1 1 Section 1. STUDIES.
1 2 1. a. The Iowa telecommunications and technology
1 3 commission established in section 8D.3 shall initiate and
1 4 complete a study concerning the possible sale of the network.
1 5 The study shall include a review of legal and practical issues
1 6 which may affect whether the sale of the network should be
1 7 approved or rejected, or which may affect the terms under
1 8 which a sale should be completed. The study shall include a
1 9 review of issues including all of the following:
1 10 (1) The effect of the sale on the tax-exempt bonds which
1 11 were issued for purposes of financing certain parts of the
1 12 network.
1 13 (2) The impact on existing telecommunications providers.
1 14 (3) The protection of state interests including the
1 15 assurance of affordable access to the network for public
1 16 entities, including Part III users which are not yet connected
1 17 to the network.
1 18 (4) The necessity of compliance with other applicable
1 19 state law.
1 20 (5) Issues relating to the use of public rights-of-way by
1 21 any potential buyer of the network.
1 22 (6) Benefits to Iowa businesses and citizens.
1 23 (7) Providing for a long-term lease of capacity sufficient
1 24 to meet the needs of existing and future educational users of
1 25 the network identified in chapter 8D.
1 26 (8) A review of whether a sale of the network should be
1 27 completed pursuant to a request for proposals or by auction.
1 28 (9) A review of the impact of federal communications
1 29 commission policy and regulations on the potential sale of the
1 30 network in its entirety or in parts, and a recommendation as
1 31 to the manner in which the network should be sold as a result
1 32 of this review.
1 33 (10) Other relevant issues as identified by the
1 34 commission.
1 35 b. The commission shall consult with other state agencies,
2 1 appropriate federal agencies, and private associations and
2 2 vendors in completing this study.
2 3 2. The commission, in consultation with the utilities
2 4 division of the department of commerce, shall study the
2 5 possible conversion of the Iowa communications network into a
2 6 public utility. The study shall include a review of legal and
2 7 practical issues identified by the commission and the division
2 8 which may affect such conversion.
2 9 3. The commission, prior to November 1, 1995, shall
2 10 complete the studies required by this Act and deliver a
2 11 written report including any recommendations related to each
2 12 study to the members of the house of representatives committee
2 13 on technology and the senate committee on communications and
2 14 information policy, the chief clerk of the house, and the
2 15 secretary of the senate.
