1 3 (COMPANION TO LSB 2441HH BY VAN MAANEN)
1 4 A Concurrent Resolution urging the Congress of the
1 5 United States to allow retired members of the
1 6 United States Armed Forces who have a service-
1 7 connected disability to concurrently receive
1 8 retired pay and disability compensation.
1 9 WHEREAS, persons retired from military service are
1 10 required by law to waive from their longevity
1 11 retirement pay an amount equal to the compensation for
1 12 service-connected disability paid by the United States
1 13 Department of Veterans Affairs; and
1 14 WHEREAS, retired military personnel are the only
1 15 federal personnel required to waive the compensation;
1 16 and
1 17 WHEREAS, the waiver is discriminatory and unjust;
1 18 and
1 19 WHEREAS, the military retirement system is unique
1 20 because it is the top incentive for high quality
1 21 people to consider making a career in the United
1 22 States Armed Forces and is a central issue in
1 23 sustaining active duty retention and readiness; and
1 24 WHEREAS, military retired pay is purely earned
1 25 compensation; and
1 26 WHEREAS, large financial sacrifices already have
1 27 been imposed on career military members; and
1 28 WHEREAS, the long-term retired pay, plus service-
1 29 connected disability compensation, will trail
1 30 inflation as the military population declines and
2 1 lower cost-of-living adjustment rules take effect for
2 2 those persons who came on active duty after 1986; and
2 3 WHEREAS, currently only about 17 percent of those
2 4 who enter military service are thinking of making the
2 5 military service a career, citing unwillingness to
2 6 endure the sacrifices of hazardous duty, family
2 7 separation, frequent moves, forfeiture of personal
2 8 freedoms, and a forced midlife career change after 20
2 9 years of service; and
2 10 WHEREAS, military members are compelled by law and
2 11 policy to retire in their forties, which is the point
2 12 of their maximum financial need because of college-age
2 13 children, home mortgages, and the need for family
2 14 health care insurance, and their own retraining needs,
2 15 as most retirees served in the combat arms
2 16 skills&endash;infantry, artillery, and armor&endash;and have no
2 17 immediate transferable civilian career field job
2 18 opportunities; NOW THEREFORE,
2 19 BE IT RESOLVED BY THE SENATE, THE HOUSE OF
2 20 REPRESENTATIVES CONCURRING, That the Congress of the
2 21 United States be urged to adopt H. 65 which will allow
2 22 retired members of the United States Armed Forces who
2 23 have service-connected disabilities to concurrently
2 24 receive retired pay without reduction of the amount of
2 25 their United States Department of Veterans Affairs
2 26 disability compensation.
2 27 BE IT FURTHER RESOLVED, That copies of this
2 28 resolution be sent to the Governor of Iowa, the
2 29 President of the United States, the President of the
2 30 United States Senate, the Speaker of the United States
3 1 House of Representatives, and the members of Iowa's
3 2 congressional delegation.
