1 1 Amend the amendment, H-5419, to Senate File 2443,
1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 13, by inserting after line 13 the
1 5 following:
1 6 "Sec. . NEW SECTION. 15A.4 CONTROLLED
1 7 SUBSTANCE OFFENSE – REPAYMENT OF ASSISTANCE.
1 8 A business which receives economic development
1 9 assistance shall enter into an agreement with the
1 10 governmental entity providing the assistance to repay
1 11 the assistance received by the business if one of the
1 12 following individuals is convicted of a violation of
1 13 chapter 124 committed during the period in which the
1 14 agreement is in effect:
1 15 1. The owner, if the business is a sole
1 16 proprietorship.
1 17 2. A partner or managing partner, if the business
1 18 is a partnership or limited partnership.
1 19 3. A member of a limited liability company with
1 20 management responsibilities.
1 21 4. The chief operating officer of a corporation."
1 22 #2. By renumbering as necessary.
