1 1 Section 1. Section 135I.2, Code 1995, is amended to read
1 2 as follows:
1 3 135I.2 APPLICABILITY.
1 4 This chapter applies to all swimming pools and spas owned
1 5 or operated by local or state government, or commercial
1 6 interests or private entities including, but not limited to,
1 7 facilities operated by cities, counties, public or private
1 8 school corporations, hotels, motels, camps, apartments,
1 9 condominiums, and health or country clubs. This chapter does
1 10 not apply to facilities intended for single family use or to a
1 11 swimming pool or spa operated by a homeowner's association
1 12 representing seventy-two or fewer dwelling units if the
1 13 association's bylaws, which also apply to a rental agreement
1 14 relative to any of the dwelling units, include an exemption
1 15 from the requirements of this chapter, provide for inspection
1 16 of the swimming pool or spa by an entity other than the
1 17 department or local board of health, and assume any liability
1 18 associated with operation of the swimming pool or spa. To
1 19 avoid duplication and promote coordination of inspection
1 20 activities, the department may enter into agreements pursuant
1 21 to chapter 28E with a local board of health to provide for
1 22 inspection and enforcement in accordance with this chapter.
