  1  1    Amend the amendment, H-3985, to Senate File 481, as
  1  2 amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 6, by inserting after line 22 the
  1  5 following:
  1  6    "Sec.    .  Section 321.449, unnumbered paragraph
  1  7 4, Code 1995, is amended to read as follows:
  1  8    Notwithstanding other provisions of this section,
  1  9 rules adopted under this section for a driver drivers
  1 10 of a commercial vehicle vehicles shall not apply to a
  1 11 driver for a private carrier, who is not for hire and
  1 12 of a commercial vehicle who is engaged exclusively in
  1 13 intrastate commerce, when the driver's commercial
  1 14 vehicle is not operated more than one hundred miles
  1 15 from the driver's work reporting location vehicle's
  1 16 gross vehicle weight rating is 26,000 pounds or less,
  1 17 unless the vehicle is used to transport hazardous
  1 18 materials requiring a placard or if the vehicle is
  1 19 designed to transport more than fifteen passengers,
  1 20 including the driver.  For the purpose of complying
  1 21 with the hours of service recordkeeping requirements
  1 22 under 49 C.F.R. } 395.1(e)(5), a driver's report of
  1 23 daily beginning and ending on duty time submitted to
  1 24 the motor carrier at the end of each work week shall
  1 25 be considered acceptable motor carrier time records.
  1 26 In addition, rules adopted under this section shall
  1 27 not apply to a driver for a farm operation as defined
  1 28 in section 352.2, or for an agricultural interest when
  1 29 the commercial vehicle is operated between the farm as
  1 30 defined in section 352.2 and another farm, between the
  1 31 farm and a market for farm products, or between the
  1 32 farm and an agribusiness location.  A driver or a
  1 33 driver-salesperson for a private carrier, who is not
  1 34 for hire and who is engaged exclusively in intrastate
  1 35 commerce may drive twelve hours, be on duty sixteen
  1 36 hours in a twenty-four hour period and be on duty
  1 37 seventy hours in seven consecutive days or eighty
  1 38 hours in eight consecutive days.  A driver-salesperson
  1 39 means as defined in 49 C.F.R. } 395.2, adopted as of a
  1 40 specific date by the department by rule."
