1 1 Section 1. NEW SECTION. 514C.11 POSTDELIVERY BENEFITS
1 2 AND CARE.
1 3 1. Notwithstanding section 514C.6, a person who provides
1 4 an individual or group policy of accident or health insurance
1 5 or individual or group hospital or health care service
1 6 contract issued pursuant to chapter 509, 514, or 514A or an
1 7 individual or group health maintenance organization contract
1 8 issued and regulated under chapter 514B, which is delivered,
1 9 amended, or renewed on or after July 1, 1996, and which
1 10 provides maternity benefits or newborn care benefits, shall
1 11 not terminate inpatient benefits or require discharge of a
1 12 mother or the newborn from a hospital following delivery
1 13 earlier than determined to be medically appropriate by the
1 14 attending physician after consultation with the mother and in
1 15 accordance with the most recent guidelines for perinatal care
1 16 established by the American academy of pediatrics and the
1 17 American college of obstetricians and gynecologists.
1 18 2. When performing utilization review of inpatient
1 19 hospital services related to maternity and newborn care,
1 20 including but not limited to length of postdelivery stay, any
1 21 person who provides an individual or group policy of accident
1 22 or health insurance or individual or group hospital or health
1 23 care service contract issued pursuant to chapter 509, 514, or
1 24 514A, or an individual or group health maintenance
1 25 organization contract issued and regulated under chapter 514B,
1 26 shall use the most recent guidelines for perinatal care
1 27 established by the American academy of pediatrics and the
1 28 American college of obstetricians and gynecologists.
1 29 EXPLANATION
1 30 This bill provides that a person who provides an individual
1 31 or group policy of accident or health insurance, an individual
1 32 or group hospital or health care service contract, or an
1 33 individual or group health maintenance organization contract,
1 34 which is delivered, amended, or renewed on or after July 1,
1 35 1996, and which provides maternity benefits or benefits for
2 1 newborns, shall not terminate inpatient benefits or require
2 2 the discharge of a mother or newborn from the hospital
2 3 following delivery earlier than is medically appropriate based
2 4 upon a determination by the attending physician in
2 5 consultation with the mother and in accordance with the
2 6 guidelines established by the American academy of pediatrics
2 7 and the American college of obstetricians and gynecologists.
2 8 The bill also requires that when any of the above named
2 9 entities is performing utilization review of inpatient
2 10 hospital maternity and newborn care services, including but
2 11 not limited to inpatient length of stay, the entity is to use
2 12 the most recent guidelines for perinatal care established by
2 13 the American academy of pediatrics and the American college of
2 14 obstetricians and gynecologists.
