PAG LIN 1 1 Section 1. Section 257.8, subsection 1, Code 1995, is 1 2 amended to read as follows: 1 3 1. STATE PERCENT OF GROWTH.TheBeginning with the 1995 1 4 regular session and for each two years thereafter, the state 1 5percentpercents of growth forathe following two budgetyear1 6 years shall be established by statute which shall be enacted 1 7 within thirty days of the submission in thebaseodd-numbered 1 8 year of the governor's budget under section 8.21. The 1 9 establishment of the statepercentpercents of growth fora1 10 the following two budgetyearyears shall be the only subject 1 11 matter of the bill which enacts the statepercentpercents of 1 12 growth forathose budgetyearyears. 1 13 Sec. 2. Section 257.8, Code 1995, is amended by adding the 1 14 following new subsections: 1 15 NEW SUBSECTION. 1A. GENERAL ASSEMBLY EXPENSES. 1 16 Notwithstanding section 2.10, subsection 1, if the state 1 17 percents of growth have not been established by the thirtieth 1 18 day, the maximum number of days that members of the general 1 19 assembly may receive per diem during the regular session in 1 20 the odd-numbered year under section 2.10, subsection 1, shall 1 21 be reduced by one day for each day following the thirtieth day 1 22 until the state percents of growth have been established under 1 23 subsection 1. However, the maximum number of days that 1 24 members may receive per diem shall not be reduced by more than 1 25 forty days. 1 26 NEW SUBSECTION. 1B. GOVERNOR'S SALARY. Notwithstanding 1 27 any statute setting the salary of the governor of the state, 1 28 if the state percents of growth have not been set as required 1 29 under subsection 1, the salary of the governor shall be 1 30 reduced for each day for which the maximum number of days that 1 31 members of the general assembly may receive per diem under 1 32 section 2.10, subsection 1, is reduced under subsection 1A. 1 33 The reduction in salary shall be in an amount equal to the 1 34 annual daily salary of the governor if the governor were to be 1 35 paid a daily salary. 2 1 Sec. 3. This Act, being deemed of immediate importance, 2 2 takes effect upon enactment and applies to establishing the 2 3 state percents of growth for school budget years beginning on 2 4 or after July 1, 1995. 2 5 EXPLANATION 2 6 The bill requires that beginning with the 1995 regular 2 7 session and each two years thereafter the state percents of 2 8 growth shall be established for each of the following two 2 9 school budget years within 30 days of the submission of the 2 10 governor's budget. 2 11 The bill provides that if the general assembly has not 2 12 established the state percents of growth within 30 days of the 2 13 submission of the governor's budget, the maximum number of 2 14 days for which members may receive per diem are to be reduced 2 15 by one day for each day following the thirtieth day until such 2 16 time as it is established. However, the maximum would not be 2 17 reduced by more than 40 days. The governor's salary would 2 18 also be reduced proportionally for the same number of days 2 19 that the maximum per diem days are reduced.
