1 3 #1. By striking page 1, line 27 through page 2,
1 4 line 7, and inserting the following:
1 5 "b. Notwithstanding contrary provisions of chapter
1 6 8D, upon completion of the study established in 1995
1 7 Iowa Acts, House File 461, enacted during the 1995
1 8 regular session, and upon a determination under the
1 9 study that the sale of the network is practicable, the
1 10 commission shall develop a request for proposals for
1 11 the sale of the Iowa communications network. The
1 12 request for proposals shall provide for the assurance
1 13 of affordable access to the network for public
1 14 entities, including Part III users, which are not yet
1 15 connected to the network. The request for proposals
1 16 shall also provide that all remaining Part III sites
1 17 which are not connected to the network by June 30,
1 18 1996, shall be connected by July 1, 1999. The
1 19 commission shall not enter into an agreement related
1 20 to a proposal submitted in response to the request for
1 21 proposals without the prior authorization by a
1 22 constitutional majority of each house of the general
1 23 assembly and approval by the governor. The commission
1 24 shall deliver a written report on or before March 15,
1 25 1996, to the general assembly which shall include all
1 26 proposals submitted in response to the request for
1 27 proposals and the recommendations of the commission
1 28 regarding the proposals."
