1 2 BY SALTON
1 3 A Concurrent Resolution urging the United States Congress
1 4 to enact legislation and appropriate funding to ensure
1 5 that drainage district assessments are not adversely
1 6 affected by federal acquisitions of lands in drainage
1 7 districts.
1 8 WHEREAS, in some areas of the state of Iowa,
1 9 substantial federal acquisitions of lands in drainage
1 10 districts for waterfowl and wildlife habitat are
1 11 focusing the cost of maintaining drainage district
1 12 infrastructure on the remaining property owners in
1 13 drainage districts; and
1 14 WHEREAS, the state of Iowa by statute must pay
1 15 drainage district assessments against lands which the
1 16 state of Iowa owns or holds title to; and
1 17 WHEREAS, property owners in the state of Iowa
1 18 within drainage districts must pay drainage district
1 19 assessments or risk losing their lands; and
1 20 WHEREAS, it is not equitable that the federal
1 21 government can acquire lands within drainage districts
1 22 from property owners who were financially responsible
1 23 for drainage district assessments without assuming
1 24 this financial responsibility, thus forcing the
1 25 remaining property owners within the drainage district
1 26 to pay the federal government's share of the drainage
1 27 district assessment; NOW THEREFORE,
1 28 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
1 29 SENATE CONCURRING, That the United States Congress
1 30 enact legislation and appropriate funding to ensure
2 1 that when the federal government acquires lands within
2 2 drainage districts, the federal government shall pay
2 3 its share of drainage district assessments; and
2 4 BE IT FURTHER RESOLVED, That the Chief Clerk of the
2 5 House of Representatives send a copy of this
2 6 resolution to the Speaker of the United States House
2 7 of Representatives, to the Majority Leader of the
2 8 United States Senate, and to the members of Iowa's
2 9 congressional delegation.
