PAG LIN 1 1 Section 1. Section 904.701, Code Supplement 1995, is 1 2 amended by adding the following new subsection: 1 3 NEW SUBSECTION. 6. All departments and independent 1 4 agencies of state government shall cooperate with the 1 5 department of corrections in employing inmates under this 1 6 program to the extent that such inmate labor does not displace 1 7 existing employees of the departments or independent agencies. 1 8 Sec. 2. 1995 Iowa Acts, chapter 166, section 2, is amended 1 9 to read as follows: 1 10 SEC. 2. DEVELOPMENT OF PLAN AND TRANSITION TO FULL WORK 1 11 PROGRAMMING BY DEPARTMENT. Notwithstanding section 1 of this 1 12 Act, the department of corrections shall not be required to 1 13 fully implement the requirements of section 904.701, until 1 14 July 1, 1997. However, the department of corrections shall 1 15 develop and implement a plan in consultation with stateand1 16 departments and independent agencies, local agencies, and 1 17 members of the private sector, which provides for the 1 18 incremental implementation of the hard labor requirements 1 19 contained in section 904.701, for each inmate who is 1 20 physically and mentally able to perform hard labor and does 1 21 not present an unreasonable security status, and who is not 1 22 currently engaged in labor meeting the requirements. The plan 1 23 shall provide for implementation of hard labor work programs 1 24 during the interval of time between the effective date of this 1 25 Act and July 1, 1997, with full implementation of the 1 26 requirements of section 904.701 by July 1, 1997, and may 1 27 provide for the performance of work by inmates both inside and 1 28 outside of the institutions under the control of the 1 29 department of corrections. The plan shall include a procedure 1 30 for the determination of suitability of an inmate for the 1 31 performance of hard labor and, if an inmate is found to be 1 32 suitable, the placement of the inmate in an appropriate hard 1 33 labor program. In selecting and developing work programs 1 34 which are included within the plan, the department of 1 35 corrections shall choose work programs which would require 2 1 minimal additional administrative costs,which minimize the2 2need for additional personnel,and whichminimize theensure 2 3 against security risks to the general public. These work 2 4 programs shall be overseen and implemented under the 2 5 supervision of the department of corrections by employees of 2 6 the department of corrections. The department of corrections 2 7 shall submit a report to the general assembly on January 1, 2 8 1996, outlining the progress made towards implementation of 2 9 this Act. The department of corrections shall also file a 2 10 copy of the completed plan with the general assembly on 2 11 January 1, 1997. 2 12 EXPLANATION 2 13 This bill requires the department of corrections and the 2 14 other state agencies and departments to work together to 2 15 employ the inmates under the hard labor program, which is 2 16 required by 1995 legislation to be fully implemented by July 2 17 1, 1997. 2 18 LSB 3175SV 76 2 19 jls/cf/24
