cable involving the connection of five Part III
  5 26 sites, to provide for a lump-sum payment at the time of
  5 27 installation and activation of the circuit which will result
  5 28 in a real savings within a range of $23,400 up to $27,000 per
  5 29 site when compared to the original contract price.
  5 30    Sec. 6.  ADDITIONAL CONNECTIONS.
  5 31    1.  LEWIS CENTRAL HIGH SCHOOL.  Notwithstanding section
  5 32 8D.13, subsection 5, the state may own and the Iowa
  5 33 telecommunications and technology commission shall provide for
  5 34 the construction and connection to the Iowa communications
  5 35 network of the Lewis Central high school, located in Council
  6  1 Bluffs and contiguous to the school for the deaf established
  6  2 under chapter 270.
  6  3    2.  ADDITIONS TO PART III.  The Iowa telecommunications and
  6  4 technology commission may contract for construction relating
  6  5 to connections to the Iowa communications network for the
  6  6 following authorized users which were not identified in the
  6  7 original Part III request for proposals, but which meet the
  6  8 definition of a Part III user pursuant to section 8D.13,
  6  9 subsection 2, paragraph "c":
  6 10    a.  Meservey-Thornton community school district, Thornton.
  6 11    b.  Eldora state training school, Eldora.
  6 12    c.  Iowa juvenile home, Toledo.
  6 13    d.  Four oaks educational center, Cedar Rapids.
  6 14    e.  Keystone area education agency, Dubuque.
  6 15    Sec. 7.  EFFECTIVE DATE.
  6 16    1.  Section 2, subsection 1, paragraph "d", of this Act,
  6 17 which authorizes the Iowa telecommunications and technology
  6 18 commission to begin negotiations for ordering necessary
  6 19 equipment prior to the availability of funding, being deemed
  6 20 of immediate importance, takes effect upon enactment.
  6 21    2.  Section 6, subsection 1, of this Act, which authorizes
  6 22 the state to construct and own the Iowa communications network
  6 23 connection to Lewis Central high school, being deemed of
  6 24 immediate importance, takes effect upon enactment.
