PAG LIN 1 1 Section 1. Section 257.2, subsection 12, Code 1995, is 1 2 amended to read as follows: 1 3 12. "State percent of growth" means the percent of growth 1 4which is established by statutecalculated pursuant to section 1 5 257.8, and which is used in determining the allowable growth. 1 6 Sec. 2. Section 257.8, subsection 1, Code 1995, is amended 1 7 by striking the subsection and inserting in lieu thereof the 1 8 following: 1 9 1. a. CALCULATION BY DEPARTMENT OF MANAGEMENT. On or 1 10 before December 31, 1995, the department of management shall 1 11 compute a state percent of growth for the budget year begin- 1 12 ning July 1, 1996, and a state percent of growth for the year 1 13 next following the budget year. 1 14 On or before December 31 of each subsequent base year, the 1 15 department of management shall compute a state percent of 1 16 growth for the budget year next following the budget year. 1 17 The state percents of growth shall be forwarded to the 1 18 director of the department of education. 1 19 b. BUDGET YEAR CALCULATION. For the budget year commenc- 1 20 ing July 1, 1996, the state percent of growth equals ninety 1 21 percent of the average of the following two percents of change 1 22 in receipts of state general fund revenues for the fiscal 1 23 years, computed or estimated by the state revenue estimating 1 24 conference created in section 8.22A as follows: 1 25 (1) The percent of change between the actual revenues 1 26 received during the second year preceding the base year and 1 27 the revised estimate of revenues received during the year 1 28 preceding the base year. 1 29 (2) The percent of change between the revised estimate of 1 30 revenues received during the year preceding the base year and 1 31 the estimate of revenues to be received during the base year. 1 32 c. CALCULATION FOR YEAR FOLLOWING BUDGET YEAR. For the 1 33 year following the budget year, the state percent of growth 1 34 equals ninety percent of the average of the following two 1 35 percents of change in receipts of state general fund revenues 2 1 for the fiscal years computed or estimated by the state 2 2 revenue estimating conference created in section 8.22A, 2 3 adjusted as provided in paragraph "d", as follows: 2 4 (1) The percent of change between the actual revenues 2 5 received during the year preceding the base year and the 2 6 revised estimate of revenues received during the base year. 2 7 (2) The percent of change between the revised estimate of 2 8 revenues received during the base year and the estimate of 2 9 revenues to be received during the budget year. 2 10 d. ADJUSTMENT. On or before December 31, 1996, and 2 11 December 31 of each subsequent base year, the department of 2 12 management shall recompute the state percent of growth for 2 13 that base year using the actual figures available. The 2 14 difference between the recomputed state percent of growth for 2 15 that base year and the original computation for that base year 2 16 shall be added to or subtracted from the state percent of 2 17 growth for the budget year next following the budget year, as 2 18 applicable. 2 19 e. DEFINITIONS. For purposes of this subsection: 2 20 (1) "Estimate of revenues" for a fiscal year is the 2 21 estimate made by the revenue estimating conference in December 2 22 of the fiscal year preceding that fiscal year. 2 23 (2) "Revised estimate of revenues" for a fiscal year is 2 24 the revised estimate made by the revenue estimating conference 2 25 in December of that fiscal year. 2 26 Sec. 3. Section 257.14, unnumbered paragraph 1, Code 1995, 2 27 is amended to read as follows: 2 28 For the budget years commencing July 1, 1991, July 1, 1992, 2 29 July 1, 1993, July 1, 1994, and July 1, 1995, if the 2 30 department of management determines that the regular program 2 31 district cost of a school district for a budget year is less 2 32 than one hundred percent, or for the budget year beginning 2 33 July 1, 1995, less than one hundred one percent, of the total 2 34 of the regular program district cost plus any adjustment added 2 35 under this section for the base year for that school district, 3 1 the department of management shall provide a budget adjustment 3 2 for that district for that budget year that is equal to the 3 3 difference. For the budget year commencing July 1, 1995, 3 4 there is appropriated from the general fund of the state to 3 5 the department of education an amount sufficient to pay, as 3 6 state supplementary aid, to those school districts the 3 7 additional adjustment amounts added to their budgets as a 3 8 result of increasing from a one hundred percent budget 3 9 guarantee to a one hundred one percent budget guarantee. 3 10 Sec. 4. EFFECTIVE DATES. 3 11 1. Section 3 of this Act, being deemed of immediate 3 12 importance, takes effect upon enactment and applies to the 3 13 school budget year commencing July 1, 1995. 3 14 2. Sections 1 and 2 of this Act take effect July 1, 1995, 3 15 for the calculation of the state percent of growth for school 3 16 budget years commencing on or after July 1, 1996. 3 17 EXPLANATION 3 18 The bill creates a formula for calculating state percent of 3 19 growth beginning with the 1996-1997 school budget year. The 3 20 formula is 90 percent of the average percent change in the 3 21 state general fund revenues for the three fiscal years ending 3 22 before the school year to which the percent of growth would 3 23 apply. The figures would be estimates except for the earliest 3 24 year which would be the actual revenues. Beginning with the 3 25 1998-1999 school year, in calculating the percent of growth 3 26 for that year, the calculation would include an adjustment for 3 27 what the percent of growth would be, if based upon actual 3 28 revenue figures, for the school year two years previous. 3 29 Present law guarantees that a school district's regular 3 30 program district costs for the budget year beginning July 1, 3 31 1995, will equal at least 100 percent of those district costs 3 32 plus any cost guarantee adjustment for previous school budget 3 33 years. This bill increases that guarantee from 100 percent to 3 34 101 percent for the budget year beginning July 1, 1995. The 3 35 bill makes appropriations from the state general fund to pay 4 1 school districts the amounts by which their budgets increased 4 2 because of the guarantee being changed from 100 percent to 101 4 3 percent. 4 4 The bill provides effective dates. 4 5 LSB 2552SV 76 4 6 mg/jw/5
