1 1 Section 1. Section 272C.3, subsection 1, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. k. Establish a licensee review committee
1 4 for the purpose of evaluating and monitoring licensees who
1 5 self-report physical or mental impairments to the board. The
1 6 board shall adopt rules for the establishment and
1 7 administration of the committee, including but not limited to
1 8 establishment of the criteria for eligibility for referral to
1 9 the committee and the grounds for disciplinary action for
1 10 noncompliance with committee decisions. Information in the
1 11 possession of the board or the licensee review committee,
1 12 under this paragraph, shall be subject to the confidentiality
1 13 requirements of section 272C.6. Referral of a licensee by the
1 14 board to a licensee review committee shall not relieve the
1 15 board of any duties of the board and shall not divest the
1 16 board of any authority or jurisdiction otherwise provided. A
1 17 licensee who violates section 272C.10 or the rules of the
1 18 board while under review by the licensee review committee
1 19 shall be referred to the board for appropriate action.
1 20 EXPLANATION
1 21 This bill provides for the establishment by each licensing
1 22 board named in chapter 272C of a licensee review committee for
1 23 the purpose of evaluating and monitoring licensees who self-
1 24 report physical or mental impairments to the board. The bill
1 25 provides that if a licensee referred to the committee violates
1 26 an existing ground for revocation or suspension of a license
1 27 while under the review of the committee, the licensee is to be
1 28 referred to the licensing board for appropriate action. The
1 29 bill also directs each licensing board to adopt rules for the
1 30 establishment and administration of a committee, provides that
1 31 information in possession of the licensing board or the
1 32 committee due to self-reporting of a licensee is confidential,
1 33 and provides that the establishment of the committee does not
1 34 relieve the licensing board of the board's duties nor does the
1 35 establishment of the committee divest the board of the
2 1 authority or jurisdiction that the board would otherwise have.
